These chances are as follows: The proposed DI-1 drop inlet is to be replaced by a standard manhole. This is to prevent any drainage from entering this culvert from your devel- opment. Erosion control stone is to be placed at the discharge end of the proposed culvert extension. A curb is to be constructed along the north edge of the paved area to direct the run off to a drop inlet on the northwest corner. If the entrance to Garber Road is eliminated, a paved flume may be used in lieu of the drop inlet and culvert. This site plan is being approved by this Department with the understanding that no drainage from this proposed development is allowed to enter the drain- a;e easement or the property to the north. All drainage is to be directed to Garber Road. Should additional development be planned in this area which would increase the run off it will be the responsibility of the Developer to make satisfactory arrangements with the effected property owners and this Depart- ment. if there are any questions, please advise. MEMORANDUM February 18, 1976 TO: PLANNING COMMISSION for the County of Frederick, Virginia MEMBERS FROM: H. Ronald Berg, secretary of the PLANNING COMMISSION SUBJECT: Staff Recommendation - GARBER SITE PLAN J-0'D"X(,0o V ". LOCATION: Mr. Donald E. Garber proposes a fast-food restaurant operation on Lot Number Three (3) of the Garber Subdivision. The proposed location is at the intersection of new and old Routes 522 and across Route 522 from Lowe's. PROBLEM: Since the construction of Lowe's and the Farm Credit Service there has been exces- sive storm water flow across the property owned by Dr. J. L. Grimes. No easements are in existence, nor have been granted, to carry this storm water. RECOM1161ENDATION: After an on -site review and review during staff meetings (of the site); the staff recommends that this Site Plan not be approved until the drainage problem is corrected. The fotl.owing methods of correcting said problem arc respectfully su­­ested: 1. All drainage water should be taken down the North lot line of Lot Number Three (3) to old Route 522 and all the driveway culverts dorm to the Grimes property should be re -sized. 2. A drainage easement should be secured from Dr. Grimes and other property owners to complete the easement on record along Lots One (1) and Two (2). This easement should be improved with a paved ditch. RATIONALE: The water problem is damaging Dr. Crimes' property now. There is no reason to wait for further development, as suggested by the Highway Department, as it would solve nothing. Further, it is unfair to expect Dr. Grimes to bear the cost of errosion of his property that is directly resulting from the Garbers not having properly planned for storm water runoff. Briefly, the sources of the problem are: 1. drainage along Garber Road; 2. drainage from the incomplete easement in the subdivision; 3. drainage from Rt. 522 and the Farm Credit site. iQeasures that should be taken to alleviate the existing problem and anticipated future problems are: 1. a comprehensive drainage study made by a professional engineer to include methods and materials to accommodate runoff from the entire area down to I-81; 2. if proposed water and sewer lines are laid in the subdivision immediate erosion control of the broken ground must be attempted. The path of these lines goes directly through the imcomplete drainage easement on the subdivision plat. 3. to establish where the responsibility lies to finance construction involved. 4. deadlines for completion of construction should be set and enforced. In closing I wish to thank you for your time and effort in this matter. I know that you will attempt to do what is fair for all concerned. L. Peters, agreement dated March 10, 1971. There are 30 lots within this subdivision to which a sewer main could be extended; however, per an agreement with Frederick County dated January 24, 1.973, hIr. Peters agreed to the County serving 18 of those lots.
