Approval of Rezoning Request #010-88 of Glaize and Brothers, A Virginia
Partnership, to rezone 5 acres from MH-1 (Mobile Home Park) to B-2 (Business
General) for model homes and offices. This property is located on the east side
of Route 522, a short distance north of the intersection of Route 522 with
Bufflick Road, in the Shawnee Magisterial District.

Rezone 5.000 acres
from MH-1 (Mobile Home Park)
to B-2 (Business General)
LOCATION: Route 522, a short distance north of the intersection of Route 522 with
Buff lick Road, and located on the west side of Route 522
ADJACENT LAND USE AND ZONING: Mobile home park zoned MH-1 (Mobile Home Community
District), a church zoned RP (Residential Performance), agricultural land zoned
A-2 (Agricultural General), and residences and small businesses zoned B-1
(Business Limited)
Model homes and offices
Transportation Department - No objection to the proposed rezoning, however, a
land use permit for the construction of a secondary road connection will be
required. Should the developer desire the access road to be taken into the
Secondary System, a complete set of roadway plans in accordance with both the
Frederick County Ordinance and the Virginia Department of Transportation
specifications will be required.
Health Department - No objection, provided the connections outlined in the
accompanying letter are maintained. (See attached letter)
Greenwood Fire Company - No problems with rezoning at this time.
Planning and Zoning - The following issues should be considered.
Location - The site is located just outside of the current urban development
area in the plan. It is located between land zoned MH-1 and RP. It is
within 500 feet of land currently zoned B-2 and M-2 to the north. It is
across Route 522 from land currently zoned B-1.
Impacts and Site Suitability - The RP land to the south currently contains a
church building. A mobile home park is located to the northwest. Concern
should be expressed for possible impacts of business zoning on the mobile
home park.
B-2 rezonings can create substantial traffic impacts. However, the site is
on a major arterial that is undergoing improvements.

Conclusions - The site is located on a major arterial, not far from an
interstate interchange, in an area with a broad mixture of uses and zoning.
The current pattern of development along Route 522 from Route 50 to Bufflick
Road seems to be oriented towards increased heavy commercial development with
B-2, B-3, and industrial zoning.

This letter is in reference to the Comment Sheet received in this office
concerning your rezoning request. The property in question is located on the
pest side of Rt. 522, just before Rt. 645 and is referenced as
64000-A00-0000-0000-0009B on the Frederick County, Virginia tax map.
On March 22 and March 29, 1988 inspections were made of the property's
sanitary facilites. Located was a well and septic tank which are understood
to serve the white two story frame house at the front of the lot. It is not
clear as to where the actual drainfield is located, however a depression with
evidence of sewage was located in the vicinity. This may very well be the
tail end of the drainfield. Also noted was a "gray water" surface discharge
point adjacent to the house.
Satisfactory sanitary facilities could not be located for the single
story white house to the rear of the property. A water hydrant is located next
to the house. The source of water is unknown. Also noted was what could be an
artesian flow (spring) coming up in the breezewayo The discharge flows under a
portion of the house and stagnates in a low area.
The Frederick -Winchester Health Department has no objection to your rezoning
request provided the following conditions are maintained until central sewer and
water becomes available:
1. The white two story frame structure shall serve as office space for a
maximum of ten (10) employees working a standard five day work week
(40 hours).
2. The gray water discharge shall be routed to the septic tank (excluding
roof, foundation and basement drains).
3. The septic tank shall be pumped as necessary if sewage continues to
break out on the ground surface.
4. The single story white frame structure will be used only as a storage
and workshop facility with no sanitary facilities. Water entering the
structure shall be disconnected.
5. No new construction shall be permitted on the property. This does not
include repair work to existing structures.
In addition to these conditions it is recommended that the septic tank be
pumped and the water supply be tested for bacteriological quality and disinfected

if necessary, prior to occupancy. It is also recommended that the artesian flow
be controlled to prevent damage to the structure and to discourage the nesting
of pests (mosquitoes, flies, etc.) in the low area.
It is this department's opinion that the existing sanitary facilities
would better serve an office complex than two residential structures. If you

The Frederick -Winchester Health Department has no objection to your tesoning
request provided the following conditions are maintained until central sewer an4

1. The white two story frame structure shall serve as office space for a
maximum of ten (10) employees working a standard five day work week
(40 hours).
2. The gray :rater discharge shell be routed to the septic tank (excluding
roof, foundation and basement drains).
3. The septic tank shall be pumped as necessary if swage continues to

foregoing subdivision of the above described property, as it appears on the
aforesaid attached plat, is with the free consent and in accordance with the
desire of the undersigned owners and that the said Grantors do further
desire to subdivide the aforesaid property in accordance with the provisions

Subdivision, located Northwest of Stephens City, North of and adjacent to

County, Virginia as more particularly described by the aforesaid referenced

B. Ann W. Glaize, wife of Fred L. Glaize, III, joins in this Deed of
(Dedication to evidence her consent hereto and to join, insofar as any right
or claim that she has in said property, to affirm the .actions taken herein.
C. All the lots, as shown on the plat attached hereto, shall be
subject to the following restrictions, which are covenants real, running
with the land and shall be binding on all subsequent owners of the said
lots, and each deed, by recitation or by reference, shall contain these
restrictions.
1. All lots shall be used for single family residential purposes only.
No detached garage nor carport shall be permitted on any lot. Any utility
or other outbuilding on any lot shall be of the same material and
construction as the main structure on said lot.
2. No sigi'.s or advertising of any nature shall be erected or
maintained on any lot except for sale or rental signs for said lot which
signs shall not exceed five (5) square feet in area.

