On behalf of the Winchester Regional ;airport Authority (WRAA), I submit the following comments
regarding the above referenced site pian.
1. The following comments should be included with the release for construction (RFC) plans:
a. In accordance with the Code of Federal Regulations Title 14 Part 77.9, the
development meets Federal Aviation Administration (FAA) criteria to file an Obstruction
Evaluation/Airport Airspace Analysis (OE/AAA). OE/AAA filings are also subject to
review by the Virginia Department of Aviation (DOAV).
b. Electronic filing may be accomplished at the following web address:
https://oeaaa.faa.gov/oeaaa/external/portal.jsp.
c. The height of any proposed structures must account for the maximum height of any
and all appurtenances.
d. Cranes and/or temporary construction equipment require a separate OE/AAA filing.
e. OE/APAA submissions should be made a minimum of 45 days prior to the expected
start date of construction.
2. Provide copies of any FAA determination letters to the airport.
The WRAA requests compliance with these comments as a condition of approval of the site plan.

** DETERMINATION OF NO HAZARD TO AIR NAVIGATION **
The Federal Aviation Administration has conducted an aeronautical study under the provisions of 49 U.S.C.,
Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerning:
Structure: Building Airport Parc Building E
Location: Winchester, VA
Latitude: 39-08-23.89N NAD 83
Longitude: 78-09-11.39W
Heights: 725 feet site elevation (SE)
40 feet above ground level (AGL)
765 feet above mean sea level (AMSL)
This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a
hazard to air navigation provided the following condition(s), if any, is(are) met:
It is required that FAA Form 7460-2, Notice of Actual Construction or Alteration, be e -filed any time the
project is abandoned or:
At least 10 days prior to start of construction (7460-2, Part 1)
X Within 5 days after the construction reaches its greatest height (7460-2, Part 2)
Based on this evaluation, marking and lighting are not necessary for aviation safety. However, if marking/
lighting are accomplished on a voluntary basis, we recommend it be installed in accordance with FAA Advisory
circular 70/7460-1 L Change 2.
The structure considered under this study lies in proximity to an airport and occupants may be subjected to
noise from aircraft operating to and from the airport.
This determination expires on 06/14/2020 unless:
(a) the construction is started (not necessarily completed) and FAA Form 7460-2, Notice of Actual
Construction or Alteration, is received by this office.
(b) extended, revised, or terminated by the issuing office.

(c) the construction is subject to the licensing authority of the Federal Communications Commission
(FCC) and an application for a construction permit has been filed, as required by the FCC, within
6 months of the date of this determination. In such case, the determination expires on the date
prescribed by the FCC for completion of construction, or the date the FCC denies the application.
NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETERMINATION MUST
BE E -FILED AT LEAST 15 DAYS PRIOR TO THE EXPIRATION DATE. AFTER RE-EVALUATION
OF CURRENT OPERATIONS IN THE AREA OF THE STRUCTURE TO DETERMINE THAT NO
SIGNIFICANT AERONAUTICAL CHANGES HAVE OCCURRED, YOUR DETERMINATION MAY BE
ELIGIBLE FOR ONE EXTENSION OF THE EFFECTIVE PERIOD.
This determination is based, in part, on the foregoing description which includes specific coordinates, heights,
frequency(ies) and power. Any changes in coordinates, heights, and frequencies or use of greater power, except
those frequencies specified in the Colo Void Clause Coalition; Antenna System Co -Location; Voluntary Best
Practices, effective 21 Nov 2007, will void this determination. Any future construction or alteration, including
increase to heights, power, or the addition of other transmitters, requires separate notice to the FAA.This
determination includes all previously filed frequencies and power for this structure.
If construction or alteration is dismantled or destroyed, you must submit notice to the FAA within 5 days after
the construction or alteration is dismantled or destroyed.
This determination does include temporary construction equipment such as cranes, derricks, etc., which may be
used during actual construction of the structure. However, this equipment shall not exceed the overall heights as
indicated above. Equipment which has a height greater than the studied structure requires separate notice to the
FAA.
This determination concerns the effect of this structure on the safe and efficient use of navigable airspace
by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or
regulation of any Federal, State, or local government body.

