Dear Mr. Casterline:
I am writing to follow up on my letter dated May 5, 1994, regarding the installation of a
traffic light at the corner of Route 7 and Regency Lakes Drive.
As you are aware, the original Regency Lakes site plan and master development plan
was submitted in 1986, and it was approved with the understanding that a traffic light
would be required for Route 7 and Regency Lakes Drive at some point during project
development. It was acknowledged and understood that when the Resident Engineer
for the Staunton District of the Virginia Department of Transportation indicated traffic
levels exist which justify this traffic light, then it would be installed by the developer or
the Virginia Department of Transportation at the developer's expense.
My letter to you on May 5 of this year stated that Mr. William H. Bushman, Resident
Engineer for the Staunton District, had informed Frederick County that the need for a
traffic light now exists at this intersection. I also informed you that Sheetz, Incorporated
had graciously stepped forward and agreed to pay half the cost for installation of the
light.
Both Frederick County and Sheetz, Inc. have been working together in order to see that
the traffic light is installed, and are anxiously awaiting your response to this proposal.
This proposal from Sheetz, Inc. is yery generous and one we believe you will want to
grasp because of the savings to your company.

I am writing to ask for your consideration and action on a proposal that will be mutually
beneficial to your company, the residents of Regency Lakes, and Frederick County.
When the original Regency Lakes site plan and master development plan was
submitted in 1986, it was approved with the understanding that a traffic light would be
required for Route 7 and Regency Lakes Drive at some point during project
development. It was acknowledged and understood that when the Resident Engineer
for the Staunton District of the Virginia Department of Transportation indicated traffic
levels exist which justify this traffic light, then it would be installed by the developer or
the Virginia Department of Transportation at the developer's expense.
Mr. William H. Bushman, Resident Engineer for the Staunton District, has informed
Frederick County that the need for a traffic light now exists at this intersection. The
combination of the level of traffic generated by Regency Lakes development and the
projected levels of traffic the proposed Sheetz convenience store will add to Regency
Lakes Drive, has established the need for signal light control.
It is important to note the original approval agreement of your development required
that the Regency Lakes owners bear 100% of the costs associated with providing the
traffic light. Sheetz, Inc. has recognized the impact their proposed development will
have on the level of traffic on Regency Lakes Drive and has stepped forward and
agreed to pay half the cost for installation of the light. This proposal from Sheetz, Inc.
is very generous and one we believe you will want to grasp because of the savings to
your company.

SUBJECT: Installation of Traffic Light - Sheetz Route 7 Project
DATE: May 10, 1994
Please be advised that staff is moving expeditiously to
issue building permits for the Route 7 Sheetz project. One
obstacle which we are trying to resolve with the Virginia
Department of Transportation (VDOT) is the installation of a
traffic light at the intersection of Regency Lakes Drive and
Route 7. Prior to change in ownership, Regency Lakes Development
had indicated they would fully fund the installation of the
traffic light when the need justified said installation. Sheetz
has also indicated that it- will pay one-half of the cost of said
light. With Sheetz being a definite commitment, I have written
the new owners (Casterline, Inc.) of Regency and asked them to
remit one-half the cost ($40,000) of the new traffic light.
I feel confident that the new owners will fund their share
of said light, but it may be necessary for the county to advance
Regency's share for the cost of the light if we near completion
of the Shedtz project and the issue is not resolved.
This memorandum is for your information only and is provided
to you only as a measure of caution and not a request for funds.

This letter is to follow up on our phone conversation of this morning regarding the Sheetz, Inc.
site plan. As we discussed, the site plan is basically ready for approval provided the Planning
Commission grants a waiver for the spacing requirement on arterial highways and the revisions
we spoke of this morning are made. To summarize the needed revisions, I offer the following:
1) The second entrance on Regency Lakes Drive does not meet the 70 foot spacing
requirement on collector roads from the 60 foot ingress/egress easement owned by S-D
Corporation as required by the Zoning Ordinance.
2) Please indicate the correct deed book and page reference for the ingress/egress easement
on the site plan.

