E. PLANNING AND DEVELOPMENT - ACTIVITY REPORT #36
1. Route 37
On June 28 and 29, Kris met and/or spoke with a number
individuals concerning the status and proposed routing of Route 37.
Inquires were prompted by the article in Saturday's Winchester
Star.
Bob Watkins discussed the Route 37 project and Route 11
North improvements with Donn Besselvievre of Cives Steel Company.
2. ISTEA
On June 16, Evan Wyatt met with representatives of the
School Board and the Parks & Recreation Department to continue work
on the ISTEA Transportation Enhancement proposal.
On June 21, Evan presented the ISTEA Enhancement proposal
to the Frederick County School Building & Grounds Committee and the
Frederick County School Board.
On June 23, presented the ISTEA Transportation
Enhancement proposal to the Winchester/Frederick County Bicycle
Committee.
On June 25, Evan met with Stan Hough to provide
information for a story in the Wednesday Edition regarding the
ISTEA Transportation Enhancement proposal.
3. Comprehensive Plans and Programs Committee (CP&PS)/
Corridor Studies
On June 25, Kris Tierney was interviewed by Phil Luttrell
of WAZT channel 25 in Hagerstown concerning the County's corridor
studies. The interview aired Friday, June 25, on the 5:30
newscast.
Ron Lilley reported that the Chamber of Commerce and the
Corridor Appearance Task Force developed a script and corresponding
images for the video of the Task Force report. Tentative
arrangements have been made for a Joint Work Session of the City
and County Planning Commissions on corridors for August 23.
4. Stephens City/Frederick County Joint Planning Group
In conjunction with the Comprehensive Plan Subcommittee,
arrangements for a July 26 public meeting on the planning for the
Route 11 corridor have been made. Maps and information are being
prepared for that meeting.
5. Development Review & Re lations Subcommittee DR&RS
Evan Wyatt reported that the DR&RS met on June 22 and
began the first of a series of discussions regarding allowable
density in the RP Residential Performance District; they
recommended an amendment to the RA Rural Area Zoning District to
remove items pertaining to one time divisions of land; and they
discussed ideas to enforce the protection of environmentally
sensitive land.
6. Historic Resources
Extra copies of the Rural Landmarks Survey presentation
have been made. The County school system agreed to use the
presentation in history/social studies classes. A mailing to
civic/social groups has been prepared to offer the presentation as
an educational program for group meetings.
The design for the historic plaque was refined somewhat
and should be brought to the Board of Supervisors for final
approval in August.
Arrangements are being made for an informational meeting
for owners of historic properties about the State and National
Registers, to be held in September.
7. Plan Reviews and Site Inspections
Kris Tierney conducted the following:
On June 16, met with Chuck Maddox and Bob Watkins to
discuss possible transportation improvements in the area of Valley
Mill Road and Route 7. Mr. Maddox is preparing a proposal to take
to the Planning Commission and Board of Supervisors regarding the
pending MDP for the Hillsdale Estates Townhouse Development.
Met with Bob Watkins and an adjoining property owner of
the Hillsdale Estates MDP to discuss traffic concerns and answer
questions regarding the proposal.
On June 17, met with Susan Armentrout of the Unimin
Corporation to discuss their forthcoming rezoning application to
rezone 211 acres adjoining their existing mining operation at Gore
from RA to EM.
Egan Wyatt conducted the following:
On June 17, met with representatives of Miller Milling to
discuss final site plan requirements.
On June 30, approved the revised Miller Milling site
plan. This site is located in the Fort Collier Industrial Park in
the Stonewall District.
On June 18, reviewed a master development plan for
Greenwood Realty Partnership for 88 single family dwellings. This
site is located along the east side of Greenwood Road (Rt. 656) in
the Stonewall District.
On June 22, met with representatives of Snappy Lube to
discuss site plan requirements for a three bay addition to the
existing site along Valley Pike (Rt. 11S).
On June 23, met with the developer for Lakeside Condos
and representatives of Parks and Rec to review recreational
requirements for that subdivision.
On June 23, met with Tim Painter to discuss site plan
requirements for self service storage facilities and for an
addition to Hilltop House.
On June 24, met with John Lewis to discuss site plan
requirements for an automobile sales and repair facility proposed
to be located along Welltown Road (Rt. 661) in the Gainesboro
District.
On June 28, approved a site plan for Mountain View Church
of Christ for a mobile classroom unit. This site is located along
Valley Pike (Rt. 11S) in the Back Creek District.
On June 29, met with representatives of the First
National Bank of Strasburg to discuss site plan requirements.
8. Alternate Wastewater Treatment
On June 22, the Technical Advisory Committee overseeing
the study of alternate wastewater treatment potential for rural
community centers received a draft report from the consultants.
The committee members have been asked to get their comments on the
draft to Kris ASAP so that they can be conveyed to the consultant.
We hope to have the final report to the Planning Commission some
time in late July or early August.
9. BZA
The Board of Zoning Appeals adopted bylaws in June.
10. Virginia Growth Strategies Act
Bob Watkins attended the Lord Fairfax Planning District
Commission's Executive Committee meeting and Commission meeting.
Del. Tayloe Murphy, Jr. addressed the Commission on the Virginia
Growth Strategies Act.
11. Other
On June 26, Kris Tierney, Ron Lilley, Lanny Bise, Sam
Russell from the Real Estate Office, and Chris Cotterel with Parks
and Recreation, represented Frederick County in the Loudoun Street
Mile and won the Mayor's Challenge Cup.
Ron Lilley attended a seminar on Fiscal Impact Analysis
which provided information about the fiscal impacts of various
types of development.
On June 25, Evan Wyatt, Denice Cather, and Renee' Arlotta
participated in the County CPR training class.

