Twyford Datalux Corporation 155 Aviation Drive Winchester, Virginia 22602 RE: Datalux Corporation Property Identification Number (PIN) 64F-1-2 Violation of the Frederick County Zoning Ordinance Dear Mr. Twyford: On Friday, April 18, 1997, this office received a complaint concerning construction activity at the above referenced property. I immediately conducted a site inspection to find that the required 50-foot landscape buffer along the eastern property line had been violated. As you were not available when I telephoned Datalux Corporation following my site inspection, I spoke with Robert Wilson concerning this matter. My site inspection revealed that the 50-foot landscaped buffer had been completely cleared of vegetation, graded, and curb and gutter forms had been set. The construction crew was in the process of placing gravel within the forms. It was during this site visit that I advised the construction crew to stop work on this project. The removal of the vegetation within the 50-foot buffer, both natural and planted, violates the approved Master Plan for the Airport Business Center (MDP # 009-87) in addition to the approved Site Plan for Datalux Corporation (Site Plan # 13-94). It is my understanding that this action also violates the covenants for the Airport Business Center. These violations may be remedied by restoring the vegetation within the 50-foot buffer. All curb and gutter forms, rebar, gravel, and other construction materials shall be removed from the 50-foot buffer. As it is not possible to restore the natural vegetation that previously existed, plantings to satisfy the Full Landscape Buffer requirements of the Zoning Ordinance shall be implement. A Full Landscape Buffer will require: a minimum landscape density of three (3) plants per ten (10) linear feet; at least 107 North Kent Street - Winchester, Virginia 22601-5000 Page 2 Datalua Corporation Mr. Twyford April 21, 1997 three (3) species of plants with a minimum caliper of 2 inches at time of planting; and a majority of the plantings being evergreens and at least one-third (1/3) being deciduous. The approved site plan calls for the construction of a manufacturing addition that is 8,006 square feet, the expansion of the paved parking and maneuvering area that will contain a total of 32 regular parking spaces, two disabled parking spaces that are van accessible and have appropriate signage, and the extension of curb and gutter, the installation of concrete sidewalks, the relocation of the dumpster pad, which will be enclosed by a solid wooden fence with a latched gate, the creation of a storm water management discharge structure, the planting of a landscaped screen along the rear of the property, and all appropriate erosion and sedimentation control measures. I have provided you with two copies of the approved site plan. This will allow you to provide the contractor with an on -site copy and keep a copy for your records. Our comments may be found on the enclosed plans marked in red and as follows: IThe existing commercial entrances will be adequate to accommodate the proposed building expansion. 2: The roadway fill and 30" drainage culvert should not be used as part of the detention facility. A separate facility (berm or weir wall) should be constructed away from the road that does not affect the performance or maintenance of the 30" culvert. The facility can be partially in the existing drainage easement, but must be off the right-of-way. To make room for the facility, it appears the 30" culvert can be shortened 9'+ and still provide the 10' shoulder and 3:1 fill slope necessary for Aviation Drive. At least 5' of clearance from the 30" culvert end section to the toe of the new facility is needed for maintenance. 3. The statement on Page 4 of the stormwater management report "capacity of 30" C.M.P.A. at 14% is 83 c.f.s." is only taken into account Manning's equation. Inlet control "Hw/D" restrictions should be looked at. Please revise and resubmit three (3) copies for further review.
