Dear Mr. Jones:
The Frederick County Planning Department administratively approved Site Plan #019-94 for
Price Costco on February 6, 1995. The approved site plan calls for the construction of the
136,000 square feet Price Club facility which will include retail, office, and warehousing space,
as well as a tire installation department, the provision of a paved parking lot complete with 679
regular parking spaces, 14 disabled parking spaces with appropriate ramps and signage, curb and
gutter, directional arrows, outdoor lighting fixtures, and landscaping around the parking lot
perimeter and in the interior raised islands, the installation of concrete sidewalks around the
facility and along Costello Drive, the provision of 5 loading dock spaces that are striped to
provide 12' x 45' spaces, the creation of a right-in/right-out ingress/egress that will intersect
with Front Royal Pike (Route 522), the provision of land for a future inter -parcel connector with
the F & M Bank property to be developed by Price Costco or a subsequent owner, the
installation of an outdoor compactor and baler that will be completely screened by a six foot high
brick wall, the construction of an on -site stormwater management facility, and all appropriate
erosion and sedimentation control measures.
I have provided you with two copies of the approved site plan. This will allow you to maintain
a copy for your records, and to provide the contractor with an approved copy to be maintained
on -site. Please have the contractor notify this office to schedule an on -site inspection once all
improvements are complete. Please contact me if I may answer any questions regarding this
letter.

the account of Armada/Hoffler Construction Company in the amount of $15,545.00. Their
current obligation to complete all site improvements associated with Site Plan #019-94 for the
Price Costco Company have been accomplished.
This performance bond should be released to Barbara E. Moore, Attorney -in -fact, Union Pacific

RE: Final Occupancy Permit For Price Club
Dear Tom:
I conducted a site inspection at the Price Club this morning. As you know, all required site
work must be complete or adequately bonded in order to receive a Final Certificate of
Occupancy Permit for this project. Frederick County issued a Temporary Certificate of
Occupancy Permit to allow for the stocking of merchandise. It is my understanding that your
firm would like to obtain a Final Certificate of Occupancy Permit by May 23, 1995.
Enclosed is a copy of the approval letter, dated February 13, 1995, that was sent to Price
Costco. This letter provides a summary of the required site work that is depicted on the
approved site plan. Also enclosed is a copy of the Irrevocable Letter of Credit form for
Frederick County for your review. Frederick County bases the amount of the bond on the
estimated cost for completing all outstanding site work. This estimate can be provided by the
contractor or the subcontractors. Please contact Mr. Wayne Miller, Zoning Administrator, at
665-5651 in the event that a Letter of Credit is required. Mr. Miller is the approval authority
for this process.
I will continue to conduct site inspections throughout the month of May as requested. Please
contact me if I may answer any questions regarding this letter.

Dear Mr. Tisinger,
Price Costco is currently building one half of Costello Drive from U.S. Route
522 east, just about to the Garber Estate eastern property line. Much of the existing
subgrade is not suitable to support the roadway. Approximately 3 ft. of material will
need to be excavated and replaced with offsite shale. Currently we are attempting to
get VDOT to allow 18 inches of excavation and placement of a geo grid and then
backfill with 18" of offsite shale material.
VDOT is concerned that if Price Costco replaces only the subgrade required to
build their part of the roadway, it will be very difficult for a future developer to
remove the necessary material to widen Costello Drive to its full width. Therefore,
it may be prudent to get the on site contractor to excavate the unsuitable material for
the full width of the right of way now.
Price Costco intends to only improve 40 ft. of the right of way. The cost to
remove the unsuitable material and replace it with offsite shale for the remaining
40 ft. of the right of way is estimated at $63,700. This figure is based on 4,900 cu. yds.
of material at $13/cu. yd. This figure could be cut to approximately $45,000 if the geo
grid is used.