Inspections Dept.: Building shall comply with the Virginia
Uniform Statewide Building Code and Section 309, Use Group R
(Residential) of the BOCA National Building Code/1990.
City of Winchester: Utilities - no comments. Planning - no
comments.
Planning & Zoning: There is no master development plan for
this property and considering the size of the site (8.469
acres,2 lots), staff recommends waiver of this requirement.
This site adjoins B-2 zoned property to the south, I-81 to the
east and M-1 zoned property to the north. A category "B"
buffer will be required against the B-2 property. Since
Welltown Pike (Route 661) is classified as a collector by the
comprehensive plan, the front setback need only be 35' vice
the 50' depicted on the plats. The plats provided have been
modified to reflect the changes addressed by VDOT in their
comments. The same issue was addressed by the County Engineer
and has been corrected. The comments of the Fire Marshall
have been addressed with the Sanitation Authority. Mr.
Wellington Jones advised on July 6, 1993, that it is possible
to extend the water line that is located along the west side
of Welltown Pike on to this site to accommodate both domestic
service and for fire protection. The Fire Marshall advises
that he will require fire hydrants on the property for
development. Since the water will need to be extended onto
the sight for fire protection service, it would seem that
utilization of the domestic service would be appropriate. The
Sanitation Authority meters can be read by the City of
Winchester to make sewer charge determination since they will
be providing the sewer service. A deed of dedication for the
street and appropriate bonding will need to be submitted prior
to final plat approval. This application will go to the Board
of Supervisors following Planning Commission recommendation.

We have reviewed and are returning the referenced project's subdivision plat due to the emission
of the drainage and detention pond easements on Sheets 2 & 3 of 3. Also, the center line curve
of Mercedes Court does not appear to meet what was approved on the site plan. Has there been
some design change that we are unaware or We have marked our comments on one set of the
plats in red.
Once the above items have been addressed, please resubmit the plats for our signature. Should

Mr. Chairman and Commission Members,
I am writing this in regards to Negleyland which is now to
the subdivision and site plan phase of development. When i first
commented on this site on February 19, 1992, I addressed the
concerns or" fire protection on the site. At that time I was
informed that the city water main was over 800' from the property
and extending it would be cost prohibitive for the owners. I
agreed.
After several conversations with the owner and Mr. Lewis, I
have learned that the problem with water to this site lies with
some rule, code, or policy out there "somewhere."
Sewage to this site is in a privately owned forced main,
serviced by the City of Winchester. Mr. Negley has purchased
rights to this forced main and I'm told there is adequate
capacity for his development.
There is a water main running along the west side of Rt. 661
in front of the subject property, but it is owned by F.C.S.A.
The water main becomes City owned at Rt. 661 and Rt. 11. Herein
the problem. I'm told that the development cannot be serviced by
water from one locality and sewer from another.
At this time the owner is planning to install wells for
their domestic water which would have meters installed. The City
will read these meters to determine the gallonage of sewer for
which to bill the occupants. This arrangement gives us no fire
protection on this site whatsoever.
I have asked why the County cannot provide water service,
including hydrants, to this site and bill for water usage only?
And if the City can read meters installed on wells to determine
sewage flow, why can't they read the meters installed on the
County water service for the same purpose?

