The Frederick County Comprehensive Plans and Programs Subcommittee (CPPS) will be meeting
on Monday, August 9, 1999 at 7:30 p.m. in the first floor conference room of the County
Administration Building, 107 North Kent Street, Winchester, Virginia. The CPPS will discuss the
following agenda items:
AGENDA
1) Request from Mr. Jim Petry, Vice President - Development, Jasbo, Inc., to extend sewer
service to the Whitfield Subdivision, located on the east side of Double Church Road (Route
641).
2) Request from Joseph A. Allen, et als, to expand the Urban Development Area (UDA) to
incorporate a 16.9 -acre portion of a 41 -acre parcel. This parcel is located within the City of
Winchester and Frederick County and has frontage along Cedar Creek Grade (Route 622).
Staff has been directed to advise all committee members that access to the County Administration Buildingfor night
meetings that do not occur in the Board room will be limited to the back door of the four-story wing. I would
encourage committee members to park in the county parking lot located behind the new addition or in the Joint
Judicial Center parking lot and follow the sidewalk to the back door of the four-story wing.

Item #1: Seaver Service Extension Request
Please find included under this agenda item a letter from Mr. Jim Petry to Mr. Kris C. Tierney, dated
July 19, 1999, a location map and plat map depicting the Whitfield Subdivision, property ownership
information, and a memorandum from Mr. John Dailey to Mr. Evan Wyatt, dated October 2, 1997,
Mr. Petry has requested that consideration be given to allow the extension of sewer service to the
Whitfield Subdivision. Mr. Petry has stated that the subdivision is experiencing failing drainfield
systems and that perk sites for undeveloped lots cannot be achieved.
Staff has discussed this situation with Mr. Wellington H. Jones, Director, of the Frederick County
Sanitation Authority (FCSA). Mr. Jones has advised staff that service to the Whitfield Subdivision
would have to be accomplished through the installation of a pressurized sewer line that would tie into
the pump station serving the Woodside Estates Subdivision, which is located across Double Church
Road (Route 641). Mr. Jones feels that sewer service could be extended to the Whitfield Subdivision
with limited service capacity; however, the FCSA would desire to evaluate the current system and
general area to be served if additional acreage was being proposed. It should be noted that the
Whitfield Subdivision is served by public water; therefore, there is not a potential for well
contamination within the subdivision.
The CPPS considered this request in October 1997 and recommended that sewer service should not
be extended to the Whitfield Subdivision. The CPPS felt that a favorable action would set a
precedent which would result in additional requests for residential sewer service outside of the
county's Urban Development Area (UDA) and Sewer and Water Service Area (SWSA). The CPPS
also noted that historically, extension of sewer service outside of the UDA and SWSA has only been
granted to accommodate existing industrial, commercial, and institutional uses, and not to promote
new development.
Staff has invited Mr. Petry to address the CPPS during the August meeting. The CPPS will ultimately
be asked to forward a recommendation to the Planning Commission and Board of Supervisors. This
recommendation could be for the extension of sewer service with limited capacity, for the expansion
of the Sewer and Water Service, or for denial of the request. This recommendation could be made
during the August meeting, or at a subsequent meeting should the CPPS desire staff to provide
additional information or conduct further research.

Dear Kris:
On several occasions, we have discussed the Whitfield Subdivision on
Route 641 south of Stephens City. These discussions involve the lack of
sewer service to that subdivision.
We are advised that there are a number of failing drainfields within the
subdivision. We currently own seven lots which we have paid taxes on for
years that are unbuildable for lack of a perk site. The subdivision currently
has water service from FCSA.
I have discussed this matter with Mr. Wendy Jones of FCSA and he is in
agreement that sewer service could be extended to this subdivision. We
are asking the County to take whatever action is necessary allowing us to
extend this service. Should there be any questions you can reach me at

In response to your 10/1/97 request, I have reviewed the health department's permit files
for the Whitfield Subdivision. I found no record of any repair applications submitted or
repair permits issued for this subdivision. Of course, this does not mean that no
drainfields are failing in this area. It only indicates that the property owners have not
contacted us concerning repairs.

Item #2: Urban Development Area Expansion Request
Please find included under this agenda item a letter from Mr. Stephen M. Gyurisin to Mr. Evan A.
Wyatt, dated July 30, 1999, a location map and plat map depicting a 40.9 -acre tract owned by Joseph
A. Allen, et als, and an aerial photograph of the property. On behalf of Mr. Allen, Mr. Gyurisin has
requested that consideration be given to allow the expansion of the county's Urban Development
Area (UDA) to incorporate the 16.9 -acre portion of this tract.
The 40.9 -acre tract has frontage along Cedar Creek Grade (Route 622) and has the ability to connect
to the Westridge Subdivision through local streets connections within the City of Winchester and
Frederick County. The Westridge Subdivision is served by public water and sewer which is provided
by the City of Winchester Public Utilities Department. It would be reasonable to expect this property
to be served in a similar fashion; however, the ability to do so must be authorized by the Frederick
County Sanitation Authority Board. Staff has discussed this issue with Mr. Wellington Jones, FCSA
Director, and has determined that Mr. Jones plans to present this request to his Board on August 17,
1999 with a favorable recommendation.
The 24 -acre portion of this tract that is located within the City of Winchester is currently zoned LR,
Low Density Residential District, which allows for the development of single family dwelling units
on 12,000 square foot lots. The 16.9 -acre portion of this tract that is located within Frederick
County is currently zoned RA, Rural Areas District, which would allow for the development of single
family dwelling units and mobile home units on five -acre lots. Mr. Gyurisin's letter states that should
Mr. Allen be successful with this request and a subsequent rezoning, that he intends to develop the
entire acreage as a 12,000 -square foot lot residential subdivision. In general, a 12,000 -square foot
lot subdivision yields 2.5 units per acre; therefore, the impact on the 16.9 -acre portion would result
in the development of 42 single family residential units in lieu of 3 residential units.
Staff has invited Mr. Gyurisin and Mr. Allen to address the CPPS during the August meeting. The
CPPS will ultimately be asked to forward a recommendation to the Planning Commission and Board
of Supervisors. This recommendation could be made during the August meeting, or at a subsequent
meeting should the CPPS desire staff to provide additional information or conduct further research.

On behalf of the owner of parcel 16-A-2 consisting of 16.9 + acres zoned Rural Area (RA), we request
extension of the Urban Development Area (UDA) to include this property.
4r. Allen's property consists of approximately 41 acres in two parcels located in both the City of Winchester
and Frederick County. The portion of the property located in the City of Winchester is zoned "LR" a
residential zoning classification that allows single family, detached, 12,000 + square foot homes. The portion
located in Frederick County is zoned `TI.A" allowing 2-5 acre lots. We are requesting the extension of the
Urban Development Area (UDA) to allow for development of the remainder of Mr. Allen's property in a more
urban fashion. We envision development design that would be similar to the adjoining Westridge Subdivision
that consists of 12,000 + square foot single family homes, public sewer and water, sidewalks, streetlights,
storm water management and public streets. The adjoining Westridge Subdivision is located in both the City
of Winchester and Frederick County.
Access to the property is possible through future stub roads planned as part of the Westridge Subdivision, the
unbuilt Rudbar Avenue and Cedar Creek Grade.
Sewer and water service would be provided by the City of Winchester if approved by the Frederick County
Sanitation Authority.
Our plans include requesting for a Residential Performance (RP) zoning designation and developing the
infrastructure for a residential neighborhood consisting of 12,000 + square foot single family homes.