Proposal: To construct and/or operate a(n) Crane to a height of 100 feet above ground level, 825 feet above
mean sea level.
Location: The structure will be located 0.46 nautical miles southwest of WINCHESTER RGNL (OKV)
Airport reference point.
Case Description for ASN 2018 -AEA -14554 -OE
Temporary crane for building construction
Schedule: 8 months; 03/01/2018-10/31/2018.
Part 77 Obstruction Standard(s) Exceeded and Aeronautical Impacts, if any:
Aeronautical study revealed that the temporary structure will not exceed any Part 77 obstruction standard.
Aeronautical study confirmed that the temporary structure will have no effect on any existing or proposed
arrival, departure or en route instrument/visual flight rules (IFR/VFR) operations or procedures. Additionally,
aeronautical study confirmed that the temporary structure will have no physical or electromagnetic effect on the
operation of air navigation and communications facilities and will not impact any airspace and routes used by
the military. Based on this aeronautical study, the FAA finds that the temporary structure will have no adverse
effect on air navigation and will not impact any aeronautical operations or procedures.
Based on this aeronautical study, the structure would not constitute a substantial adverse effect on aeronautical
operations or procedures because it will be temporary. The temporary structure would not be considered a
hazard to air navigation provided all of the conditions specified in this determination are strictly met.
As a condition to this Determination, the structure is to be marked/lighted in accordance with FAA
Advisory circular 70/7460-1 L Change 2, Obstruction Marking and Lighting, flags/red lights - Chapters
3 (Marked),4,5(Red),& 12.
Any failure or malfunction that lasts more than thirty (30) minutes and affects a top light or flashing obstruction
light, regardless of its position, should be reported immediately to (877) 487-6867 so a Notice to Airmen
(NOTAM) can be issued. As soon as the normal operation is restored, notify the same number.
It is required that the manager of WINCHESTER RGNL, (540) 662-5786 be notified at least 3 business days
prior to the temporary structure being erected and again when the structure is removed from the site.
This determination expires on 06/14/2020 unless extended, revised, or terminated by the issuing office.
It is required that FAA Form 7460-2, Notice of Actual Construction or Alteration, be e -filed within 5 days after
the temporary structure is dismantled.
NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETERMINATION MUST

As a condition to this determination, the equipment must be lowered when not in use, between sunset & sunrise
and during poor flight conditions (ceiling <1000', visibility <3 miles). If the crane cannot be lowered, it must be
lighted for increased conspicuity in accordance with FAA Advisory Circular 70/7460-1, Obstruction Marking
and Lighting, red lights - Chapters 4, 5(Red),&12.

A VDOT review has been conducted for the Airport Business Parc Building E site plan dated November 19,
2018. Based on the review of the drawings, all of the VDOT requirements are addressed and the site plan is
approved by our office. Please ensure that all applicable agencies have the most recent set of approved
drawings.
We offer the following general comments:
• Our review and comments are general in nature. Should details be overlooked during plan review or
conditions in the field exist such that additional measures are warranted, such measures shall be
completed to the satisfaction of the department.
t Materials used and methods of construction shall adhere to the current observed VDOT Road and
Bridge Specifications, Road and Bridge Standards, Manual on Uniform Traffic Control Devices, and Land
Use Permit Special Provisions.
• A preconstruction conference shall be held by the engineer and/or the developer with the attendance
of the contractor, various County agencies, utility companies, and VDOT prior to initiation of work.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
• Any construction related changes to the approved plan must come through the design engineer to
VDOT for approval. Please allow a minimum of 5 business days for VDOT review.
• A Land Use Permit shall be obtained before any work is performed on the State's right-of-way. The
permit is issued by this office and may require application fees, the salary & expenses of a State
assigned inspector, and surety bond coverage.

Buildings shall comply with The Virginia Uniform Statewide Building Code (VUSBC) Sections
311, S Storage of the International Building Code/2015, the 2015 VUSBC/ International Fire
Code. Other Code that applies is ICC A117.1-3-09. Accessible and Usable Buildings and
Facilities and 2015 Virginia Energy Code
Proposed 88,233sq ft building shall meet T503 for height and area. Unlimited Area Buildings
per Section 507 shall maintain an open perimeter of 60'. Buildings have sprinkler systems
identified.
Maximum travel distance per IBC/USBC to an exit is 400'. All required exits shall meet ANSI
Al 17.1-09 for accessibility and slopes. Question on location of exterior exits along loading
loading dock area. All required exits shall be accessible. Exterior area of refuge shall
comply with Section 1016 of the USBC/IBC. Building wall for 10' in all directions shall be
rated for one hour. Openings located within the wall inside this 10' shall be rated as well.
The area of refuge shall be located outside the required dimensions of the landing. Minimum 48"
between handrails required.
Maximum travel distance to restrooms shall be in accordance with Section 2902.3.2. (Maximum
500' unless otherwise approved by AHJ)
Storage racks exceeding 12' in height require fire department access around perimeter of the
building and shall comply with the 2012 Virginia Fire Code/International Fire Code. The access
doors shall not be spaced further apart than 100'
ANSI parking spaces provided as required per T1106.1 with a minimum of 4 spaces. Accessible
parking and unloading shall not exceed 2% slope (1:48). Accessible Route shall extend from
parking and unloading area to accessible route to main entrance. Curb ramps shall have a
minimum 3' landing at the top and bottom of the landing. Van spaces require minimum
unloading area 8' with 8' of parking or a minimum of 11' wide parking with 5' of unloading
space is required. No enlargement provided. Accessible route with max 5% slopes shall be
provided from parking/unloading to main entrance.
Public entrances into spaces larger than 3000 sq ft shall be provided with a vestibule as detailed
per ANSI A 117.1-09
All structural plans submitted for permit application shall be sealed by a VA Design Professional
Special inspection requirements of Chapter 17 of IBC shall apply to this type of structure. (soils,
compaction, concrete, steel etc.) Geotech report is required per Uniform Statewide Building
Code, Section 1803
