PROPOSED USE AND IMPROVEMENTS: Landscaping contracting business and retail
nursery sales business
REVIEW EVALUATIONS:
VA Dept. of Transportation - No objection to the proposed rezoning. A
commercial entrance, meeting the Department's minimum standards with adequate
sight distance, will be required. Before we can comment further, it will be
necessary to submit to our office a site plan for review.
Sanitation Authority - Water and sewer is not available.
Health Department - Site visit on 4/7/88 revealed no evidence of septic
system malfunction. Therefore, Health Department has no objection to the
present rezoning, given that only one office employee will be added to the
system, in addition to the occupants of the house. See attached letter.
Round Hill Fire Company -
Planning and Zoning - The following issues should be considered:
Location: The site is located outside of the urban development area at the
northern end of the Albin area. The site is approximately 2,000 feet north
of an existing B-2 area.
Site Suitability: A B-2 use on the site could generate substantial traffic.
However, the site is located on a major arterial highway with good sight
distance to the north. There is no cross -over at this location. Access from
Winchester would require a U-turn.

The site is relatively isolated from existing residential uses with the
exception of the residence and motel on the adjoining parcel. Existing
buildings are over 100 feet from the adjoining developed parcel. Impacts
would probably not be significant in relation to the neighboring motel use.
Spot Zoning Policy: This request would come under the spot zoning policy if
similarly situated properties in this area are not generally treated the
same. B-2 rezonings have occurred in the Albin area. Whether this property
is similar and in the same area is not a simple question.
Conclusions: Significant adverse impacts would not be expected. Other
properties have been rezoned to the business categories in the Albin area.

Clerk of the Circuit Court of Frederick County, Virginia in
Deed Book 230, at Page 157; LESS off conveyance of a strip of
land to the Coirunonwealth of Virginia for the widening of U. S.
Route 522 by deed recorded in the aforesaid Clerk's office in
Deed Book 294, at Page 487. The interest of Harry B. Rinker
was devised by him to his wife, Luella S. Rinker, by Will
probated in the aforesaid Clerk's office in 1972 in Will Book
II 72, at Page 595.

This conveyance is made subject to all legally enforceable
restrictive covenants and easements of record affecting the
aforesaid realty. The Grantor reserves for the benefit of
Burnt Presbyterian Church the right to continue to use that
