I am writing in response to our phone conversation of August 18, 2010 regarding the above
referenced property. You advised that you were interested in renting the existing model home
on the property to a prospective commercial tenant. You expressed frustration over the
manner in which you were being treated by various county departments and stated you did not
get adequate assistance in determining whether or not particular uses could be located within
the existing structure.
I directed my office staff to meet with representatives from the Health Department, the
Planning and Development Department, and the Building Inspections Department to find out
why you could not rent the existing model home and what permitted uses would be allowed in
this structure without requiring the filing of a new site plan or major site modifications. During
that meeting my staff was advised of various reasons why certain uses were not appropriate for
this location. Some of the major reasons include:
The existing drain field was permitted for 150 gallons/day. Per the Health
Department, 95 gallons/day are being consumed by the uses located in the multi -
tenant commercial structure, which leaves a remainder of 55 gallons/day for the
existing model home. Per Health Department regulations, as uses change in the
multi -tenant structure and/or the model home, the gallons/day requirement also
changes.
Per the Building Official, the existing model home is approved for a load of up to 50
pounds per square foot. The Building Official can post.the structure with the 50
pounds per square foot requirement, if you so desire. Please note, however, that
the load requirement for a retail use is 100 pounds per square foot and that such a
use therefore would be in excess of the posted limit.

The property is zoned B-2 (General Business). This district contains a large number
of permitted uses; however, each of those uses has specific parking and other
requirements which must be met if they are to be undertaken in this district.
After a lengthy meeting with the various department representatives, a consensus was reached
that an office use with up to five employees could be accommodated without a new site plan
being filed. Should you wish to pursue any of the other permitted uses in the B-2 District at this
location you will need to consult with the Health Department, the Planning and Development
Department, and the Building Inspections Department to determine whether or not the current
site, health system, parking, etc. can accommodate those uses.

The Frederick County Planning Department administratively approved Site Plan #010-94 for
Hager's Spa & Pool on April 18, 1994. The approved site plan calls for the construction of a
two story model home with electrical service, the installation of 18 concrete wheel stops to
designate parking spaces on the existing gravel parking lot, and the enclosure of the trash
dumpster with an opaque wooden fence with a latched gate.
I have provided you with two copies of the approved site plan. This will allow you to provide
the contractor with an on -site copy and keep a copy for your records. Please contact this office

Dear Scot:
I have had an opportunity to review the above referenced site plan. The following comments
need to be addressed prior to final approval of this site plan:
1) Please revise the development name to reflect the existing business use.
2) Please provide a signature for the Registered Professional Engineer Certificate.
3) Please provide the date that the plan was prepared.
4) Please change the Vicinity Map scale to 1" = 24,000'.
5) Please change the zoning of parcel 52-A-148 to read RA.
6) Please provide the owners name for parcel 52-A-149 (Winchester Outdoor Advertising).
7) Please provide FAR calculations for this parcel.
8) Please provide the height for all structures located on this parcel.
9) Please provide the location and dimension for any existing or proposed sign, outdoor
lighting fixture, or outdoor storage area.
10) Please enclose the trash dumpster with a solid wooden fence with a latched gate.
11) Please provide the name for Route 50 West (Northwestern Pike).
12) Please provide the location and dimension of any easements on this property.
13) The parking calculations for this site are confusing. It appears that these calculations
have been based on the square footage requirements for the category of furniture and
carpet stores, retail nurseries, farm equipment and feed sales, boat, mobile home and
motor vehicle sales. My understanding is that the primary use for this site is a sales
office for spas and pools. The parking requirements for this use would fall under the
category of general offices which requires 1 parking space for each 250 square feet of
floor area.

The Frederick County Planning Commission provided staff with administrative approval
authority for this site plan during their regular meeting of April 6, 1994. I will recommend final
approval of this site plan once our department has received the site plan application, the site plan
review fee, all approved review agency comments, and five copies of the final site plan that
address the comments specified in this letter.

Dear Barbara,
Per our telephone conversation, our firm is proceeding with the required site
plan for the proposed model home situated on the 1.56 acre tract located west of
Winchester on U.S. Route 50. Our firm has had a lengthy discussion with the
Frederick County Planning staff to determine the requirements for this site plan.
Based on our meeting the following list will be required to obtain site plan approval.
1. The proposed model home will be situated on a permanent
foundation, inspected on an annual basis by the Frederick County
Inspections Department.
2. This residential model home will not require current ADA standards.
3. Existing parking for the current business will need to be determined
based on the square footage of the existing building. All parking spaces
will be shown on the site plan and must be improved with concrete
parking stops.
4. The model home is considered an accessory use to the existing facility
and will require two additional parking spaces.
5. As an accessory use, the model home will not require buffer and
screening.
6. The Frederick County Planning staff presented the site plan concept to
the Planning Commission on Wednesday, 6 April. The plan received
favorable approval by the Planning Commission for the staff to proceed
with administrative review and approval of the model home site plan.
7. The Frederick County Site Plan Application Fee for this project will be
the minimum rate of $500 payable at the time of application
submission.

8. Paved parking will not be required provided the existing parking lot
has adequate space for the existing use and the additional two space
accessory use.
Our firm has proceeded with the field run topographic survey and the one
sheet site plan drawing. Additionally, we are finalizing the site plan application and
comment sheets ready for submittal to the agencies. Your assistance in distributing
these comment sheets would be greatly appreciated.
