H MEETING MINUTES OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board Room of the Old Frederick County Court House in Winchester, Virginia on February 19, 1992. PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman; Manual C. DeHaven, Stonewall District; S. Blaine Wilson, Shawnee District; John R. Marker, Back Creek District; Todd D. Shenk, Gainesboro District; George Romine, Shawnee District; Marjorie Copenhaver, Back Creek District; Roger Thomas, Opequon District; John H. Light, Stonewall District; Beverly Sherwood, Board Liaison and James Barnett, City Liaison. ABSENT Ronald W. Carper, Gainesboro District Planning_ Staff present were: Robert W. Watkins, Secretary; Kris C. Tierney, Deputy Planning Director; and W. Wayne Miller, Zoning Administrator. CALL TO ORDER Chairman Golladay called the meeting to order at 7:00 p.m. MEETING MINUTES -JANUARY 15 1992 Upon motion made by Mr. Romine and seconded by Mr. Thomas, the minutes of January 15, 1992 were unanimously approved as presented. 0 BIMONTHLY REPORT Chairman Golladay accepted the Bimonthly Report for the Commission's information. INTRODUCTION OF MR JOHN LIGHT, NEWLY APPOINTED REPRESENTATIVE FROM STONEWALL DISTRICT . Chairman Golladay introduced Mr. John Light, who was appointed as a new commission member representing the Stonewall District. Mr. Light's first term will be from 2/12/92 to 10/31/93. COMMITTEE REPORTS Comprehensive Plan - 2/10/92 Mtg, Mrs. Copenhaver reported that the Comprehensive Plan Subcommittee reviewed several requests to expand the sewer and water service area. The subcommittee also prioritized activities in their "Action Program". Winchester City Planning Commission Mr. Todd Shenk reported that the Leesburg Corridor Plan was discussed. Mr. Shroeder, Winchester City Planning Commissioner, said that the City is studying all the major avenues coming into the City --Valley Avenue, Route 11 North, Route 522 and Amherst Street --with the idea of having either a special exception to the approach or to having an approach overlay. Mr. Shroeder said that the City will do this comprehensively for the whole City and wishes to coordinate their efforts with Frederick County. 3 Sanitation Authority -2 j10/92 Mrs. Copenhaver reported on the following items: 1) The Northern Loop Waterline, established to increase water pressure and supply to the Fredericktowne/Albin Village /Lakeside area, should be in service this week. 2) A loan was received and engineering design commenced for the water treatment plant at the quarry. 3) Discussion was held regarding the two alternatives to the Parkins Mill expansion -- either pumping water over to the Opequon plant or expanding Parkins Mill. Mrs. Copenhaver expressed concern about future development of that land if the trunk line is run from the Parkins Mill Plant to the Opequon. She asked if the County could deny access to the sewer line. 4) Two other project priorities discussed for the County were the Fort Collier Industrial Park and water on Route 522 South from the airport to Southview Subdivision. Fort Collier Industrial Park is to be connected to the Stonewall Storage Tank. Historic Resources Advisory Board - 2/18/92 Mtg. Mr. Watkins said that the committee discussed the idea of recognizing significant historic sites with a plaque program. Economic Develo ment Commission Mr. Romine said that he met with the Transportation Committee and the Virginia Department of Transportation regarding several industries' concerns over road problems on Route 11 North. Mr. Romine said that VDOT now acknowledges that a problem exists and can address it. 11 SUBDIVISIONS Subdivision Application of Hershey Extension of Park Center Drive and Brooke Road in the Stonewall District. ACTION - APPROVED Mr. Miller said that Park Center Drive is located approximately 1,750' southeast of Route 11 North and Brooke Road is located approximately 1,350' northeast of the intersection with Fort Collier Road. He said that this application will be the final phase that will complete the two roads up to the boundary of the Hershey Foods property. This will be the limit of VDOT's acceptance and maintenance. Mr. Bruce Edens, with Greenway Engineering and Surveying Company, said that all requirements of VDOT have been met. Upon motion made by Mr. DeHaven and seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the Hershey Extension of Park Center Drive and Brooke Road. This property is located southeast of Route 11 North and northeast of the intersection with Fort Collier Road, in