We have reviewed the rezoning application for Lanzeta Properties located on Rte. 11 in Frederick
County, Va. This application is to rezone 1.724 acres identified as parcels TM # 44-A-48, TM # 44-A-
59 and TM # 44-A-60 from RA to B2. The proposal is to consolidate the three lots into one, if the
rezoning is successful. We offer the following comments:
Frederick County's Comprehensive Plan calls for this segment of Rte. 11 to be a future Urban
6 lane divided highway (U6D). We suggest coordination with County staff to determine
appropriate future right-of-way needs.
Please remove the proposed "improved driveway and access to residence" from the last sheet
of this submittal. Entrance proposals and design will take place at the site plan stage.

(the "Properties") — Proffer Statement dated August 30, 2019
Dear John:
You have submitted to Frederick County for review the proposed proffer statement (the
"Proffer Statement") for the above -referenced proposed rezoning of the Properties, in the
Stonewall Magisterial District, from the RA (Rural Areas) District to the B2 (General Business)
District. 1 have now reviewed the Proffer Statement and it is my opinion that the Proffer
Statement would be in a form to meet the requirements of the Frederick County Zoning
Ordinance and the Code of Virginia, and would be legally sufficient as a proffer statement,
subject to the following comments:
1. On the title/cover page of the Proffer Statement, the reference should be to the actual
record owner of the Properties, Martinsburg Pike LLC, as opposed to Lanzeta
Properties.
2. In the introductory paragraph, to ensure that the requirements of the Generalized
Development Plan (GDP) are expressly made requirements of the Proffer Statement,
the reference to the GDP could be included at the end of the previous sentence, as "...
development of this particular 1.724 acres will be in conformity with the terms and
conditions set forth in this document and the attached Generalized Development
Plan."
3. With respect to the GDP requirements (including the "improved driveway and access
to residence") and proffer items 1 and 2, the Proffer Statement should state a specific
time/event by which the requirements shall be completed. Along similar lines, with
respect to the proffered monetary contribution, staff will want to confirm that, given

the presence of an existing building most recently used for commercial purposes, a
site plan will be required, so as to trigger the proffered monetary contribution.
4. With respect to any modified buffer adjacent to the existing M1 -zoned property,
while the placement of the existing structure on the Properties obviously permits a
reduced buffer, any reduced buffer requirements are not necessarily proper for
inclusion in the Proffer Statement (and by extension, the GDP).
I have not reviewed the substance of the proffers as to whether the proffers are suitable
and appropriate for this specific development, as it is my understanding that review will be done
by staff and the Planning Commission.

Regarding ROW reservation/dedication I would suggest you consider a bit of a hybrid. Typically it is preferable to get the frill
right of way dedication up front so the site can develop with that in mind but it is my understanding that the right of way for a
six lane route 11 as the comprehensive plan calls for would render the site undevelopable since you are trying to use the
existing structure. Given the fact that the 6 lane facility- is likely a long term improvement and a 4 lane facility is more likely to
happen sooner I would suggest consideration of a dedication sufficient to accommodate the 4 lane roadway with a future
reservation for the 6 lane that would perhaps be triggered by redevelopment. Based on coordination with VDOT the width
from the center of the existing right of way that would be needed for a 4 lane facility with sidewalk in the right of way would
be 46.5'. That grows by an additional 12' for the future six land roadway. This assumes a curb and gutter roadway and does
not include right turn lane which would depend upon warrants. I'm not sure this site would trigger a turn lane warrant but I
would also suggest doing that analysis just to be sure since we would want to see that if warranted.