RE: Revised Price Costco Lighting Plan
Dear Ron:
I have reviewed the proposed lighting plan revisions for the above referenced project. It appears
that there is a conflict with the proposed landscape plan and one of the proposed parking lot
lighting poles. This pole is located on the raised island in the third parking row closest to Front
Royal Pike.
Frederick County does not have any opposition to this new lighting plan, provided that the
proposed shade tree is shifted slightly on this raised island to accommodate both improvements.
I will include this letter with the other approved review agency comments in our site plan file.

1 space per 200 square feet of retail area. This requires 680 regular parking spaces for
the proposed 136,000 square feet structure. Disabled parking spaces are based on 2 %
of this total; therefore, 14 disabled parking spaces are required as well for a total of 694
parking spaces. The proposed plan indicates 644 regular parking spaces and 15 disabled
parking spaces for a total of 659 parking spaces. The six parking spaces adjacent to the
loading docks do not meet the dimensional requirements.
15) Please provide the loading space calculations for this project. It appears that there are
three spaces provided. The calculations for retail use require a total of five spaces. The
loading spaces need to be stripped to provide for a 12' x 45' dimension per space.
16) The required landscape percentage for this site is a minimum of 15%. I calculated all
areas not being used for the building, the driveways, and loading or parking (I included
all raised islands as being landscaped) and determined that this percentage has not been
met.

inspection I found all listed items have been satisfactorily addressed.

extremely helpful in complying with our requests and recommendations during all phases
of this construction project. Especially notable was the work on a very busy Route 522.

This is in response to our telephone conversation last week concerning the Valley Farm
Credit entrances. In addition to the curb adjustments mentioned in Mr. Ron Mislowsky's
letter to you of May 10, 1995 the following will also be required:
1.) The portions of the existing entrance pavement which lie within the limits of the
proposed 12' wide southbound lane will need to be removed and replaced in
accordance with the approved Route 522 pavement section (8" Type 21-B Aggregate,
6" Type BM-2 Asphalt Concrete and 1.5" Type SM-2A Asphalt Concrete).
2.) In order to provide a smooth transition from the proposed Route 522 edge of
pavement to the backside of the entrance, the existing entrance pavement should be
removed and replaced with 8" 21-B Aggregate and 2" Type SM-2A Asphalt Concrete
or the existing pavement surface will need to be built up with SM-2A Asphalt Concrete.
In either case the new pavement surface should extend at least to the backside of the
entrance radii.

We reviewed your revised preliminary grading plan dated 04/17/95 and Profile Sheet 8-A dated
04/14/95 which raises the Costello Drive center line elevation approximately 3'± and provides for the
required 18" of select borrow material and modified UD-1 system under the roadway. The revised
grade is satisfactory provided you work out acceptable tie-ins with the Price Club entrances and you
show outfall locations and elevations of the modified UD-1's.
The 18" of select borrow will need to be placed and compacted in two 9" layers as part of the typical
section. The 18" layer should be placed from 15.5" to 33.5" below final grade. The modified UD-1
underdrains shall be installed at the locations and depths shown on the revised typical section with
a 6" perforated PE pipe. As we have previously discussed the UD-1 outfall pipe on the left (north)
side shall tie-in to the drop inlets. In addition, outfall pipe from the LTD- 1 to the side ditch on the
right (south) side will need to be provided every 300'f.
Please revise/finalize your plan to reflect the above comments and submit four copies for our file.

necessary. However, please keep in mind the standard DI-313 drainage structures you
have indicated to be possibly lowered are already designed at minimum or just below
desirable design height. Any changes or revisions to these structures will need to be
reviewed and approved by this office prior to implementation.

This is to acknowledge receipt of your revised plans dated January 30, 1995 for the above
referenced project. The plans appear satisfactory and are approved. Please advise the
developer accordingly.
I offer the following comments:
A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT shall be conducted
prior to initiation of work within the Costello Drive or Route 522 south rights -of -way.
Materials used and method of construction shall apply to current observed VDOT Road
& Bridge Specifications applicable during construction of this development.
Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department prior to inclusion into the Secondary Road System.
Attached is a copy of the minimum requirements and information needed prior to
acceptance of subdivision streets into the Secondary System. This is the responsibility
of the developer.
All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.