the Stonewall District, and is identified as GPIN 540000A0000810. Request for exemption from the Rural Land Use Regulations of the Frederick County Subdivision Ordinance by Fred Harner. ACTION - REFERRED TO DEVELOPMENT REVIEW AND REGULATIONS SUBCOMMITTEE Mr. Wayne Miller stated that by a letter dated February 5, 1992, Mr. Fred Hamer is requesting that he not be required to build a road to the tertiary state standards that are required by the Subdivision Ordinance, Page 18-4-14, Section 4-16-2.1. The road in question, Dove Drive, is located in section 5 of Lake Isaac Estates at Gore in the Back Creek District and is depicted on the submitted plat as the 60' right-of-way going from State Route 610 northwest to proposed lot 46 and then right to the Dove property to the north. Mr. Miller said that as the plat is presented, the applicant would only be responsible for the road that will serve lot 46, although the right-of-way and existing road serves as access to the Dove property to the north. Mr. Miller said that the staff does not feel that approval would have 5 significant impact on future situations of similar nature, but there may be facets that should receive -additional scrutiny. Mr. Miller felt that it may be in the best interest of all to have this request and future similar requests, sent to the Development Review and Regulations Subcommittee for recommendations. Mr. Fred Harner came forward and said that he was requesting exemption from building Dove Drive to State standards. Mr. Harner indicated that the Dove property is served by an existing 12' right-of-way. The Commissioners commented that Mr. Harners plat showed a 60' right- of-way going from Route 610 to Lot 46. They felt that if Mr. Harner did not intend to provide a 60' right-of-way to the Dove property, then the plat needs to indicate such. Mr. Miller pointed out that because Mr. Harner is subdividing lots 46 and 47, the right-of-way is considered a "shared private driveway" and must be a minimum of 50'. To avoid precedent setting for future requests of this nature, the Planning Commission felt that the Development Review and Regulations Subcommittee should review this request and present their recommendations before the Commission takes action. Upon motion made by Mr. Romine and seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously agree to refer this request to the Development Review and Regulations Subcommittee for their recommendation. Mr. Harner said that, because of the delay, he would withdraw this plat and submit a new plat without a right-of-way from Route 610 to lot 46. He said that he could access the lot from an existing subdivision. OTHER Discussion on Work Program for the Development Review and Regulations Subcommittee NO ACTION Mr. Watkins said that the Development Review and Regulations Subcommittee was formed to discuss all regulations related to Frederick County's rural r and urban areas. He said that they will accomplish this task through ordinance review, discussion of interpretations related to ordinance language, and plans review of certain development projects prior to public hearings. Mr. Watkins stated that the primary goal of the Development Review and Regulations Subcommittee in 1992 will be to execute a comprehensive review of the Frederick County Zoning Ordinance with particular emphasis on: Article II - C.U.P.'s 2-7 ( requirements and procedures) Article III - Buffer and Screening Requirements 3-12 (effectiveness) Article VI - Residential Planned Community District (R4) Article IX - Business and Industrial Zoning Districts 9-2 (allowed uses) 1992-1993 Capital Improvements Plan for Frederick County ACTION - APPROVED Mr. Watkins presented the 1992-1993 Capital Improvements Plan (CIP) for Frederick County. Mr. Watkins explained that this is a five-year plan for capital facilities within the County. He further explained that the plan comes before the Planning Commission because it needs to be tied in with the idea of comprehensive planning in the County. He said that the Planning Commission initially reviews the plan to insure that the development of facilities is in conformance with the planning ideas and processes in the County. The staff and the Commission reviewed and discussed the various projects within the plan. Mrs Sherwood inquired if the Senseny Elementary renovation included air conditioning and also if the renovation was being considered to be moved further back on the list. Mr. Watkins replied that the renovation did include air