Held in the Board Room of the Old Frederick County Court House in Winchester, Virginia on
October 7, 1992.
PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman;
Manuel C. DeHaven, Stonewall District; Marjorie H. Copenhaver, Back Creek
District; John H. Light, Stonewall District; and Beverly Sherwood, Board
Liaison.
ABSENT: John R. Marker, Vice Chairman/Back Creek District; S. Blaine Wilson, Shawnee
District; Todd D. Shenk, Gainesboro District; George L. Romine, Citizen at
Large; Ronald W. Carper, Gainesboro District; Roger L. Thomas, Opequon
District.
Planning Staff present were • Robert W. Watkins, Planning Director; W. Wayne
Miller, Zoning Administrator; and Evan A. Wyatt, Planner II
CALL TO ODDER
Chairman Golladay announced that the Commission could not act on any official
business because of the lack of a quorum. Chairman Golladay stated that only four voting
members out of ten total Planning Commissioners were present, resulting in only 40%
representation. He said that all public hearing items would have to be postponed to the next
regularly scheduled meeting.
Mr. Miller stated that one of the conditional use permit applicants, Ms. Jill
Holden, would not be able to be present at the next meeting, however, she could have a
representative available. Chairman Golladay recognized that Ms. Holden was present.
DISCUSSION REGARDING AN ORDINANCE CHANGE TO ALLOW RESTAURANTS IN
THE B-1 (NEIGHBORHOOD BUSINESS) ZONING DISTRICT
Mr. Evan Wyatt reported that the Development Review and Regulations
Subcommittee (DRRS) met on September 10, 1992 with Mr. Thomas C. Glass, the owner of the
Country Park Plaza Shopping Center on Senseny Road, to discuss the allowance of restaurants
ON
in the B-1 (Neighborhood Business) Zoning District. Mr. Wyatt said that the DRRS felt that
restaurants are appropriate in shopping centers that are zoned B-1, but should not be the only
structure on the parcel. The DRRS felt that restaurants would be appropriate provided that they
were not of the night club variety. Mr. Wyatt explained that the Standard Industrial
Classification Manual (SIC) distinguishes between eating places (restaurants) and drinking places
(night clubs); therefore, this concern could be addressed through the SIC Code.
Mr. Thomas C. Glass was present to answer questions from the Commission. Mr.
Glass felt that food service was compatible with other permitted uses in neighborhood shopping
centers and should be allowed with restrictions. Mr. Glass proposed restrictions that would allow
restaurants in B-1 only if they were part of a shopping center containing other business units and
did not contain drive-through service. Mr. Glass said that a restaurant in his shopping center,
Toni's Pizza and Subs, wants to expand. He said that they are now considered as a carry -out
bakery business; but if they expand, they would be considered a restaurant.
The Commission had no objections to the proposal as long as nightclubs and drive-
through services were prohibited, as they could disturb nearby neighborhoods. Chairman
Golladay instructed the staff to advertise the ordinance change for public hearing.

1. House Numbering/911 System
Continued update of House Numbering Project through use
of ACAD11, dBase IV and general inquiry. Bob Watkins, Kris
Tierney, Mark Lemasters, and Evan Wyatt met with John Warwick of
Overman & Associates to discuss the history of problems with the
house numbering project.
2. Corridor Appearance/Stephens City Planninq
Bob Watkins and Ron Lilley attended the Lord Fairfax
Planning District Local Planners Network. Planning in Stephens
City and corridor appearance issues were discussed.
3. Capital Improvements Plan
Lanny Bise has begun data collection for the upcoming CIP
process.
4. Site Plan Reviews
Evan Wyatt conducted the following site plan reviews:
On October 5, met with Steven Gyurisin to conduct a
preliminary review of a site along Route 647 (Aylor Road).
On October 6, provided final site plan approval for
Hershey Pasta (Phase II). This site plan was for the proposed
Miller Milling project.
On October 7, met with representatives of Delta
Associates to finalize requirements for the relocation of Route 728
(Victory Lane).
On October 9, provided final site plan approval for the
Winchester Regional Airport Authority to allow the relocation of a
portion of Route 728 (Victory Lane) and widening of the
intersection with Route 645 (Airport Road).
5. Joint Frederick County/Stephens City Planning Committee
Lanny Bise prepared maps for the Joint Frederick
County/Stephens City Planning Committee.
6. Violations
Lanny Bise inspected several zoning violation complaints.
7. Alternative Wastewater Treatment Study
Lanny Bise prepared maps for the Rural Community Center
Alternative Wastewater Treatment Systems Committee meeting. Kris
and Lanny attended the RCC Alternative Wastewater Systems Committee
meeting held on October 13, 1992. The Committee discussed the
results of the sanitary survey.
8. Top of Virginia Home Builders
Bob Watkins addressed the Top of Virginia Home Builders
Association on current work in the Planning Department.

tract is in the City of Winchester and is zoned Low Density
Residential (LR).