This letter is in reference to my preliminary review of the site plan for Sheetz, Inc. This site
plan has not been officially submitted and my review is strictly for compliance with the Zoning
Ordinance. The overall concept of this plan is fine, however, I have a few relatively minor
comments that should be addressed. I offer the following:
I would prefer that the Sheetz sign shown on Sheet 2 (Construction Plan) be indicated
on Sheet 1 (Site Plan), along with the dimensions.
2) It would be helpful to have a legend indicating symbols.
The ordinance requires one loading space for the first 10,000 square feet of floor area,
there is a space behind the building that looks as though it is a loading space. Please
indicate .
Per my conversation with John Trenary, Building Official, the handicap parking
spaces provided do not meet the intent of the ADA law. These spaces need to be moved
closer to the entrances to the store.
The review of entrance spacing is contingent on VDOT reducing the speed limit on Route 7 to
35 mph, therefore reducing the minimum entrance spacing requirement to 150 feet.
Furthermore, be advised that once this department receives the official site plan application it
will need to appear on the bi-monthly report to the Planning Commission.

We have received your revised site plans dated May 3, 1994 for the referenced project. All of
our earlier comments appear to have been satisfactorily addressed. Please advise the owner of
our approval.
I offer the following comments:
• A preconstruction conference held by you or the owner with the attendance of the contractor,
various County agencies and this Department shall be conducted prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such that
additional measures are warranted, such measures shall be implemented as directed by our site
inspector.
• The contractor shall notify this office when work is to begin or cease for any undetermined
length of time. Also we will require 48 hours notice for any and all inspections.
• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. Said permit will require a minimal processing fee, surety bond coverage
and the salary and expenses of a State assigned inspector. A permit of this nature normally
takes approximately thirty (30) days to process and issue once satisfactory application has been
made. As previously discussed, we will not consider issuance of a permit for this project for
the improvements to. Route 7 until 100 % funding for the required signal is in place.

• Although Regency Lakes Drive is currently not in our Secondary Maintenance System, all
construction within this right-of-way must be in accordance with the approved plans in order
for the street to be added at a future date. All construction access to the site must be from
Regency Lakes Drive.
A deed of dedication and plat for the required right-of-way along Route 7 conveying the
property to the Commonwealth of Virginia will need to be provided. Once prepared the
instrument should be submitted for our review prior to recordation. The instrument should
be submitted as soon as possible in order to accommodate the necessary Route 7 widening and
signal installation.
• We will require six (6) additional sets of the approved site plan in order to issu necessary
permits.
Again, I would like to point out we will be unable to issue the Sheetz Corporation a land use
permit to start construction on the Route 7 right-of-way until all signal funding is finalized.
However, we have no objections to construction activities starting on site or on the Regency
Drive right-of-way.

I am writing in response to our telephone conversation last week concerning the reference
project. As I said, we do not believe the existing entrance to The Apple Cart parcels will have
an adverse impact on the proposed Sheetz entrance on Regency Lakes Drive. If the Sheetz
Corporation is required to maintain a landscape barrier or fence along the property line with The
Apple Cart parcels, access through the existing entrance gutter to the approximately 1,000 sq. ft.
parcel would be impractical as well as almost impossible.

As requested, we have reviewed the above referenced project's site plans dated February, 1994.
Our comments may be found on the enclosed plans marked in red and as follows:
1. The entrance widths and radii are to be adjusted as noted. Also, the entrances on
Regency Lakes Drive will need to be changed to Type CG-9B in lieu of CG-10A.
2. A 10' paved right turn lane will need to be provided along the Route 7 frontage to be
consistent with the east side of the Regency Lakes Drive intersection.
3. A 5' right-of-way dedication along Route 7 and in the northwest quadrant of the
Route 7/Regency Lakes Drive intersection for future sidewalk, traffic signal pole and
equipment will be required as noted.
4. Standard CG-12 handicap ramps will need to be provided at the Route 7/Regency Lakes
Drive intersection and the Route 7 commercial entrance.
5. A curb drop inlet (Type DI-3B) or some other method is needed to pick up the gutter
flow traveling east along the north side of Route 7 to prevent water from spilling across
the pavement into the existing DI-1 drop inlet.
6. Additional detail for the proposed 6" sanitary sewer main crossing of Regency Lakes
Drive will be needed.
7. So not to restrict sight distance, the proposed plantings along Regency Lakes Drive
should be no higher than 2' at maturity.
8. The typical pavement section and storm sewer profiles will need to be adjusted/changed
as noted.

