13, 1995 at 7:30 pm in the Conference Room of the Old County Court House.

AGENDA
1) Discussion of a possible future industrial area for Frederick County.
Information pertaining to this item is attached, and we will have maps at the
meeting to help describe the areas that are involved.
2) Discussion of information provided relevant to the requested of Mr. Linwood Ritter
for permission to extend sewer to the Pioneer Trailer Park on the west side of Route
636, south of Route 277.
Committee members may recall that we discussed this item at our meeting of
December 12, 1994. A recommendation was sent to the Planning Commission
that there be no extension of the sewer and water service area to
accommodate the request. At their meeting of January 4, 1995, the Planning
Commission tabled discussion of the recommendation at the request of the
applicant.

SEARCH FOR FUTURE INDUSTRIAL SITES
WITH RAIL ACCESS
In the Fall of 1994, the Winchester Frederick County Economic Development Commission
(EDC) approached the Planning and Development Department with a concern over the lack
of availability of significant industrial acreage within the County with rail access. (See
attached letter from June Wilmot, dated October 19, 1994 and addressed to Robert
Watkins.)
Following the EDC drawing the planning staff's attention to this matter, there have been
a number of discussions between the EDC and planning staff. Much thought has gone into
evaluating what area(s) of the County might be best suited for a focused effort at facilitating
the formation of an industrial area, keeping in mind that a key ingredient is rail access.
Two very general areas were soon identified as having potential for such designation. One
is the general area east of -the Route 11 North/Interstate 81/Route 37 North interchange.
The CSX rail line travels through this area, it is in close proximity to the 81 interchange and
sewer and water service, and there are a number of large undeveloped tracts of land
present. Unfortunately, much of this area was also involved to varying degrees in the Third
Battle of Winchester and/or Stephens Depot.
The second area identified was the southwest quadrant of the Route 37 South/ Interstate
81\Route 11 South interchange area. This location is similar in obvious ways to the
northern site just described. Two key differences are that this site is somewhat more remote
in terms of direct access to Route 81, and proximity to sewer, and this area does not have
the same degree of involvement in Civil War history.
In evaluating the pros and cons of these two areas, it is the opinion of both the planning
staff and the EDC that the southern site has more potential. The primary reason for this
is that infrastructure can always be improved or extended at this site, whereas the historic
importance of the northern area is a fact that cannot be altered.
There are a couple of potential solutions to the access problem. One would be to pursue
an interchange between Route 651, Shady Elm Road, and Route 37; another would be to
encourage a connection east to Route 11.
In general, the desire at this point is to begin.the process of identifying a site to pursue and
begin thinking about how we can remove obstacles to the future use of the site selected,
The Committee needs to consider whether you feel this is an appropriate use for the area
described, and if so, how we want to proceed.
REQUEST FOR SEWER SERVICE
AT PIONEER MOBILE HOME PARK
At their meeting of January 25, 1995, the Board of Supervisors adopted the 1995 update of
the Comprehensive Policy Plan as it was recommended by the Committee and the Planning
Commission. This update did not include any extension of the Sewer and Water Service
Area.
Subsequent to Mr. Ritter's request to table discussion of the Committee's recommendation
(regarding his previous request for sewer service), the attached information was received
from Mr. Ritter.
In an effort to get first hand information on the status of the health systems in the area, I
contacted the Health Department to inquire about any information they have to document
septic system failures or problems along this stretch of Route 636. The Health Department
has no record of repairs or failed systems in this area. They were quick to point out,
however, that this does not mean there are not problems. As in other areas of the County,
it may be that residents are afraid to report problems for fear of what actions they may be
required to take to rectify the problem. The Health Department also pointed out that many
problems are only brought to their attention at the time of walkover inspections when a
residence is sold. They also stated their belief that only a fraction of failing systems are
detected during these inspections.
The Committee needs to determine if the information supplied by Mr. Ritter is such that
you wish to alter your recommendation to the Planning Commission. One possible step
might be to recommend that the Board of Supervisors request that the Health Department
do a study of the area to determine to what extent there is a problem. This would be
similar to the investigation that was done as part of the study of Rural Community Centers,
or the study of the area on 522 South near Shenandoah Mobile Home Park. Such a study
cannot be done when there is snow on the ground. There is also a manpower issue for the
Health Department.

At its retreat last March, one of the issues the Economic Development
Commission identified was the shrinking inventory of rail -served sites which
gave infrastructure in place.
Based on prospect inquiries we have not been able to meet, the Business
Attraction Committee discussed the subject at its last meeting and is requesting
the opportunity to work with your folks to identify areas which have the most
potential for future business location. Our need, I think, is to identify where
services could be most feasibly extended and where there is less conflict (such
as battlefields). What we will need to assess is whether any readjustment of
the urban development line would be advantageous.
One of the reasons our community has been so successful in achieving its
successes in business development is its readiness. The purpose of this effort
would be to establish the direction of future investments of the infrastructure
so that our resources are concentrated where it is most attractive for
manufacturing to be located. The other key is to reserve these areas in the land
use plan.

Attached is information pertaining to the request of Mr. Ritter for approval to extend sewer
to his M11 I (Mobile Home) property located on Route 636.
Commission members will recall an informal discussion was held with Mr. Ritter
m
-November at which time the Commission passed the request to the Comprehensive P1ans
= and -Programs Committee for a recommendation. The Committee discussed the request at
their meeting of December -12. The__Cotnmittee recommended against permitting the,.
extension.
In order to permit the request, either the .Sewer and Water Service Area or the Urban
Development Area would have to be extended to encompass the Ritter property. The
Committee felt that to do so would set a precedent it- -it -;would open the door to numerous
requests for similarly situated properties to request sewer extensions.
In conjunction with this discussion, the Committee also felt it would be unwise to extend the
Sewer and Water Service Area south of Route 277. Extending the SWSA to encompass the
single fancily residential properties was originally being considered as part of the: Fulton
request. The Committee felt that drawing a distinction between serving the single family
properties and not the MH -1 property would be difficult and that it wou-Id be best to make _
no adjustment to either the SWSA or the UDA in this area, at this time.

I talked with Robert Watkins, Director of Planning for Frederick County, about extending sewer
service to the parcels of land you own on State Route 636 south of Route 277. Mr. Watkins said
this land lies outside the area designated for urban development in the Comprehensive Plan.
Therefore, before sewer lines can be extended to this property, approval must be obtained from
the Frederick County Planning Commission.
Until the necessary approval is obtained from the Planning Commission, the Sanitation Authority
can not do anything to extend sewer to the land. I suggest you contact Mr. Watkins in order to
obtain the necessary approval.

General Terms and Conditions
_Payment: Payment for services shall be paid within 10 days of the beginning of
each- month. PlantManager Inc. reserves the right to cancel this contract for non-
payment for services. - -
Penalties: PlantManager Inc. will accept no liquidated or consequential damage
provisions.
Cancellation: Either party may cancel this contract with W days notice from the
canceling party.
Materials: The owner will incur costs of materials involving major repairs to
� luipment, process chemicals, utilities, process modifications etc.
Responsibility: The owner assumes the responsibility of regulatory compliance as
owner of the Discharge permit and wastewater treatment system. PlantManager
Inc. assumes the responsibility of operations as a Virginia certified operator as
outlined in -the Department of Commerce Regulations for the Certification of Water
and wastewater operators.
Repairs: Major repairs and plant modifications are the responsibility of the owner.
Analysis: All laboratory and on site analysis will be performed using the currently
acceptable version and method number of standard methods for the examination
of water and wastewater as outlined in the Federal Register regulation 40 -CFR -136. -
