Dear Mr. Sheetz:
This letter regards revisions to the site plan for the Sheetz
Convenience Store located along U.S. Route 522 North in Frederick
County, Virginia. The original site plan received administrative
approval on April 2, 1991.
Mr. Austin Spitler of Greenway Engineering revised this plan to
indicate a new location for the dumpster/recycling pad, as well as
the addition of five (5) parking spaces. This plan was received
by our office on June 4, 1991 and received administrative approval
the same day. Enclosed is a copy of the revised site plan for your
files.

Dear Mr. Pearl:
I am writing in response to our recent site review of the referenced project.
Listed below are several items which will need corrective action prior to this
office being able to mark the permits complete.
1. The line brace post at the end of the limited access fence on Route 522
has been damaged and will need replacing.
2. Several sections of curb and gutter with reversed pan just south of the
Route 522 entrance will need to be replaced to standard. This also
includes a section of the entrance radius itself.
3. The curb and gutter on Route 739 from the backside of the entrance radius
to the property line will need to be removed and replaced to standard and
realigned to provide for 16' offset from center line of the road to face
of curb. Also, in order to do so, the drainage structure will need to be
relocated and its top lowered.
4. The pavement patch over the triple line of culverts under Route 739 has
settled and will need to be overlaid with plant mix. Also, an area just
adjacent to the Fox Drive entrance will need to be overlaid to provide for
positive drainage to the gutter line.
5. A curb cut with modified inlet and P.V.C. storm drain is to be installed
from the northern radius of the Fox Drive entrance to the existing
junction box to relieve ponding water in this area.
6. The two (2) sanitary sewer manholes within the Fox Drive right-of-way are
to be lowered to provide for positive drainage away from the roadway
surf ace .
7. A 20' length of 28"x20" C.M.P.A. will need to be provided for a field
entrance into the Russon Property.

It is my understanding Mr. H. Bruce Edens of Greenway, Inc. will be providing
the necessary layout work as well as design for the P.V.C. drainage system.
Also, through copy of this letter to Mr. Edens I am requesting a deed of
dedication along with a plat to cover the dedication along Route 739 be submit
to our office for review.
Please give me a call a couple days in advance of when you plan to move back
on site so we may provide for any necessary inspections.

I am writing in response to our telephone conversation this date concerning
the referenced project. As you are aware the installation of the new entrance
and CG-6 on Route 739 has resulted in somewhat of a drainage problem.
Furthermore, the quality and standard of several sections of the new curb and
gutter within the right-of-way are questionable and may need to be replaced.
As discussed, this situation will most definitely need to be rectified.
However, prior to any corrective action being taken we will require an
engineered plan with spot elevations taken on the curb and gutter (both old
and new) for review. Once available please send them to my attention at the
above address.
In the meantime should you have any questions, please give me a call.

This letter regards the revision to the original Sheetz Site Plan
that was administratively approved on February 25, 1991. This
revision relocates the 6000 gallon underground kerosine storage
tank on this site. The new location of this tank will provide
greater separation distance from the convenience store, as well as
remove the fill cap from an area used for customer parking. The
revised site plan was administratively approved on April 2, 1991.

The Frederick County Planning Department administratively approved
Site Plan #002-91 of Sheetz Convenience Store on February 25, 1991.
This plan calls for the construction of a 3,000 square foot
convenience store, a 4,300 square foot canopy to cover the gas pump
area, 19 parking spaces, one handicapped parking space equipped
with a handicapped ramp, a five foot concrete walkway, C-G 6 curb
and guttering, a stormwater management area complete with rip -rap
and triple reinforced concrete pipe, an 8' x 16' concrete pad with
a 6' high wooden fence and gate to house dumpsters, a double horn
light, a business sign, all required landscaping and all
appropriate erosion and sediment control measures. Enclosed is a
copy of the approved site plan for your records.

