Glaize, Jr. to rezone 32.042 acres from M-1 (Industrial Limited) to B-2 (Business General) for business uses. This property is located at the corner of State Route 50 East and State Route 728, on Victory Lane, in the Shawnee Magisterial District. Glaize, Jr. Rezone 32.042 acres from M-1 (Industrial Limited) to B-2 (Business General) LOCATION: Corner of State Route 50 East and State Route 728, on Victory Lane, two miles east of Winchester MAGISTERIAL DISTRICT: Shawnee ADJACENT LAND USE AND ZONING: Vacant and industrial land zoned M-1 PROPOSED USE AND IMPROVEMENTS: Business uses REVIEW EVALUATIONS: Transportation Department - No objection to rezoning. Sanitation Authority - Water and sewer project to serve this property has bids due on October 8, 1987. Projected completion date is Fall of 1988. City of Winchester - City water and sewer facilities are not available to this property. If public water and sewer is available, it would be provided by the Frederick County Sanitation Authority. Greenwood Fire Company - No problems, however, water system should be in place before building starts. Inspections Department - This rezoning request for offices and banks shall comply to Use Group B for business, Section 303.0, and for Use Group M for mercantile retail stores, Section 308.0, of the BOCA Basic National Building Code, 1984. Planning and Zoning - The request is to rezone 32 acres from M-1 to B-2 on Route 50 East in the proposed Route 50/Airport Corporate Center. The staff has received a master plan for this project, including 141 acres currently zoned M-1. The proposed 32 acres to be rezoned are located in the northeastern portion of the master plan with approximately 1,600 feet of frontage on Route 50. 0 0 REZONING REQUEST #033-87 George W. Glaize, Jr. Location and the Comprehensive Plan - The Comprehensive Plan and Zoning Ordinance do not provide guidelines or standards for the location of new B-2 areas in the County. This proposal would potentially establish a new large retailing and office area on Route 50. Water and sewer service will be provided to the site in 1988. There are no B-2 areas in the vicinity of this site. The staff has examined this request in relation to the spot zoning policy. In this case, the area of land is not necessarily small and similar land has been similarly rezoned in the Upper Valley Business Park in the general vicinity of this area. The staff does not believe that the spot zoning policy necessarily applies in this case because of the above reasons and because the proposal is a part of an overall master plan for the development of this area. We could expect similar requests for B-2 zoning on Route 50 in this area, although the extent of sewer and water facilities should provide limits for business area expansion. Possible Impacts - On a per acre basis, areas zoned B-2 will generate substantially more traffic than areas zoned M-1. The master plan proposes a single main entrance located approximately 1,400 feet east of the Routes 50 and 728 intersection, which will also provide access to the site. It would be useful from the standpoint of traffic safety and efficiency to limit access to Route 50 to these two major intersections. The staff would not expect that the rezoning would have any significant impacts on surrounding M-1 land. Conclusions - The staff has no specific guidelines to use to make a recommendation in this case. In general, the inclusion of some B-2 areas in the large planned industrial projects in this area does not seem inappropriate. This would, however, establish a large new retailing and office area. The location of the B-2 area in relation to the M-1 area seems appropriate. STAFF RECOMMENDATIONS: Approval.