The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. Said permits will require a minimal processing fee, surety bond
coverage, and the salary & expense of a State assigned Inspector. Through copy of this
letter to Perry Engineering I am apprising them of our approval and providing a land use
permit application to cover the Route 522 improvements. I will need four (4) additional
sets of the plans for the permit.
Any entrances constructed from Costello Drive shall meet VDOT minimum standards.
This is the developer's responsibility.
• Any signs to he installed will be in accordance with attachments.
I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfiIled completely with C.R. Type 21-A Stone. This will greatly reduce the possibility
of any pavement settlement.
In order to proceed with the design of the necessary traffic signal and to ensure its
installation/operation in conjunction with the store's opening, a letter from the developer
will be necessary agreeing to pay for the signal's design and installation costs. The
letter should also include the name and address of the person to which our invoices
should be directed. An anticipated opening date would also be helpful for scheduling
purposes.
Due to design changes required to the site plan the property's final subdivision plat
entitled "Garber Estate" will need to be revised to reflect said changes. The revised plat
and its recordation will be needed prior to our acceptance of Costello Drive into the
Secondary System.

4. The sidewalk has been extended past structure #6 and the ramp placed

As requested we have reviewed the referenced project's revised site plan dated
November 28, 1994. Our comments may be found on the enclosed plans marked in red
and as follows:
1. The temporary turnaround easement shown within the Costello Drive right-of-way will
need to removed. Also an easement is not required within the right-of-way limits to
enclose the proposed 8" waterline crossing of Costello Drive at approximate
Station 5+50.
2. For clarity the ultimate typical section for Costello Drive should be added to the plan.
3. The storm sewer culverts on Sheet #5 will need to be numbered to correspond with
the profiles on Sheet #11.
4. It appears the proposed CG-12 handicap ramp is in conflict with the drop inlet
(Structure #6) left nf Station 5+30, CoStP,1io nrive.
5. It appears there is a steep drop off between the sidewalk and the 15" pipe inlet
(Structure #9-C) left of Station 0+50±. The pipe inlet should be shifted as necessary
to provide a maximum 2:1 slope behind the sidewalk.
6. The proposed northern entrance adjacent to the F & M property line will need to be
revised in accordance with the enclosed sketch which you forwarded to us several
days ago. Also, the proposed C.M. P.A. culverts under the Price Club and Farmers &
Merchants' entrance will need to be changed to reinforced concrete.
7. The Costello Drive intersection with Route 522 will need to be revised slightly to
provide a 70' radius on the southeast quadrant. This is necessary to allow northbound
tractor trailer traffic access onto Costello Drive until our roadway project widens
Route 522 at this location (see enclosed sketch).

8. Two 2" p.v.c. conduits will need to be provided undostello Drive at the location
shown for futurnal installation. The conduits wili ..e supplied by VDOT.
9. The proposed Hetz Holly to be planted in the island area of the northern entrance are
not acceptable due to the mature height impact on sight distance. If plantings are
desired at this location, a substitute specie with a mature height of 2.5' can be
submitted for our review. The developer will need to submit the enclosed cooperative
planting agreement for our review and approval prior to installation of any plants on
the right-of-way.
10. We strongly suggest the proposed irrigation system within the Route 522 right-of-way
be relocated to private property. We question the need for the system so close to
Route 522 when you are proposing a ditch between the system and the trees. If
allowed, the system will be severely impacted by our roadway project. A storm sewer
system is proposed through this area and the limits of roadway fill will approach 30'+
from the edge of the existing pavement. If the developer still desires a permit to install
the system on the right-of-way, we suggest waiting until our project has been
completed. I am also enclosing a copy of our requirements for irrigation systems on
the right-of-way for his consideration.
Due to the small scale it is difficult to determine the exact location of the proposed
irrigation system along Costello Drive. However, due to the limited space behind the
proposed sidewalk, we do not believe it to be necessary to install any part of the
system on the Costello Drive right-of-way.
In order to proceed with the design of the necessary traffic signal and to ensure its
installation/operation in conjunction with the store's opening, a letter from the developer
will be necessary agreeing to pay for the signal's design and installation costs. The letter
should also include the name and address of the person to which our invoices should be
directed. To avoid delays with the installation of the signal, we would appreciate receiving
this letter as soon as possible.
Please revise the plan in accordance with the above recommendations and resubmit four
copies for final approval. Should any changes be deemed necessary please design them
to meet or exceed the above recommendations.