PROPOSED USE: Lodge Hall and Community Park
REVIEW EVALUATIONS:
Virginia Department of Transportation: No comment. Access to
property is from a portion of Middle Road which lies within
the City of Winchester.
Fire Marshal: Fire lanes will be required in accordance with
Frederick County Chapter 10. For construction of this
magnitude fire and rescue resources could be impacted. In
order to evaluate compliance with existing fire safety codes,
I cannot approve any construction without a site plan. I have
no problem with approving this as a CUP if that meets zoning
guidelines, but must have a site plan prior to approval of
construction. All additional fire/rescue comments will be
made on site plan.

Inspections Department: . Building shall comply with the
Virginia Uniform Statewide Building Code and Section 302, Use
Group A (Assembly) of .the BOCA National Building Code/1990.
Nondiscrimination on the Basis of Disability by Public
Accommodations and in Commercial Facilities. All building
plans shall require an A/E seal licensed in the State.
Health Department: I am not aware of any reason to object to
proposal as long as no construction takes place within 20' of
drainfield area and all other statutory requirements are met.
City of Winchester: See attached letter from City of
Winchester Planning Director dated October 8, 1992.
Planning Department: The major portion of this 13.583 tract
of land is in Frederick County and is zoned Rural Area (RA).
The Zoning Ordinance permit4 nationally chartered fraternal
lodges or civic clubs, social, centers, and their related
facilities as a conditional use. Outdoor recreation,
athletic, or park facilities are also permitted as a
conditional use in the RA zoning district. This application
is proposing the construction of a lodge facility and a picnic
shelter for the Independent Order of Odd Fellows and to
establish a Community Park. The applicants further state that
they wish to work with the County Parks and Recreation Dept.
to establish Little League ball fields, soccer fields, and
picnic areas to serve the needs of residents of Frederick
County. All of these uses would fit into the authorized
conditional use categories. It is important to note that we
are not aware of any committment on the part of Frederick
County to actively participate in the development of this
property.
The applicant has advised that they intend to deed the 0.159
acre portion of this tract that is in Winchester to an
adjoining property owner. That will remove the portion of the
tract that is zoned in the City where the proposed activity
would not be permitted. The 60 foot right of way from Middle
Road into this property is also in the City of Winchester.
They have advised that this right of way will need to have a
street constructed to their standards and dedicated to the
City. The County would support that request.
A site plan that adequately addresses storm water management,
traffic patterns, buffers and screening, and facility
locations should be required. This should be coordinated with
the City -of Winchester to insure compatibility with adjoining
uses and to insure all concerns are addressed.

Considering the magnitude of the proposed development of this
tract and the possible intensity of the use, we believe it
would be in the best interest of the applicants to consider
utilizing public water from the City. If early determination
of projected requirements indicate the need for public sewer
and water, installation in conjunction with site development
would probably be cost effective. Public sewer is not readily
available although it has been extended to Westridge
Subdivision which is just "up the road". A pump station would
probably be required if sewer were extended to this area
because of the existing terrain features.
STAFF RECOMMENDATIONS FOR NOVEMBER 4 1992 PC MEETING: Approval
with the following conditions:
1. A site plan be prepared and approved by the County prior
to site development.
2. All review agency comments be complied with, including the
City of Winchester requirements pertaining to construction and
dedication of the access street.

Included in your agenda package is information regarding the amendments to Articles III
(Supplementary Use Regulations) and Article IX (Neighborhood Business District) of
Chapter 21, Zoning Ordinance, of the Frederick County Code. These amendments were
discussed by the Development Review and Regulations Subcommittee (DRRS) on
September 10, 1992 and by the Frederick County Planning Commission on October 7, 1992.
The DRRS recommended approval of this amendment with the understanding that this use
would pertain to restaurants that are part of a shopping center that serve food on premise
or on a carry out basis, and do not include nightclub activities. The Standard Industrial
Classification Manual (SIC) distinguishes between restaurant and nightclub uses. The
amendment to Article IX contains the appropriate SIC Code for restaurant use. The
amendment to Article III provided restrictions to this use if it is located in the B-1
(Neighborhood Business) Zoning District.
Staff asks that the Frederick County Planning Commission recommend approval of the
amendments to Article III and Article IX of the Frederick County Zoning Ordinance.

