OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board Room of the Old Frederick County Court House in Winchester,
Virginia on March 4, 1992.
PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman;
Manual C. DeHaven, Stonewall District; S. Blaine Wilson, Shawnee
District; John R. Marker, Back Creek District; Todd D. Shenk,
Gainesboro District; Ronald W. Carper, Gainesboro District; George
Romine, Shawnee District; Marjorie Copenhaver, Back Creek District;
Roger Thomas, Opequon District; John H. Light, Stonewall District;
Beverly Sherwood, Board Liaison and David L. Schroeder, City Liaison.

CALL TO ORDER
Chairman Golladay called the meeting to order at 7:00p.m.
MEETING MINUTES - MARCH 4, 1992
The first order of business was the consideration of the minutes of
February 5, 1992. Upon motion made by Mr. Romine and seconded by Mr. Wilson, the
minutes of February 5, 1992 were unanimously approved as presented.
BIMONTHLY REPORTS
Chairman Golladay accepted the Bimonthly Report for the Comission's
information. m

COMMITTEE REPORTS
Transportation Committee - March 2 1992 Meeting
Mr. Thomas reported that the Transportation Committee received an
extensive presentation from George Pierce, Transportation Planner from VDOT, on the
Winchester Area Transportation Study (WATS). Mr. Thomas said that the study pointed
out deficiencies in the network and improvements needed for the next five to 30 years.
He felt the Winchester Area Transportation Study would be a useful tool for the
Planning Department when reviewing future rezonings & developments. Mr. Thomas
added that the Commission also reviewed the Primary Road Improvement Plan which
will be forwarded to the Planning Commission on March 18, 1992.
Route 37 T.A.C. C.A.C. - March 3 1992 Meeting
Mr. Watkins reported that the top three alternatives in the position paper
were proposed. One of these alternatives was modified to be closer to Route 7. The
segment was moved to parallel Red Bud Road to the north and skirt the identified
Battlefield area. Mr. Watkins said that a full scale public meeting with an open house
and forum is planned for April.
ANNUAL REVIEW OF CONDITIONAL USE PERMITS
Mr. Bise presented the current list of conditional use permits for the
Committee's review. Mr. Bise requested that the Committee inform the staff of any
inactive permits and/or any permits that need to be checked for compliance.
1992-1993 WORK PROGRAM FOR PLANNING & DEVELOPMENT
The Committee and staff reviewed and discussed the 1992-1993 Work
Program for the Department of Planning & Development.

DISCUSSION REGARDING THE STUDY OF THE IMPACT OF REZONINGS ON
CAPITAL FACILITIES
The Commission and staff discussed the computer model developed by the
firm of Hammer, Siler George and Associates which measures the financial impact of
rezonings on capital facilities (schools, parks and recreation, and fire and rescue). The
model provides a basis for applicants to determine what kinds of proffers to offer.
One of the main points of interest in the methodology was the issue of what happens to
school enrollment with the addition of a dwelling. An analysis done by the staff
concluded that increasing school enrollment must be explained by factors other than
residential construction alone. The staff used relationships between pupils per dwelling
and housing types to derive a table that described the increase in enrollment that can be
projected per new dwelling for each housing type.
Mr. Watkins said that the impact model will have to be updated each year with new
enrollment figures and new population figures.
It was the consensus of the Commission that the methodology and impact model
presented were appropriate for use in determining the financial impacts on capital
facilities resulting from rezonings. A motion was made by Mr. Romine, seconded by Mr.
Thomas and unanimously passed to endorse the methodology and impact model and to
forward the information to the Board of Supervisors.
ADJOURNMENT
No further business remained to be discussed and the Commission
adjourned at 8:00 pm.

