VDACS Food Safety has no objection to these plans. I am responding because
Nikeya Thomas is leaving her position in our food safety program, effective on
Thursday of this week. You may send any other communications about your project,
where Food Safety needs to comment or have involvement, directly to me.

I am the site design engineering for a small transload facility being constructed in Frederick
County, VA, where OmniTRAX Railroad will transload canola oil and sunflower oil from
rail cars to trucks for last-mile transport to the ultimate destination. The Frederick County
Building Inspections Dept asked that I have the Dept of Agriculture and Consumer Services
review the site plan for the project. In speaking with Christy Brennan of VA Dept of Ag and
Consumer Services, I was directed to you for plan review and approval. It is for that purpose
that I am providing the attached site plan. For your information and convenience, I am also
attaching the SDS sheets for the material being transloaded.
As you will see, the site work consists of constructing a small area of pavement upon which
the trucks will park while transloading.
If information is needed from the hauler concerning the business plan, please let me know,
and I will have them contact you. My role is limited to the site plan.

The Virginia Pollutant Discharge Elimination System (VPDES) General Permit Regulation for Discharges
of Stormwater Associated with Industrial Activity (9VAC25-151-10) defines the categories of facilities that
are considered to be engaging in “industrial activity”. One of those categories is transportation facilities
classified as SIC Codes 40, 41, 42 (except 4221-4225), 43, 44, 45, and 5171 (OMB SIC Manual, 1987)
which have vehicle maintenance shops, equipment cleaning operations, or airport deicing operations.
Only those portions of the facility that are either involved in vehicle maintenance (including vehicle
rehabilitation, mechanical repairs, painting, fueling, and lubrication), equipment cleaning operation, airport
deicing operation, or which are otherwise identified under categories 1 through 7 or 9 and 10 of this
definition are associated with industrial activity. Based on the regulation and the description in your email
below, the facility where OmniTRAX Railroad will transload canola oil and sunflower oil from rail cars to
trucks is not considered to be engaging in “industrial activity”; therefore, coverage under the VPDES
General Permit for Discharges of Stormwater Associated with Industrial Activity is not required.
Va. Code § 62.1-44.5 states that: “Except in compliance with a certificate, land-disturbance approval, or a
permit issued by the Board or other entity authorized by the Board to issue a certificate, land-disturbance
approval, or permit pursuant to this chapter, it shall be unlawful for any person to: Discharge into state
waters sewage, industrial wastes, other wastes, or any noxious or deleterious substances; … Otherwise
alter the physical, chemical or biological properties of state waters and make them detrimental to the
public health, or to animal or aquatic life, or to the uses of such waters for domestic or industrial
consumption, or for recreation, or for other uses…”
While the State Water Control Law prohibits the discharge of canola oil and sunflower oil to state waters,
the law and/or regulation do not specify the steps to be taken to ensure that canola oil and sunflower oil
are not discharged into state waters.