Discussion of Possible Historic Preservation Methods

The staff would like to have a discussion with the Planning Commission concerning methods
which the County might employ to try and preserve significant historic sites throughout the
county.
As most of you are aware the Caleb rezoning resulted in a great deal of discussion and
negotiation over what portion of the tract should be preserved. To fill in those of you who
were not on the Commission at the time of this rezoning and to refresh the memory of those
who were, I will try to summarize. The Caleb rezoning involved 211 acres located just north
of route 7 and east of interstate 81. The entire parcel was to some degree involved in the
Third Battle of Winchester, with a central portion having contained the majority of the
fighting.
An application for rezoning from RA (Rural Areas) to RP (Residential Performance) was
submitted in May of 1989 and was finally approved by the Board of Supervisors in May of
1990. Throughout the course of the year between the submittal of the application and the
approval, there were numerous meetings between the applicant, their engineers and legal
counsel, the Historic Resources Advisory Board, various preservation groups, members of
the Planning Commission and Board, and the planning staff. Nearly all these meetings
centered around trying to reach a compromise between what the preservationists wanted set
aside and the developers interest in a profitable development.
The problem the County faced was that the property was located within the Urban
Development Area and was in no way "flagged" as being in any way significant. The existing
RA zoning present on the parcel at the time of the application would have allowed
development of five acre lots with no required open space. The developer ultimately agreed
to dedicate acreage to an agreed upon public agency or private organization, to place
appropriate screening and signage, to offer all of the land for sale at fair market value, to

delay any development of the parcel for one year, to phase the development so that the
most significant portion if the property would be developed last, and to accept any fair
market value offer on this portion of the property.
The process described above took a full year and involved innumerable hours of staff time
as well as the time of HRAB, Planning Commission and Board members. Some would
argue that the process was a failure and that the site was essentially "lost". The fact of the
matter is the County was caught in a very difficult position. It would have been a gamble
to turn down the rezoning and hope that the developer would not put the parcel in five acre
lots with no public access or land set aside. The county chose to negotiate the best deal we
could under the circumstances.
What the staff would like to propose is that we implement some method whereby properties
that are of undisputed historical significance are somehow marked so that a potential large
scale developer is put on notice that certain steps will need to be taken to protect the
historic aspects of a site if it is to be developed. This would be an effort to give the county
more leverage when it comes time to negotiate the terms of a rezoning or Master
Development Plan. We could adopt language that sets out the items that we would expect
to be addressed when planning a development on a "recognized" site.
This proposal is not intended to apply to small scale development such as family divisions,
small rural subdivisions or building permits. It is intended to focus on properties in and
around the UDA where the scale of permitted developments could completely eliminate
many historic sites.

HISTORIC PRESERVATION PROCEDURAL CHANGE AND
ADDITION TO THE FREDERICK COUNTY ZONING ORDINANCE
Presently the County's Zoning Ordinance states that the impact statement prepared as part
of a rezoning application should include "preservation of historic structures and sites located
on the land to be rezoned". Staff would suggest that this be expanded slightly to include a
discussion of the method(s) of preservation proposed. Also it would be appropriate that for
certain sites more detailed information be required including information on the treatment
of the historic aspects of the site.
This raises the issue of a list of locally significant sites. If the county chooses to develop
requirements that will apply to certain recognized sites, then perhaps we should publicize
a list of such sites. In this way when a developer purchases a property, he will be on notice
that the county feels the site, or some portion of it, is of some significance and that he will
be expected to address the preservation of that portion of the site. The HRAB has
compiled a list of roughly 150 sites with the aid of the Rural Landmarks Surveys that have
recently been completed for the County. These sites are those which the HRAB feels
possess some historical significance.
One possibility would be for this list to become part of the Comprehensive Plan. Another
approach might be to have an independent document to note the sites on our computer
mapping. Either way there are a number of issues to be addressed concerning whether or
not a property owner has some say in their property being placed on this list. One argument
would be that if the County deems the property to be significant, it is only fair to put the
owner (or future owners) on notice so that if and when they propose to rezone the property
or submit a Master Development Plan they will know that they will be expected to address

Another change that the staff is recommending is that our application process be modified
so that the HRAB be a regular review agency on Rezonings, Master Development Plans and
Site Plan applications that involve a historic site. This would mean that the applicant would
have to solicit comments from the HRAB on his\her application and submit these
comments as a part of the application package.

Proposed addition of section pertaining to recognized historically significant sites.
Historically significant Sites or Structures.
The intent of this section is to insure that private restrictions are
established in order to protect and preserve historically significant sites
and\or structures. The following requirements shall apply to all
development proposals affecting land which contains a site and\or
structure which has been recognized as historically significant by the
Frederick County Board of Supervisors or is listed on the State or
National Registers of Historic Places.
A harmonious placement and coordination of uses, architectural styles,
signs, and landscaping shall be provided to insure the aesthetic quality,
integrity and value of the historic site. Deed restrictions, dedications,
agreements, contracts, guarantees, or other means shall be instituted
to insure that such coordination occurs.
Buffering of noncompatible uses should be provided in such a way as
to minimize distraction from, and disruption of, the historic site or
structures present.
Deed restrictions, dedications, agreements, contracts, guarantees or
other means used to insure the above shall provide specific standards
and means for enforcement. The Historic Resources Advisory Board
shall review such methods and make a recommendation as to whether
they accomplish the intentions of this section. The Historic Resources
Advisory Board shall not control particular designs, styles or methods
used as long as the requirements of this Chapter have been met.
