This property is located on the east side of Route 522, a short distance north of the intersection of Route 522 with Bufflick Road, in the Shawnee Magisterial District. Box 601 - Winchester, Virginia - 22601 REZONING REQUEST #00-88 Glaize and Brothers, A Virginia Partnership Rezone 5.000 acres from MH-1 (Mobile Home Park) to B-2 (Business General) LOCATION: Route 522, a short distance north of the intersection of Route 522 with Buff lick Road, and located on the west side of Route 522 ADJACENT LAND USE AND ZONING: Mobile home park zoned MH-1 (Mobile Home Community District), a church zoned RP (Residential Performance), agricultural land zoned A-2 (Agricultural General), and residences and small businesses zoned B-1 (Business Limited) Model homes and offices Transportation Department - No objection to the proposed rezoning, however, a land use permit for the construction of a secondary road connection will be required. Should the developer desire the access road to be taken into the Secondary System, a complete set of roadway plans in accordance with both the Frederick County Ordinance and the Virginia Department of Transportation specifications will be required. Health Department - No objection, provided the connections outlined in the accompanying letter are maintained. (See attached letter) Greenwood Fire Company - No problems with rezoning at this time. Planning and Zoning - The following issues should be considered. Location - The site is located just outside of the current urban development area in the plan. It is located between land zoned MH-1 and RP. It is within 500 feet of land currently zoned B-2 and M-2 to the north. It is across Route 522 from land currently zoned B-1. Impacts and Site Suitability - The RP land to the south currently contains a church building. A mobile home park is located to the northwest. Concern should be expressed for possible impacts of business zoning on the mobile home park. B-2 rezonings can create substantial traffic impacts. However, the site is on a major arterial that is undergoing improvements. REZONING REQUEST #010-88 Glaize and Brothers, A Virginia Partnership Conclusions - The site is located on a major arterial, not far from an interstate interchange, in an area with a broad mixture of uses and zoning. The current pattern of development along Route 522 from Route 50 to Bufflick Road seems to be oriented towards increased heavy commercial development with B-2, B-3, and industrial zoning. The property in question is located on the pest side of Rt. 522, just before Rt. 645 and is referenced as 64000-A00-0000-0000-0009B on the Frederick County, Virginia tax map. On March 22 and March 29, 1988 inspections were made of the property's sanitary facilites. Located was a well and septic tank which are understood to serve the white two story frame house at the front of the lot. It is not clear as to where the actual drainfield is located, however a depression with evidence of sewage was located in the vicinity. This may very well be the tail end of the drainfield. Also noted was a "gray water" surface discharge point adjacent to the house. Satisfactory sanitary facilities could not be located for the single story white house to the rear of the property. A water hydrant is located next to the house. The source of water is unknown. Also noted was what could be an artesian flow (spring) coming up in the breezewayo The discharge flows under a portion of the house and stagnates in a low area. The Frederick -Winchester Health Department has no objection to your rezoning request provided the following conditions are maintained until central sewer and water becomes available: 1. The white two story frame structure shall serve as office space for a maximum of ten (10) employees working a standard five day work week (40 hours). 2. The gray water discharge shall be routed to the septic tank (excluding roof, foundation and basement drains). 3. The septic tank shall be pumped as necessary if sewage continues to break out on the ground surface. 4. The single story white frame structure will be used only as a storage and workshop facility with no sanitary facilities. Water entering the structure shall be disconnected. 5. No new construction shall be permitted on the property. This does not include repair work to existing structures. The color of the paint on the exterior of every building on each lot shall be the same as the original color unless the new color is a color used in the historic portion of Williamsburg, Virginia and is sold by the maker of the paint as a sanctioned historic Williamsburg, Virginia color. 12. Every owner shall provide his lot with off-street parking space of at least 450 square feet, which may include all area in any driveway located on the lot itself, to be used by the inhabitants of the dwelling house located on said lot. Parking on the street shall be prohibited and it is the intent of this restriction that parking space for at least two vehicles be provided. 13. A ten foot (10') easement is reserved along the rear property line of each lot (being that property line or lines of a lot that is opposite a property line of the lot fronting on a dedicated street) for the purpose of installing any utilities including, but not limited to, electrical lines, telephone lines, water and sewer lines and television cable lines. 14. There shall be no planting, structure, fences, shrubbery, or other obstruction to obstruct vision planted or maintained on any corner lot which rises more than three feet (3') above ground level within twenty-five feet (25') of the intersection of any street lines. 15. All split foyer dwelling houses shall have 850 square feet of living space on each floor, excluding carports, garages and basements, and rancher style dwelling houses, shall have 1,150 square feet of living space )n each floor. All lots are required to observe any setback lines, and/or side lines and/or rear yard lines as shown on the plat attached hereto in addition to those applicable requirements of the Frederick County Subdivision and Zoning Ordinances. 18. All of the covenants and restrictions herein shall remain in full force and effect for a period of fifteen (15) years from the date of this instrument and shall be renewed automatically for additional successive ten (10) year periods unless the owners of a majority of the lots in the Greenbriar South Subdivision shall, at least six (6) months prior to any such renewal date, execute and record an agreement amending said covenants and restrictions. 19. The Grantors reserve the right alone to impose additional restrictive covenants and restrictions as to any lot or lots owned by them at the time of the imposition and such imposition shall not affect the binding effect of these provisions upon any other lots. 20.
