Mr. Downard appeared before the Board on behalf of his re- quest. There was no opposition to this request. Upon motion made by Will L. Owings, seconded by C. Yost Rezone 7.783 acres from A-1 (Agricultural Limited) to B-2 (Business General) LOCATION: Southwest corner of intersection of US Route 522 North and VA State 694, approximately 18 miles north of Winchester, at Reynolds Store MAGISTERIAL DISTRICT: Gainesboro ADJACENT LAND USE AND ZONING: Vacant and agricultural land and general store across Route 694 zoned A-1 (Agricultural Limited) PROPOSED USE AND IMPROVEMENTS: Retail sales of groceries, fruits, and canned goods or restaurant REVIEW EVALUATIONS: Transportation Department - If this is to be an addition to an existing business, the entrances will have to be brought to the minimum commercial entrance standards. This will require a commercial entrance permit prior to opening the new business. Health Department - Application for a NPDES Discharge Permit has been made and is being processed. Also, Robert Holmes, CPSS is doing further evaluation of soils on the Yost property trying to locate a subsurface sewer disposal system. The Frederick County Health Department has no objection to a restaurant, but the sewage situation must ultimately be resolved prior to any construction. Reynolds Store Fire Company - No comments at this time. Inspections Department - This request for a conditional use permit shall comply to Section 302.0, Use Group A (Assembly Buildings), of the BOCA Basic National Building Code 1984. Planning and Zoning - The proposal is to zone 7.8 acres from A-1 to B-2 Business General). The next closest land zoned B-2 is the Branner's Gift Shop which is over 1,200 feet from this site. The proposed site is located at the Reynolds Store Rural Community Center. The recommendation from the Rural Community Center Subcommittee is to treat this area similarly as surrounding areas. e REZONING REQUEST #032-87 Douglas C. and Sue C. Yost Therefore, the staff has examined this site in relation to the spot zoning policy. This proposal will not place similarly situated property (in particular, the store across Route 694) in the same category. There is no convincing evidence that allowed B-2 uses (motels, automobile sales and service, and general retailing) will be in the public interest at this location. There is no convincing demonstration that all permitted uses would be appropriate. There is no convincing demonstration that the area will not be affected by the rezoning and subsequent rezoning requests. The site is a rural development area in the Comprehensive Plan. Country general stores, service stations, and other appropriate uses are allowed under the current zoning. Therefore, the staff believes that this rezoning would constitute an illegal spot zoning. Yost. As an adjoiner of this property, farming adjacent land, I would hope that when consider.ng this concilt10nal use permit the rural nature �f the area be taken into account. It is my feeling that appropriate conditions to assure thzs to only be a family restaurant be assigned. Two items that I feel should be addressed are as follows: a. Hours of operation. To be consistent with surrounding uses and residential dwellings I would suggest that hours of operation be from 6 a.m. until 10:00 p.m. b. NPDES Discharge Permit/Subsurface sewage system. The soils on this tract are not considered appropriate for conventional subsurface sewage systems. It would be my desire that yearly inspections of anv system installed be required to assure the adjoining landowners that Pollution is not being discharged that would create a health hazard. I am not sure if it is appropriate to address as a possible condition (or if this is covered in the site plan requirement) the placing of restrictions on outside storage and/or overnight parking of vehicles. If it is something that should be placed as a condition. I would hope that such a condition be addressed to further assure that the intent of this conditional use permit is to allow a family restaurant only. As always, I thank you for allowing me the time to express my thoughts and concerns and I apologize for not being able to attend today's meeting.