The accompanying plat represents a subdivision of a portion
of the land conveyed to Fort Collier Group L.C. by deed dated
September 18, 1991 and recorded among the land records of
Frederick County, Virginia in Deed Book 766 at Page 73.
The said parcel frosts the northwestern side of Brooke Road,
approximately 1416' northeast of its intersection with Fort
Collier Road in Stonewall District, Frederick County, Virginia and
is bounded as follows:
Beginning at an iron pin found corner to an 82.136 acre
parcel (under contract for purchase by Hershey Foods Corp) and in
the northwestern boundary of the cul-de-sac of Brooke Road; thence
with Brooke Road R/W along the arc of a curve to the left 84.67'
(Radius = 60.00' - Chord = S61°04'59"W - 77.82') to an iron pin
set corner to the Retained Portion; thence with new division lines
for the following three courses: the arc of a curve to the left
46.69' (Radius = 40.00' - Chord = N12047110"W - 44.09'); thence
N46013'37"W -334.02' to an iron pin set; thence S43046' 23"W -
519.98' to an iron pin set in the line of Lot 25C; thence with
said lot line N46°13'49"W - 371.98' to an iron pin found in the
center of an existing 20' sanitary sewer easement, corner to the
Retained Portion; thence with new division lines and the center of

Virginia Dept. of Trans ortation: No objection to conditional
use permit for this property. Existing entrance is adequate
for proposed use. However, should use ever expand in the
future, the entrance may have to be upgraded to VDOT minimum
commercial standards.
Fire Marshal: Approved. Possible use of combustible cutting
oils in tooling operations. Compliance with Virginia Fire
Prevention Code for storage of oil will be necessary. Other
than use of cutting oils in operation, this business will not
create any abnormal fire fighting hazards

Facilities. Permit required would be a change of use on the
existing building.
Health Department: Health Department has no objection to
proposal for no increased water usage (no outside employees).
Planning & Zoning: This application is for the establishment
of a Tool and Die Shop, which falls under the definition of
Cottage Occupation and is permitted in the Rural Areas Zoning
District. This use will not impact the existing character and
pattern of land use in the area. However, -the property is
currently in violation of the Zoning Ordinance for
approximately twelve inoperable vehicles and trash, junk or
other debris.
Adequate parking currently exists for approximately four
vehicles. The staff will request that the applicant address
the issues of vehicular traffic associated with this use at
the public hearing.

Health De artment: Kennel to be limited to 20 dogs. The
Health Dept. has no objection to the use of said property for
a kennel. Dog waste is considered "industrial waste", and the
State Water Control Board is responsible for this. Have
referred Keeler's to SWCB Valley Regional office in
Bridgewater.
Planning Department: This application is for an existing
kennel operation that was unknowingly operating illegally on
Senseny Road in the Residential Performance District. The
applicant is proposing to move the kennel operation to her
mother's property located in the Rural Areas District. This
move would not change the character and established pattern of
development in the area. There is a vacant, pre-existing
kennel facility on the property that is a substantial distance
away (in excess of 100 yards) from surrounding properties,
adequately shielding them both from sight and noise.
This is a small kennel with approximately 12 dogs. The
existing driveway area provides adequate parking for three to
four vehicles. Since overnight boarding of dogs is not
proposed and since the site is well buffered from adjoining
properties, noise is not expected to be a problem. The
operation will mainly be for the raising and sale of dogs and
for grooming.
STAFF RECOMMENDATIONS FOR APRIL 1, 1992: Approval with the
following conditions:
1. Any change in use shall require a new conditional use
permit.
2. All materials and equipment associated with this business
will be kept indoors.
3. No more that one sign shall be allowed, and it shall be
limited to eight square feet.
4. All dogs will be locked inside by 9:00 p.m.
5. No structures shall be expanded to contain the use nor
new structures constructed for the use unless a revised

Attached is a letter from Eugene Johnston requesting an informal discussion regarding his
desire to rezone a parcel of land adjacent to the east side of Route 81 just south of the
Middletown interchange from RA to 133.
Mr. Johnston is interested in placing a building on the property to house and/or maintain
a small number of tractor trailers which he owns and leases out.
