The approved site plan calls for the construction of a one story building consisting of 8,000 square feet which will be used to house a truck office, as well as space for storage, tractor sales, and tractor repair services. As part of the development process the existing office located in the northwest corner of parcel 55-A-33 will be relocated to the rear of parcel 55-A-32A. The approved plan also designates the planting of White Pine trees along the sides of both parcels to provide adequate screening between the site and the adjacent properties. The trees shall be no less than four feet in height at the time of planting. It is understood that Carlyle and Anderson, Inc. will provide additional landscaping and/or screening if there are changes in the vegetation or terrain that deem it necessary to maintain an adequate buffer. I had the opportunity to inspect the site on February 6, 1995, to determine if a Temporary Certificate of Occupancy Permit could be granted prior to the completion of all site improvement work. Based upon the inspection, the outstanding work that has to be completed includes the completion of commercial entrances, the paving of the parking area with asphalt, the striping of all parking spaces in the front lot, the construction of a handicap ramp, and the planting of 84 White Pines to be used as a landscape screen along the perimeter of the site. Before a Temporary Certificate of Occupancy can be issued there are two issues that need to be addressed. First, the commercial entrances must be completed. The County concurs with Mr. Childress, that the present condition of the site entrance imposes a public safety problem and that commercial entrances must be complete before the site is open for public business. Second, you may apply for a Temporary Certificate of Occupancy prior to the completion of paving and striping the parking area and landscaping. In order to obtain a Temporary Certificate of Occupancy Permit, you must issue a Letter of Credit to Frederick County that guarantees that all costs associated with the outstanding site improvements will be covered. The amount of the Letter of Credit is based on a contractor's bid for the necessary site improvements. A financial institution will issue a Letter of Credit that complies with a form acceptable to Frederick County.