One proposed occupant for this property is planning to
construct a Auto Body Repair Facility which is required to have
automatic sprinkler protection or equivalent. Wells will not be
able to satisfy this requirement so an expensive alternative will
have to be considered.
I realize this arrangement between the City and County
Utilities Authorities would be very unique but I am requesting it
in order to provide the best level of fire protection to the
site. Availability of hydrants is essential to the fire - life
safety of the occupants and the fire ground safety of our
firefighters.
If you have any questions concerning this issue, please do
not hesitate to call me. I can be available for any meeting you
may request.

The final plat submitted by Furstenau Surveying appears to be
different from the site plan prepared by Lewis and Associates dated
January 1992. The plat .indicates a cul-de-sac named Mercedes Court;
whereas, the previous site plan reflects three (3) proposed buildings
and a stormwater detention pond.
Before we will grant our approval for the final plat, we need an
explanation for the change. If the final plat reflects the actual
plan of development, we will expect a revised stormwater management
plan for the entire site. Any drainage easements required for this
revised plan shall be reflected on the final plat.

With regard to your letter of June 28, 1993, concerning fire protection at Negleyland on Route
661 north of its intersection with Route 11, I submit the following:
1) Traditionally, the City of Winchester and Frederick County Sanitation Authority will
not provide sewer service to customers without water service unless water service is not
available. There are several customers which the Sanitation Authority provides sewer
service and the City of Winchester provides water service. If the City of Winchester will
allow the developer to be served by metered wells, then it seems logical they will allow a
metered water service from the Sanitation Authority.
2) Regardless of the arrangements for domestic water and sewer service, the developer
may extend water lines to provide fire protection. At that location, the Sanitation
Authority's water system has more reliability and capacity for fire protection than the City
of Winchester's system. Therefore, from a fire protection viewpoint, fire protection
service from the Sanitation Authority's system should be preferred.
In surlmaq, if fire protection is needed at this site, the Authority has facilities available to
provide that service.

Attached is a letter from Charles Pinto, with the American Garage Company, requesting an
informal discussion with the Commission concerning a possible rezoning application. The
property involved is just over nine acres and is located at the northeast corner of the Route 50
East (Millwood Pike), Route 644 (Parkins Mill Road) intersection. The property is currently
zoned RA, Mr. Pinto is interested in pursuing B-2 zoning in order to establish a wholesale
lumberyard.
The 23 acre Oakcrest parcel which was rezoned from RA to B-2 in 1989 is located across the
street from the property in question. Both parcels are well outside of both the Urban
Development Area and the Sewer and Water Service Area.

We appreciate the request you have made concerning impact fees. In Frederick County we have
put in place a system under which cash will be received from landowners requesting changes in
zoning to allow new development. Basically, this system will evaluate the impacts of such
rezonings on the cost of schools, parks, and emergency services. Rezoning applicants will be
expected to address these impacts by providing cash in amounts reasonably related to the impacts.
However, impact fees as such are not allowed under Virginia law. In order to have impact fees
that apply to development not involving a rezoning, the Virginia General Assembly would have
to pass laws allowing us to have impact fees. You may want to present your ideas to your
representatives in the General Assembly.
We will forward your ideas and petition to the Frederick County Planning Commission. The
Planning Commission is the local „group charged with considering these types of issues. Our
staff will notify you when the petition is to be presented to the Planning Commission.
We greatly appreciate your concerns and ideas.

',Ve the undersigned do strongly suggest that the Frederick County
Board of Supervisors impose a developers impact fee3to pay the bulk of the
costs incurred by unbridled development. It is , also , recommended that
new residents to the county pay the remainder of these extra expenses.
Senior citizens on fixed incomes, who are longtime home owners of this
county, should be exempt from all new development costs, such as new
schools, sewer systems, roads, and extra police.