As requested in your letter dated December 30, 1994 you are given permission to install a temporary
construction entrance at the reference location. This letter is to be considered your permit to do so.
The following provisions will be required:
Work area protection signage in accordance with the attached while working on the right-of-way will be
required.
All work on the right-of-way is to be confined to the temporary entrance location only.
A minimum 6" depth of VDOT #1 (2-3 inch stone) course aggregate by 30' in width will be required. It is
to be placed from the edge of pavement and extended back onto private property far enough to prevent
the carrying of mud onto the roadway.
Positive drainage is to be maintained within the right-of-way at all times.
Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this entrance will
be repaired by you to our satisfaction.
This permit is being issued for 180 days.
All work is to be completed in accordance with the enclosed Virginia Erosion & Sediment Control

As requested, we have reviewed the above referenced project's site plan dated July, 1994.
Our comments may be found on the enclosed plans marked in red and as follows:
Costello Drive
1. Center line curve data is needed along Costello Drive. Due to the limited data
provided, no in depth review was performed of Costello Drive for future phases
beyond Station 13+00+.
2. The typical sections will need to be revised as marked. Three 12' lanes will need to
be constructed now with the crown at the edge of the third lane. The remaining two
12' lanes and 4' bicycle path will need to be constructed at a later date. The
proposed 5' sidewalk will need to be installed with a 1 /4" per foot slope and standard
CG-6 curb & gutter used in lieu of CG-7.
3. The pavement design is inadequate as proposed. Based on an anticipated average
daily traffic count of 10,000 trips per day on this street, the pavement design will need
to be changed to 8" of 21-B base aggregate, 6" Type BM-2 asphalt concrete and
165 lbs. per square yard of SM-2A asphalt concrete.
4. All storm sewer culverts should be numbered on both the plan and profile sheets.
Also the storm sewer should not zigzag from drop inlets in the parking lot to drop
inlets in the Costello Drive right-of-way as this will result in an undesirable high skew
crossings of curb & gutter, sidewalk, and other possible utilities. A suggested layout
is shown using 90 degree crossings of the north right-of-way of Costello Drive on Plan
Sheet #3.
5. The storm sewer should be extended westward to pick up the culvert at
Station 1 +00+.

6. Additional detail of the proposed_ temporary cul-de-sac will need to be provided. The
edge of pavement radius will need to be a minimum of 50' with an adequate
temporary easement.
7. A half typical section of the proposed commercial entrances with the pavement
designs noted will need to be provided. A standard CG- I I entrance design is to be
used and handicap access provided. The entrances will also need to be widened
to 36' to accommodate left turn movements.
8. The crest at Station 1 +00 should be eliminated.
9. It appears the culvert into the storm water management basin should be shortened.
10. The Costello Drive intersection radii with Route 522 are to be a minimum 50'.
11. The proposed water and sewer main crossings of Costello Drive should be
constructed of ductile iron pipe or encasements provided from right-of-way line to
right-of-way line.
12. It appears a future culvert may be necessary at approximate Station 15+50.
Consideration should be given to installing the water and sewer mains at this
location at proper depths to accommodate a future culvert..
Route 522 Improvements
1. Sheet #5 should be more clearly labeled as to what is existing, proposed and future.
2. The transition lengths at both ends of the Route 522 widening are too short. Due to
its complexity these plans should have a separate sheet to show existing and
proposed traffic patterns and pavement markings.
3. Tapers at the ends of the curb & gutter radii should be only 36' long.
4. The additional pavement shown (hatched) and proposed southern curb radius at the
Costello Drive intersection should be eliminated.
5. The ultimate curb & gutter width (74' from e.p. to e.p.) of Route 522 should be clearly
shown on Sheet #5.
6. The proposed design of the commercial entrance on Route 522 adjacent to the F & M
Bank property is undesirable and should be redesigned. Please refer to our
comments on Plan Sheet #5.