9. The existing sight distance and speed limit along Route 7 will need to be added to the
plans as noted.
10. The enclosed VDOT specifications will need to be incorporated into the plans.
Our review of the intersection traffic analysis report submitted by Mr. Ron Mislowsky of G. W.
Clifford & Associates revealed some discrepancies. Mr. Mislowsky was contacted about the
discrepancies and will resubmit the intersection traffic analysis report for further review. We
will apprise you on this matter as soon as possible.

As requested, we have reviewed the above referenced project's site plans dated February, 1994.
Our comments may be found on the enclosed plans marked in red and as follows:
1. The entrance widths and radii are to be adjusted as noted. Also, the entrances on
Regency Lakes Drive will need to be changed to Type CG-9B in lied of CG-10A.
2. A 10' paved right turn lane will need to be provided along the Route 7 frontage to be
consistent with the east side of the Regency Lakes Drive intersection.
3. A 5' right-of-way dedication along Route 7 and in the northwest quadrant of the
Route 7/Regency Lakes Drive intersection for future sidewalk, traffic signal pole and
equipment will be required as noted.
4. Standard CG-12 handicap ramps will need to be provided at the Route 7/Regency Lakes
Drive intersection and the Route 7 commercial entrance.
5. A curb drop inlet (Type DI-3B) or some other method is needed to pick LIP the gutter
flow traveling east along the north side of Route 7 to prevent water from spilling across
the pavement into the existing DI-1 drop inlet.
6. Additional detail for the proposed 6" sanitary sewer main crossing of Regency Lakes
Drive will be needed.
7. So not to restrict sight distance, the proposed plantings along Regency Lakes Drive
should be no higher than 2' at maturity.
8. The typical pavement section and storm sewer profiles will need to be adjusted/changed
as noted.

Our review of the intersection traffic analysis report submitted by Mr. Ron Mislowsky of G. W.
Clifford & Associates revealed some discrepancies. Mr. Mislowsky was contacted about the
discrepancies and will resubmit the intersection traffic analysis report for further review. We
will apprise you on this matter as soon as possible.

required at some later point in project development. It is
acknowledged and understood that when the Highway
Resident Engineer indicates traffic levels exist which
justify this stop light, then it will be installed by the
developer or the department at the developers expense. A
note to this effect has been added to the plans to satisfy
County requests on this matter.

In order to meet your requirements, the east bound lane
has been provided with a full 200 foot taper and 200 foot
stacking lane. The width of the turning lane on the east
bound and decell lane on the west bound lane have been
changed to 12 feet from 10 feet. We have provided a 3 to 1
taper on the west bound lane as requested. The turning
radius on the east side of the project intersection was
shown to be 15 feet in order to maintain the road
improvements within the existing right-of-way. A 40 foot
radius will require the addition of right-of-way. it 1s not
known at this writing if such an acquisition is possible,
however, we are checking. It should be pointed out that
the purpose of the pavement widening and traffic control
stripes was to allow for adequate turning radius on a
single lane end condition. With a 16 foot single lane into
the project, we believe adequate radius exist with the 15
foot radius shown. We do acknowledge that a lerger radius
would be better and we are attempting to work this out
and will reply as soon as possible.

revised to conform to your request. Also the location of
these entrances are to be fixed persuant to the 25 footset

with actual field conditions.

We acknowledge the fact that the degree of curvature at
the first horizontal curve on the entrance road is minimum
In nature. We have discussed this situation with the
owner early on in the design and he has attempted to
obtain additional right-of-way to increase this curve
radius and has been unsuccessful. We understand that the
geometric design as proposed including additional curb and
gutter as revised on the attached plans is satisfactory to
meet urban design conditions and Is therefore satisfactory
for this project.

We acknowledge a letter from Mr. Don Keith, of May 28,
1986, which establishes certain design sections for
pavement on this project persuant to a traffic analysis
Performed by the YDH&T Traffic section in Richmond, Yo.
We understand that these design sections are tenetive and
are given to the owner for the expressed purpose of
budgeting for construction costs. Actual sizing of
pavement would be done after C8R Tests are available. We
understand that your office must run the CSR's, and this
would be just prior to the point of establishing sub -grade
on this project. Attached is a summary list of our orlginai
design and also what you propQsa as a design section. Due
to the substantial difference between these two pavement
designs and the attendent increase cost, we expect more
dialog between the developer, the engineer, and the
Highway Dept. to continue on this subject. Since this is
normally a matter which is ironed out during the
construction process, it is our understanding that this
matter need not be decided out prior to conditions of the
site plan approval by Frederick County, Yo. For this
reason, the owner desires to proceed with CHR tests and
perform additional design studies prior to an actual
determination of pavement design.