AGREEMENT
This agreement, made this 20th day of February ,

Whereas, in consideration of the approval by the party of the
second part of this Virginia land disturbance plan and permit for
Sheetz Mini -Mart
and the party of the second part requiring the following work to
be completed during the land disturbance construction and before
final occupancy, the party(s) of the first part or his heirs/
assigns agree to do the following work:
lz Provide for the adequate control of erosion and sedimentation
by temporary and permanent control practices and measures
which will be implemented during all phases of clearing,
grading and construction and to provide for conformity with
the Virginia Erosion and Sediment Control Law, Title 21,
Chapter 1, Article 6.1 of the Code of Virginia and local code

RE: Preliminary Site Plan Review Of Sheetz Mini -Mart
Dear Courtney:
This letter regards my preliminary site plan review of Sheetz Mini -
Mart, located on the southwest corner of Route 522 North and Route
739. The overall concept and design of this project is fine;
however, there are some minor revisions that need to be made before
I can recommend approval of this project. I offer the following
comments:
1) The use of the property owned by W.H. Emmart & Sons needs to
be provided.
2) The limits of curb and guttering end before the northern -most
portion of the entrance off of Fox Drive - why is this not
extended?
3) The layout of the proposed landscaping would be better if
there was an additional tree located along the 5' concrete
walkway two parking spaces up from the handicapped parking
space, as well as an additional tree beside the parking space
nearest boundary line survey N63,42,20 E39,37.
4) It is difficult for me to interpret the landscaping legend.
I am not sure what B & B means, nor what the numerical
classifications stand for. Please remember that the County
requires trees to be four (4) feet in height at time of
planting.
5) The parking space layout is fine; however, the length needs
to be double checked. The six spaces directly in front of the
mini -mart should total 54' in width and the handicapped
parking space should be a minimum of 12' in width.
6) If there are outdoor lighting fixtures proposed for this
project, they need to be located.
7) Bruce Edens signature is required on the land surveyor's
certificate.

This site plan will appear on the Planning Commissions bimonthly
report for their regular meeting of February 20, 1991. If the
comments in this letter and all other review agency comments are
addressed by this meeting, I will recommend approval of this site

Per our telephone conversation this date enclosed you will find four (4)
copies of our standard Form CE-7 Land Use Permit application for your review.
You will need to sign and date these where indicated in red.
Also enclosed is surety bond Form MP-20. Please have your insurance company
complete this form for the amount of $30,000.00 and submit it to this office
with an attached power of attorney, the executed permit applications and a
check made payable to the Virginia Department of Transportation in the amount
of $70.00. Please allow thirty (30) days for processing and issuance of the
permit assembly.
The full salary and expenses of a State assigned Inspector for this project
will be set up on an account receivable number and any charges billed to your
company on a monthly basis.
As we discussed, a separate permit will be required for the proposed utilities
within the Route 739 right-of-way. This permit should be coordinated with
Mr. John Whitacre of the Frederick County Sanitation Authority.
At this time I would like to remind you no work can be performed on the
State's right-of-way until the appropriate permits are issued.

This is to acknowledge receipt of the above referenced project's revised site
plans dated February 5, 1991. The resubmitted plans appear to be satisfactory
and are therefore approved. Please advise the developer accordingly.
The developer may now make application to this office for the necessary land
use permits to cover the work to be performed on the State's right-of-way.
Two (2) permits will be required. One for the entrance modifications &
culvert installation and another for utility installations along Route 739.
The utility permit application will need to be coordinated with the Frederick
County Sanitation Authority. These permits will require a minimum fee, surety
bond coverage and the salary & expenses of a State assigned Inspector while
working on the right-of-way.
Please ensure the developer understands the 1.5' dedication on the west side
of Route 739 and the acquisition of the required 15'x10' drainage easement at
the outfall of the triple line of 23"xl4" E.R.C.P. will need to be completed
prior to issuance of the permits.

As requested we have reviewed the above referenced project's site plans' dated
December 20, 1990. Our recommendations may be found on the attached plans
marked in red and as follows:
1. A standard CG-8 concrete gutter is to be installed across the entrance on
Route 739 for drainage.
2. Standard CG-6 should be constructed on both sides of the entrances to
tie-in with the existing curb and gutter on Routes 739 and 522 as noted.
3. A standard DI-3B drop inlet is to be installed along Route 522 at the
beginning radius to Fox Drive to relieve drainage along Route 739.
4. The proposed CG-8 entrance gutter to serve the Russon property is to be
widened as noted.
5. The two (2) existing inlets and pipe in the entrance being abandoned are
to be removed. The 27" pipe and JB openings are to be patched. -
6. The existing shrubs on the Route 522 right-of-way should be removed to
enhance existing sight distance.
7. An emergency spillway needs -to be provided in the stormwater management
basin near the inlet end of the 42"x 27" pipe. The inlet end of this
culvert should be mitered on a 2:1 slope.
8. Due to current budget restraints we will be unable to participate in the
costs of the triple line of 23"x14" E.R.C.P. to be installed across
Route 739. However, it is our understanding the developer of the proposed
Foxridge development just south of this location may be willing to
participate. We suggest contacting his agent, Mr. C. E. Mattox, Jr. of
G. W. Clifford & Associates to discuss this matter. A 15'x10' easement
will need to be obtained at the outlet end of these pipes for installation
and maintenance.