7. A typical section of the proposed temporary widening and transitions areas with
pavement designs will need to be provided. Also, details of the commercial entrance
reconstruction on the west side of Route 522 will be needed.
8. Since very little data on a facility such as this exists, we sent the trip generation data
you provided to our Research Council for review. The Council developed trip
generation rates based on similar facilities in several different states, a copy of
which I am enclosing for your use. Based on our findings it appears a signal will be
necessary at the time of the opening of the facility.
Signal plans will be developed by our Traffic Engineering Office with installation
performed by our regional signal contractor. Your client will be responsible for 100%
of the design and installation costs of this signal.
Conduits under the Costello Drive intersection will need to be provided. The exact
type, length and location of the conduits will be determined by this office during
construction.
General
1. A drainage area map is needed to correspond with Areas A-Y. The map may be .
included in the revised drainage calculations upon resubmittal.
Please revise the plans and resubmit three (3) copies for further review. Should any
changes be deemed necessary, please design them to meet or exceed the above
recommendations.

I have enclosed one set of the Price Costco site plans which have been revised
per your comments. The following issues still need to be addressed.
1. Signage. I am getting the information on signs (location, size, type, etc.)
and will provide that very soon.
2. The dumpster and compactor are located on the east side of the building.
These are screened by a block wall. The hatched area adjacent to that is a
"no parking" area. Except for the transformer there are no other structures
outside the building on that side.
3. I've attached three sheets from the building plans for your information.
The building layout plan has been marked up to show the use areas. The
detail sheet is provided since the site plan detail sheet does not include
details provided with the architects package.
4. The gas line is in the right of way. No rights of way over the site are
required.
5. The site lighting plan is part of the architectural package. I've provided a
separate sheet (12A) with this set to show the exterior lighting layout.

On May 31, 1995 a meeting was held for the purpose of establishing a punch list of items
needing attention prior to VDOT accepting construction of Costello Drive and the
improvements to Route 522. Present at this meeting were Mr. Bill Rudolph and yourself of
Perry Engineering, Mr. Tom Handy with Armada Hoffler, Mr. Bob Childress, Mr. Dennis Lee
and myself of VDOT.
The following is a list of items which will need to be addressed:
1. Establish vegetation within the drainage swale on the south side of Costello Drive from
Route 522 to the natural swale off right-of-way past the end of the cul-de-sac. Also
ensure all underdrain outfall pipes are open and free of silt & debris.
2. Complete the installation of sidewalk on the north side nf Costello Drive at Station
12+50. Also install riprap as designed and install a drainage swale toward the drainage
easement off right-of-way.
3. Investigate the pavement thickness at Station 11 +20, Costello Drive and the eastern
loading dock entrance to ensure a pavement design of 6" of BM-2 and 165 lbs./s.y.
SM-2A. Also remove and replace asphalt to ensure the CC-11 is installed and working
as designed. Reinstall asphalt to ensure a smooth ingress and egress transition through
this intersection. Any repaving to Costello Drive will require removing and replacing
asphalt to a width of 12' across the entire width of the intersection.
4. Remove excess concrete from curb & gutter on Costello Drive.
5. Remove and replace curb at the modified CC-12 at Costello Drive and the western
entrance to the Price Club.