This is in regard to the need for ccxmnents from us relative to the final site
Plan approval for Regency Lake Estates Subdivision. our ccxmnents here are not to
be conztrued by any one as final approval by the Departrent of Highways and
Transportation of this subdivision plan. Final drainage analysis and actual
pavement design are incomplete and will be incorporated into the approved final
design plans when available. Interim designs have been furnished the developer
and his engineer for planning purposes.
The basic plan and most roadway features have been reviewed previously by the
Department and accepted or modified for acceptance. If the dam concept is
retained, the previously furnished agreement governing the access to phase I must
be formulated. A guide has been furnished.
The proposed entrance on Route 7 must include the recommerx features as
outlined in the memorandum from Mr. ,7. H. Diamond, Staunt= District Traffic
Engineer, c opjr attached, , This includes all work associated with adjusting the
median crossover and attendant turn lanes. You will note Mr. Diamond indicates
the full development sche?xne will require the installation of a traffic signal at
this Location, t-.e cost of which is the developer's responsibility.
Also attached for your review are the comments made by Mr. D. L. Camper,
Assistant Secondary Roads Engineer. We understand the r.,exreloper and his engineer
have been informed of them previously, though to date we have not seen plans

At the request of Mr. Joe Stephens of your company, I am enclosing the following information for the
referenced project:
• Land Use Permit Application #40109
• Land Use Permit Surety Bond Form MP-20
• Copy of letter dated 05/19/94 to your design engineer, Mr. John C. Lewis, P.E.
The land use permit application will need to be completed where indicated and returned along with a
check made payable to VDOT in the amount of $40.00. Mr. Stephens indicated your company will post
a bond for the entire amount of the required traffic signal in order to get the permit process started. Our
estimated cost for the signal is $100,000 and other related right-of-way improvements $15,000.
Therefore, the enclosed bond form will need to be completed in the amount of $115,000 and returned
along with your land use permit application.
The items I have highlighted on the enclosed letter to Mr. Lewis will also need to be provided.
Once the required information has been received, our processing time for a permit of this nature takes
approximately thirty (30) days. Your company will be responsible for paying the salary and expenses
of a State assigned Inspector in conjunction with the project. Any charges will be billed monthly on an
account receivable basis. Also the design, material, and installation costs of the traffic signal will be
billed to the same account receivable number.

We have completed our review of the subject site plan and offer
the following comments:
1) Stormwater Management
The proposed stormwater management utilizes a 42 inch RCP to
detain storm runoff. A review of the design calculations
related to this system yielded the following comments and/or
questions:
a) On page 4 under Area 3 Summary, the pre -development
flows should be 1.27 and 1.63 for the two (2) and ten
(10) year storms, respectively.
b) Under the tabulated pond data, the maximum storage for
the pipe at elevation 669.50 is given as 2,454 cubic
feet. This value exceeds the actual volume capacity
of 240 feet of 42 inch RCP. Please justify.
c) The peak inflows indicated on page 3 of each set of
computer output sheets indicates values of 2.98 and
3.15 for the two (2) and ten (10) year storms,
respectively. These appear to be pre -development
conditions. Attachment 3 indicates peak flows of 5.25
and 6.73 for the two (2) and ten (10) year post -
development conditions, respectively.
It is suggested that the actual unit hydrograph rather than the
modified hydrograph be utilized to resolve these discrepancies.
Please provide the input used to develop inflow hydrographs. It
appears that the file being used to generate the inflow hydrograph

RCP. A four (4) inch thick "cement" plug will not work in
a 42 inch diameter opening.
b) Refer to the on site pavement section. Provide typical
joint patterns and joint details for the proposed rigid
pavement.
c) Verify that the proposed flexible pavement section at the
Route 7 East entrance approximates the Route 7 East
pavement section. It is anticipated that the bituminous
base thickness under Route 7 East is closer to seven (7)
inches. It is suggested that the Virginia Department of
Transportation be contacted to verify this thickness.
