Dear Mr. Knechtel:
Thank you for the opportunity to offer review comments on the Off Road Innovations rezoning
application package, with a draft proffer statement dated May 2019 and Impact Analysis
Statement dated May 2019. Frederick Water offers comments limited to the anticipated
impact/effect upon Frederick Water's public water and sanitary sewer system and the demands
thereon.
The project parcels are located inside of the County's Sewer and Water Service Area (SWSA),
but through previous approvals the City of Winchester's water and sewer services have been
extended and constructed on the parent tract and could be accessible for the proposed
subdivision and rezoning parcel. On March 21, 2019, the Frederick Water Board of Directors
granted an exception to enable the utilization of the City's water and sewer services (see
attached letter of March 21, 2019).
Thank you for the opportunity to offer review comments on the Berlin Steel rezoning
application.

Dear Joe,
On March 19, 2019, the Frederick Water Board of Directors granted your request for an exception
to enable the utilization of City of Winchester Water and Sewer for your client's property on Full
House Drive. This approval affirmed that the previously installed water and sewer infrastructure on
Tax Map Numbers 54A -1-A and 54A -1-A2 may be used for the City's water and sewer service. The
approval also recognizes the city's comment (dated February 15, 2019, attached) that the City will
accept the sewerage conveyed to it through the existing private pump station and sewer line; no
upgrades to the private pump station is permitted. This action enables your client to work with the
City of Winchester to facilitate the water and sewer connection.
The Board did want the property owner and its tenants to be aware that by utilizing City water and
sewer services, the City will provide the services at rates established by City of Winchester City
Council. More importantly, neither Frederick Water nor the Frederick County Board of Supervisors
have a role in the water and sewer rates that may be charged by the City, and therefore the
property owner and tenant will have limited if any representation in the event of future water and
sewer rate increases.

Dear Mr. Knechtel:
You have submitted to Frederick County for review the Proffer Statement for the above -
referenced, proposed rezoning Gt a pwlion of thv Property, in the Stonewall Magisterial District,
from the B2 (General Business) District to the B3 (Industrial Transition; District. I have
reviewed the Proffer Statement and it is my opinion that the Proffer Statement would be in a
form to meet the requirements of the Frederick County Zonng Ordinance and the Code of
Virginia, and would b:: legally sufficient as a proffer statement, subject to the following
comments:
1. Owner and date identification — Because the County Code requires a proffer
statement for a rezoning to be recorded in the land records upon approval of the
rezoning, the Proffer Statement will need to include in its heading the names of the
owners of the Property. As well, for best clarity, the heading should also indicate the
full date (day, month, and year) of the version of the ProtTer Statement.
2. Signature requirements/reference to "owners" — Because a rezoning and a proffer
statement restrict the use of a property, the owners of the Property at the time of
rezoning, and not the "developer", will need to sign Proffer Statement and the
rezoning appfication. This same requirement will also apply to any powers of
attorney being submitted, T you or anyo.)e other than the owners will be responsible
for the presentation of the rezoning to County officials. Along similar lines,
throughout the Proffer Statement, the term "developer" should be changed to
"owners".

Per your request, please accept this letter indicating that the City of Winchester has water and sanitary sewer
facilities in the area of your proposed development and will be willing to serve the development based on the
following pre -requisites:
A development plan must be submitted to the City showing all proposed connections to the existing
system and any proposed new facilities. All existing facilities need to be field verified for location, size
and condition.
Since this connection is proposed to be made to a private pump station where the public force main is
at capacity, no modifications can be made to the existing pump station. No new connections to the
City's force main will be permitted.
Prior to installation of the water meter, the required availability fees will need to be paid in full.