9. As we have recently discussed a plant mix overlay of Route 739 over the
area to be open cut for storm sewer and waterline installation will be
required. This area may need to be extended as noted due to possible
construction damage. A determination on this will be made by this
Department after all work is complete.
Please revise the plans in accordance with the above and resubmit four (4)
copies for final approval. You will also note several existing conditions
marked on the plans in green. These items should be incorporated into the
plans as well. Should any changes be deemed necessary please design them to
meet or exceed the above recommendations.

We have reviewed the above referenced site plan as
submitted and offer the following comments:
GENERAL
The plan and computations need to be sealed and signed by
a registered engineer or 3B surveyor.
ACCESS ISSUES
We have no comments on the access issues. The existing
driveways seem adequate to handle the projected traffic
for this development. It would be desirable from the
County's standpoint to eliminate the eastern entrance off
of Route 522, but since it exists and does not appear to
create any major problems it should not be an issue.
DRAINAGE AND STORMWATER MANAGEMENT
1. Stormwater management calculations and drainage divide
map was provided. The stormwater management analysis
was thoroughly done and calculations look good. The
culvert under fOX Road is roughly 16 cfs. This project
does not appear to impact this culvert.
2. The way the proposed pond is to be graded shows it as
flat on the bottom which would create a marshy area.
This can be remedied and still maintain the pond
storage volume by using the stone rip -rap section as a
seepage release. Allow approximately 6 inches of rip -
rap depth below the 819 invert of the wier which would
allow minimal slope to the existing culvert. Grade the
invert of the pond to about 818.7 at about 5 feet in
front of the rip -rap. Where the 819 contour is
indicated around the pond, this should be set at

approximately 819.3 to allow for some minimal fall
across the pond bottom. The rip -rap will need to be
kept clear from silt or this too will block drainage
which will create standing water.
3. The timber wier should be embedded in the embankment
more than indicated to ensure that it does not get
washed out. I would suggest that timber no less that
(8) eight feet be used for a total width of 1818" at
the bottom and the top timber then set back to the
indicated 2'8" separation with the end flush with the
bottom timber.

Dear Courtney:
As requested we have reviewed the above referenced project's site plans dated
December 20, 1990. Our recommendations may be found on the attached plans
marked in red and as follows:
1. A standard CG-8 concrete gutter is to be installed across the entrance on
Route 739 for drainage.
2. Standard CG-6 should be constructed on both sides of the entrances to
tie-in with the existing curb and gutter on Routes 739 and 522 as noted.
3. A standard DI-3B drop inlet is to be installed along Route 522 at the
beginning radius to Fox Drive to relieve drainage along Route 739.
4. The proposed CG-8 entrance gutter to serve the Russon property is to be
widened as noted.
5. The two (2) existing inlets and pipe in the entrance being abandoned are
to be removed. The 27" pipe and JB openings are to be patched.
6. The existing shrubs on the Route 522 right-of-way should be removed to
enhance existing sight distance.
7. An emergency spillway needs to be provided in the stormwater management
basin near the inlet end of the 42"x 27" pipe. The inlet end of this
culvert should be mitered on a 2:1 slope.
8. Due to current budget restraints we will be unable to participate in the
costs of the triple line of 23"x14" E.R.C.P. to be installed across
Route 739. However, it is our understanding the developer of the proposed
Foxridge development just south of this location may be willing to
participate. We suggest contacting his agent, Mr. C. E. Mattox, Jr. of
G. W. Clifford & Associates to discuss this matter. A 15'x10' easement
will need to be obtained at the outlet end of these pipes for installation
and maintenance.