conditioning. He said that the School Board removed the boiler project, but felt the other projects were appropriate. Mrs. Sherwood said that the committee questioned funding for the library and although their project is ongoing, it was moved back another year. Mr. Watkins said that library representatives felt that decision was realistic. Mrs. Sherwood said that the committee felt the Parks and Recreation projects were appropriate. VA Mrs. Copenhaver commented that there were no requests from Fire and Rescue. Mr. Watkins said that they were contacted, but did not respond. Mr. Watkins felt it was the intention of the Fire and Rescue Department to develop a coordinated CIP for all Frederick County Fire and Rescue companies. Mr. Thomas suggested that possibly next year, the County could support the James Wood Swim Team by adding an indoor swimming pool to the CIP list. Mr. Thomas said that the pool could be utilized year-round by the swim team and the Parks and Recreation facility could also use the pool for sports and therapeutic exercises for the residents of the County. Upon motion made by Mr. Romine and seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously endorse the 1992-1993 Capital Improvements Plan for Frederick County as presented, with no changes in the project priorities. Installation of Monitoring Cells on Route 522 South NO ACTION Mr. Watkins said that this item is from the Transportation Committee and that they are sending it on to the Board of Supervisors. He said that the Committee endorsed a request by Shawnee District Supervisor W. Harrington Smith, Jr., to recommend that VDOT install monitoring cells along State Route 522 South and Interstate 66. This request was endorsed as a means to monitor truck traffic that bypass the weigh scales located on I-81. Mr. Watkins said that the Transportation Committee believes that the installation of monitoring cells will enable the VDOT to determine truck traffic patterns and assist with strategic planning. The Commission accepted this item as information. Resolutions of Appreciation for Rural Issues Subcommittee Citizen Members ACTION - APPROVAL Mr. Watkins presented Resolutions of Appreciation for the citizen members of the Rural Issues Subcommittee for their work in developing land use �-O regulations intended to preserve the rural nature of Frederick County. The resolutions honored Gary DeOms, James M. Douglas, Gerald Crowell and Robert Holmes. The Commission unanimously endorsed the resolutions. Page 2 Battlefield Partnership Master Development Plan County Engineer: Prior to road construction, we request copies of the detailed site plans, with corresponding road profiles, culvert inverts and ditch sections. We also request a copy of drainage calculations to verify adequacy of existing drainage structures. Planning and Zoning: The proposed Master Development Plan is being reviewed specifically for parcels owned by Battlefield Partnership (marked in yellow on your plans). Some lots in the vicinity of this development were previously owned by the applicant and have been subdivided, sold, and developed. The site currently includes Marathon Drive, Musket Drive, and Sulky Drive, water and sewer, fire protection, drainage easements, and existing facilities such as Marathon Bank, Donald B. Rice Tire Company, Stroehman Breads, and Snappy Lube. Two issues that are the basis for a required Master Development Plan are the proposed extension of Sulky Drive which will connect with U.S. Route 11 South, and the creation of a stormwater management pond that will serve the developed areas, as well as future development. Review agencies appear to be satisfied with this plan, provided that they receive additional information related to road and site drainage. Staff concerns regard the maintenance of the proposed stormwater management pond, as well as its location. With this area being owned by many individuals, staff believes it is prudent to require an acceptable maintenance agreement for this facility. The location of the proposed stormwater management pond will make it difficult to develop the western side of Sulky Drive, as the stormwater management pond and the twenty (20) foot drainage easement can not be encroached by development. Staff will require the applicant to address minor plan revisions prior to final plan approval. These items include total acreage of the area owned by Battlefield Partnership, zoning classification of property numbers 1 -Al, 1--A2, 2, 3, and 4, and administrative information.