6. Add topsoil backfill behind curb and next to sidewalk along Costello Drive and
Route 522 as needed.
7. Add EC-1 to end of curb & gutter at Station 823 +75 on the east side of Route 522 into
the side ditch.
8. Repair CC-12 curb ramp on the north side of the Route 522 entrance median to
eliminate 1 "+ lip at the pavement.
9. Repair sidewalk to ensure stone under sidewalk is contained at the F&M Bank entrance.
10. Install EC-1 at the end of the northern entrance radius into the F&M Bank building and
add 21-B to shoulder along the taper.
11. Cut excess wood from sign posts throughout project.
12. Add 21-B to shoulder between Valley Farm Credit entrances.
13. Add CD marker to drain outlet on west side of Route 522 near signal pole bases.
Upon completion of these items please call me for a reinspection.

organized under the laws of the State of Penn , lvania, and having its principal office in the City of
Philadelphia, State of Pennsylvania, as Surety, are held and firmly bound unto the County of
Frederick, Obligee, in the sum of Fifteen thousand five hundred forty-five dollars ($15.545.00lawful
money of the United States of America, for the payment of which well and truly to be made we bind
ourselves, our successors and assigns, jointly and severally, firmly by these presents.
The condition of this obligation is such that, Whereas, the Obligee will issue a Certificate of
Occupancy for the Price Club, Winchester. VA conditioned upon the filing of Performance Guaranty
assuring the Completion of Miscellaneous Sitework and Landscaping at Price Club, Winchester VA
NOW THEREFORE, if the said Principal shall well and truly complete the improvements in
accordance with the plan then this obligation to be void, otherwise to remain in full force and effect.
IN WITNESS WHEREOF, the said Principal, has signed and sealed this bond and the said
Surety, has caused the same to be signed in its name and its corporate seal to be hereto affixed and

This Power of Attorney is granted under and by authority of Article VII of the By -Lows of UNITED PACIFIC INSURANCE COMPANY which

ARTICLE VII - EXECUTION OF BONDS AND UNDERTAKING
1. The Board of Directors, the President, the Chairman of the Board, any Senior Vice President, any Vice President or Assistant Vice
President or other officer designated by the Board of Directors shall have power and authority to (a) appoint Attomey(s)-in•Fact and to
authorize them to execute on behalf of the Company, bonds and undertakings, recognizences, contracts of indemnity and other writings
obligatory in the nature thereof, and (b) to remove any such Attomey(s)-in•Fact at any time and revoke the power and authority given to them.
2. Atto►ney(sHn-Fact shall haw power and authority, subject to the terms and limitations of the Power of Attorney issued to them, to
execute and deliver on behalf of the Company, bonds and undertakings, recognizences, contracts of indent ty wW other writings obligatory in
the nature thereof. The corporate seal is not neoessery for the validity of any bonds and undertakings, recognizences, contracts of indemnity
and other writings obligatory in the nature thereof.
3. Attornoy(s)-in-Fact shall have power and authority to execute affidavits required to be attached to bonds, rocognizances, contracts of
Indemnity or other conditional or obligatory undertakings and they shall also have power and authority to certify the financial statement of the
Company and to copies of the By -Laws of the Company or any article or section thereof.
This Power of Attorney is signed and sealed by facsimile under and by authority of the following Resolution adopted by the Board of Directors
of UNITED PACIFIC INSURANCE COMPANY at a meeting hold on the Sth day of June, 1979, at which a quorum was present, and said
Resolution has not been amended or repealed:
'Resolved that the signatures of such director* and officers and the seal of the Company may be affixed to any such
Power of Attorney or any certificates relating thereto by fecsimila, and any such Power of Attorney or certificate bearing
such facsimile signatures or facsintila anal shall be valid and binding upon the Company and any such Power so executed
and certified by facsimile signatures and facsimile seal shag be valid and binding upon the Company, in the future with
respect to any bond or undertaking to which it is attached.'
