Jubal Early Drive, Suite 103 Winchester, Virginia 22601 COUNTY of FREDERICK Department of Planning and Development 540/665-5651 RE: Transfer of Development Rights Program Letter of Intent Property Identification Numbers: 37 -A -34B Magisterial District: Back Creek Dear Mr. Holliday: FAX: 540/665-6395 Thank you for your interest in Frederick County's Transfer of Development Rights (TDR) Program. The Frederick County Department of Planning and Development has completed a review of TDR Application Number 06-13. Our office has received all required TDR application materials and on November 25, 2013 the required site inspection was completed to document the property and verify that no zoning violations exist on the site. This office has determined that Property Identification Number (PIN) 37 -A -34B meets the sending property criteria outlined in § 165-302.01 — Sending Properties. This is the same property identified in the instrument recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia as Instrument Number 130013277. Frederick County has determined that this property is eligible to transfer up to 6 residential development rights based on the following calculations: Sending Property TDR Calculations for PINs 37 -A -34B Total Area =36.7666 acres Area in ROW = 0.54 acres Total Eligible Area = 36.2266 Total By Right Density = 7 lots Rights Retained = I Development Rights Available (TDR Sending Area 3) = 6 Please note that any changes or improvements to Property Identification Number (PIN) 37 -A -34B may impact the number of residential development rights you are eligible to transfer. If site conditions materially change subsequent to issuance of this letter of intent, the Department will not issue a TDR Certificate and this letter of intent will be null and void. A new application for TDR certification will be required to re-evaluate potential TDR calculations if this letter of intent is declared null and void. If you choose to proceed with the Transfer of Development Rights Program your next step would be to request a TDR Certificate.
