Rezone 200 acres
from A-2 (Agricultural General)
to RP (Residential Performance)
LOCATION: At the intersection of Routes 642 and 636, just east of Stephens City
MAGISTERIAL DISTRICT: Opequon
ADJACENT LAND USE AND ZONING: Vacant agricultural and residential uses zoned RP
(Residential Performance) and A-2 (Agricultural General)
PROPOSED USE AND IMPROVEMENTS: Residential building sites
REVIEW EVALUATIONS:
Transportation Department - No objection to the rezoning request.
Sanitation Authority - Water and sewer are not presently provided. It will
be provided by the Wrights Run/Parkins Mill Interceptor and water lines
extended from Wakeland Manor.
Health Department - No objections as long as a connection is made to central
water and sewer.
Stephens City Fire Company - No objections.
Planning and Zoning - The following issues should be considered:
Location: This site is located in the Urban Development Area as designated
by the Comprehensive Plan. Land currently zoned RP is located to the north
of this site, directly across Route 642. Land currently zoned RP is adjacent
to the east and across Route 642 to the north.
Site Suitability: The site is a relatively level, mostly wooded site with
frontage on Routes 642 and 636. The site does not contain prime agricultural
soils. The Soil Conservation Service describes much of this site as having
seasonally high water tables. Special methods for dealing with drainage may
be needed on this site.
REZONING REQUEST #001-88
ADD Partnership
The western portion of this site could be served by gravity sewer to the
planned Wrights Run interceptor which will be located in the vicinity of the
western boundary of this site. The sewer service to the eastern portion of
the site would require pumping.
Impacts: No adverse environmental impacts would be anticipated. The
rezoning could result in a substantial increase in traffic on Routes 642 and
636. When fully developed at an average of three units per acre, the site
could generate over 5,000 average daily trip ends.
The two-lane capacities on Routes 642 and 636 are probably less than 7,000
vehicles per day. With full build out of this property and with the
development of surrounding properties, traffic on Routes 642 and 636 will
reach the capacity of the roads, causing traffic problems. A complete
reconstruction of Route 642 is included in the Six Year Secondary Road
Improvement Plan.
It is the staff's understanding that local funds have been allocated to use
VDOT's revenue sharing program to improve Route 642 from Route 522 to west of
the intersection with Route 647. This funding should move the improvement of
Route 642 to a time roughly concurrent with the likely development schedule
for this land. It will substantially improve access to the site.
Conclusions: The site is in the Urban Development Area and is adjacent to
existing RP zoning. Road improvement plans are underway that should deal
with road impacts.
STAFF RECOMMENDATION: Approval.
PLANNING COMMISSION RECOMMENDATIONS OF 5/3/89: Unanimous approval.

May 10, 1989
As per our preliminary studies, it appears that the entire site
will sewer by either gravity with deep sewers or a combination of
pump station", force. main, and gravity sewers.
Until a final development plan is completed the systems cannot be
designed.
As a general overview, it appears that the majority of the site
will sewer by gravity.

REVIEW EVALUATIONS:
Transportation Department - No objection to the rezoning request.
Sanitation Authority - Water and sewer are not presently provided. It will
be provided by the Wrights Run/Parkins Mill Interceptor and water lines
extended from Wakeland Manor.
Health Department - No objections as long as a connection is made to central
water and sewer.
Stephens City Fire Company - No objections.
Planning and Zoning - The following issues should be considered:
Location: This site is located in the Urban Development Area as designated
by the Comprehensive Plan. Land currently zoned RP is located to the north
of this site, directly across Route 642. Land currently zoned RP is adjacent
to the east and across Route 642 to the north.
Site Suitability: The site is a relatively level, mostly wooded site with
frontage on Routes 642 and 636. The site does not contain prime agricultural
soils. The Soil Conservation Service describes much of this site as having
seasonally high water tables. Special methods for dealing with drainage may
be needed on this site.
The western portion of this site could be served by gravity sewer to the
planned Wrights Run interceptor which will be located in the vicinity of the
western boundary of this site. The sewer service to the eastern portion of
the site would require pumping.

Impacts: No adverse environmental impacts would be anticipated. The
rezoning could result in a substantial increase in traffic on Routes 642 and
636. When fully developed at an average of three units per acre, the site
could generate over 5,000 average daily trip ends.
The two-lane capacities on Routes 642 and 636 are probably less than 7,000
vehicles per day. With full build out of this property and with the
development of surrounding properties, traffic on Routes 642 and 636 will
reach the capacity of the roads, causing traffic problems. A complete
reconstruction of Route 642 is included in the Six Year Secondary Road
Improvement Plan. However, due to funding limitations, that project will
possibly not begin during the next six years. The portion of Route 636 that
would be impacted is not on the road improvement program.
Conclusions: The site is in the Urban Development Area and is adjacent to
existing RP zoning. However, substantial potential traffic impacts are of
concern due to the limitations on Routes 642 and 636. The Comprehensive Plan
suggests that new urban development should be approved in the Urban
Development Area when roads with sufficient capacity have been provided (page
55). It is not clear that sufficient road capacity is available at this
site.
STAFF RECOMMENDATION: Denial.

pursuant to my request at the time of filing of the application
that this matter be heard in April, 1988, I would request that
the rezoning of ADD Partnership's 200 Acre tract be postponed
for several weeks until the Frederick County authorities can
make a decision on the interceptor line which is scheduled for
Wright's Run -Parkins Mill Road Sewer Plant.
It would seem to me that the zoning issue on the ADD
Partnership property will hinge on great part upon the decision
as to whether or not to build that interceptor line.

THIS DEED made and dated this 29th day of December,
1986, by and between HERSCHEL C. PANGLE and JOAN ANN PANGLE,
his wife, parties of the first part, hereinafter called the
Grantors, and ADD PARTNERSHIP, a Virginia Partnership, party
of the second part, hereinafter called the Grantee.
WITNESSETII: That for and in consideration of the sum
of Ten ($10.00) Dollars, cash in hand paid, and other good and
valuable consideration, the receipt of which is hereby acknowl-
edged, the Grantors do hereby grant and convey with general
warranty of title unto the Grantee, in fee simple, as specific
partnership property, pursuant to Title 50, Code of Virginia,
1950, as amended, all of that certain lot or parcel of land,
together with the improvements thereon and the appurtenances
thereunto belonging, containing 200 Acres, more or less, lying
and being situate along the Southern side of Virginia State
Secondary highway No. 642 and the Western side of Virginia
State Secondary IIighway No. 636, about five (5) miles South of
Winchester, in Opequon Magisterial District, Frederick County,
Virginia; and being the same land conveyed to the Grantors
herein by deed dated September 19, 1983, from Herschel C.
,Pangle, et ux, which deed is of record in the Office of the
Clerk of the Circuit Court of Frederick County, Virginia in
Deed Book 566 at Page 120. Reference is made to the said deed
for a more particular description of the property herein
conveyed.
This conveyance is made subject to all easements,
rights of way and restrictions of record affecting the subject
property.
The Grantors hereby covenant that they have the right
to convey to the Grantee, that the Grantee shall have quiet