3. No boats, mobile homes, motor homes, campers, commercial buses,
trailers of any type, tractors, trucks or other motor vehicles (other than
automobiles, motorcycles, pickup trucks and 3/4 ton (or less) vans) shall be
permitted on any lot except during the course of construction. No motor
vehicle or material portion thereof, which does not have a current license
and current Virginia inspection sticker shall be permitted on any lot.
4. No animals of any kind (including livestock, poultry or birds)
shall be permitted on any lot, except that dogs, cats and other usual
household pets may be kept, provided that they are not kept, bred or
maintained for commercial or charitable purposes or in unusual numbers.
5. No fence or hedge shall be constructed or planted in the front nor
along the side (not applicable to corner lots) of any residence nor within
twenty-five (25) feet of any street. Rear fencing and hedges shall not
exceed six (6) feet in height. All fencing shall be of wood or vinyled
covered chain link construction.
6. No noxious or offensive activities shall be carried on upon any lot
nor shall anything be done thereon which may be, or may become an annoyance
or nuisance to the neighborhood.
7. In the event that a dwelling is destroyed, the owner of the
dwelling, within thirty (30) days from said destruction, shall clear away
the remaining portion of the dwelling unit and maintain the lot in a neat
and orderly condition.
8. In the event a dwelling unit is damaged, or has materially
deteriorated, the owner of the unit shall immediately repair the damage or
deterioration.
9. No lot shall be used or maintained as a dumping ground for rubbish.
Trash, garbage or other waste shall be in sanitary containers. No refuse or
any container for same shall be placed or stored in front of any house,

10. No exterior clothes lines, or hanging device, shall be permitted on
any lot, except for an umbrella type with a diameter not to exceed seven (7)
feet, provided, however, that the same may only be used in the rear of any
building constructed on said lot and the clothes line is stored within a
utility building or the equivalent when the clothes line is not in use.
11. The color of the paint on the exterior of every building on each
lot shall be the same as the original color unless the new color is a color
used in the historic portion of Williamsburg, Virginia and is sold by the
maker of the paint as a sanctioned historic Williamsburg, Virginia color.
12. Every owner shall provide his lot with off-street parking space of
at least 450 square feet, which may include all area in any driveway located
on the lot itself, to be used by the inhabitants of the dwelling house
located on said lot. Parking on the street shall be prohibited and it is
the intent of this restriction that parking space for at least two vehicles
be provided.
13. A ten foot (10') easement is reserved along the rear property line
of each lot (being that property line or lines of a lot that is opposite a
property line of the lot fronting on a dedicated street) for the purpose of
installing any utilities including, but not limited to, electrical lines,
telephone lines, water and sewer lines and television cable lines.
14. There shall be no planting, structure, fences, shrubbery, or other
obstruction to obstruct vision planted or maintained on any corner lot which
rises more than three feet (3') above ground level within twenty-five feet
(25') of the intersection of any street lines.
15. All split foyer dwelling houses shall have 850 square feet of
living space on each floor, excluding carports, garages and basements, and
rancher style dwelling houses, shall have 1,150 square feet of living space

16. All dwelling houses constructed, if said dwelling house has a
chimney, and the chimney is flued on the outside of the dwelling house, then
all such flues shall be entirely faced with brick.
17. All lots are required to observe any setback lines, and/or side
lines and/or rear yard lines as shown on the plat attached hereto in
addition to those applicable requirements of the Frederick County
Subdivision and Zoning Ordinances.
18. All of the covenants and restrictions herein shall remain in full
force and effect for a period of fifteen (15) years from the date of this
instrument and shall be renewed automatically for additional successive ten
(10) year periods unless the owners of a majority of the lots in the
Greenbriar South Subdivision shall, at least six (6) months prior to any
such renewal date, execute and record an agreement amending said covenants
and restrictions.
19. The Grantors reserve the right alone to impose additional
restrictive covenants and restrictions as to any lot or lots owned by them
at the time of the imposition and such imposition shall not affect the
binding effect of these provisions upon any other lots.
20. The invalidation of any one of the covenants or restrictions
contained herein by judgment or Court Order shall in nowise affect any of
the other provisions which shall remain in full force and effect. The
failure of the lot owners or the Grantors herein to enforce any covenants or
restrictions shall not be deemed to be a waiver of the right to do so
thereafter as to a default occurring prior or subsequent thereof.
21. The covenants and restrictions contained shall not impose any
restraint on any portion of land now owned or hereafter acquired by Fred L.

We, the Church Board of the Calvary Church of the Brethren, are
very interested in the adjacent properties which affect our own
community.
We understand that a portion of the Barberio property is under
consideration to be re -zoned as Business-B2. We have also been
informed that Glaize and Brother is planning to do some construc-
tion there. We are not at all objecting to their endeavor, for
they are a very reputable firm. However, we do have a concern for
the future of our area. If that property was sold or other sec-
tions rezoned, we want to go on record of requesting the Planning
Commission and Board of Supervisors to assist in protecting and
preserving the wholesome area we now share.
Thank you for working so diligently to help our County to be pro-
gressive and yet to insure a safe and wholesome community in which
we can raise our children.
