Simkhovitch REZONING REQUEST PROFFER Property Identified - Tax Map 54A -1 -A Stonewall Magisterial District Property of Donald S. & Velma B. Simkhovitch June 24, 2019 PRELIMINARY MATTERS June 24, 2019 Pursuant to Section 15.2 - 2296 et. Sea• of the Code of Virginia, 1950, as amended, and the provisions of the Frederick County Zoning Ordinance with respect to conditional rezoning, the undersigned owner hereby proffers that in the event the Board of Supervisors of Frederick County, Virginia, shall approve Rezoning Application # for the rezoning of 1.57 acres of the 3.684 -acre parcel TM54A-1-A, from the Business General Zoning District (132) to Industrial Transition Zoning (133), the following proffer statement is made by the owner. Development of the subject property shall be done in conformity with the terms and conditions set forth herein, except to the extent that such terms and conditions may be subsequently amended or revised by the owner and approved by the Frederick County Board of Supervisors in accordance with Virginia law. In the event that such rezoning is not granted, then these proffers shall be deemed withdrawn and of no effect whatsoever. These proffers shall be binding upon the owner and their legal successors or assigns. The subject property is more particularly described as a portion of the land conveyed to Ronald S. & Velma B. Simkovich by deed dated September 22, 1999, and recorded in Deed Book 948, page 247, and further being a portion of the property designated as "Parent Tract" parcel A on the Final Plat of Subdivision of the lands of Ronald S. & Velma B. Simkovich, Recorded in Instrument # 160003050, dated February 10, 2016. See attached Rezoning Plan by Potesta & Associates, Inc. dated May 22, 2019. SITE PLAN ELEMENTS The development of the subject property and the submission of the site plan will provide for the following landscape items. Simkhovitch Monument Style Sign The owner shall comply with the rezoning application #04-03 proffer of one monument style sign along Martinsburg Pike, located on Parcel 54A -1-A. Street Connections Parking Ingress and egress to this portion of the property shall only be accessed through the existing entrances off of Martinsburg Pike and Park Center Drive. Parking for this property will be available onsite and with a shared parking agreement with the adjacent parcels. Maximum Building Size The owner shall comply with the rezoning application #04-03 proffer that the owner's building shall be included in the development's combined square footage of buildings to not exceed 100,000 square feet. The conditions proffered above shall be binding upon the owner, its successors, heirs, and assigns. In the event the Frederick County Board of Supervisors grant said rezoning and accepts these conditions, the proffered conditions shall apply to the land rezoned in addition to other requirements set forth in the Frederick County Code.
