FOR REVIEW FROM CITY OF WINCHESTER None E. PLANNING AND DEVELOPMENT - ACTIVITY REPORT 130 1. Corridor Appearance Ron Lilley has substantially completed illustrating the recommendations of the Chamber of Commerce Corridor Appearance Task Force. The illustrations will be part of the final report of the task force, which is to be presented to the Board within the next couple of months. 2. Transportation Evan Wyatt participated in the Staunton District Commonwealth Transportation Board Preallocation meeting on March 23. The purpose of the meeting was to present the Frederick County Primary Road Improvement Plan to the State. 3. Winchester/Frederick County__Joint Transportation Committee Ron Lilley met with the Winchester/Frederick County Joint Transportation Committee on March 29 and exchanged information on a variety of issues, including potential ISTEA-funded projects and the WATS status. 4. ISTEA On March 26, Evan Wyatt met with Winchester City Planning Director, Tim Youmans, to discuss potential city/county projects that would qualify under the ISTEA Enhancement Program. 5. House Numberin 911 S stem Staff is continuing with the update of the House Numbering Project through the use of ACAD11, dBase IV, and general inquiry. 6. Site PlansfInspections Lanny Bise is continuing to work with G. W. Clifford & Associates on the Blue Ridge Industries Site Plan. Evan Wyatt conducted the following site plan inspections: On March 25, conducted a site inspection at the former Western Steer site on Route 522 North (North Frederick Pike). On March 26, conducted a site inspection at the Liberty Baptist site, located on the south side of Route 277 (Fairfax Pike). On March 26, conducted a site inspection at the Lakeside Condominium site, located on the west side of Chinkapin Drive in Lakeside. On March 30, Evan Wyatt met with geologist Monica Gorman to discuss environmental impact issues on various sites along the Route 11 South corridor. 7. Prince Frederick Office Park On March 23, Bob Watkins and Evan Wyatt met with representatives of the Prince Frederick Office Park and VDOT to discuss requirements related to site access, road networking, and storm water management. 8. Civil War Heritage„& Tourism Mark Lemasters and Ron Lilley began production of a map of Civil War -related sites in support of the Planning District Commission's efforts on Civil War heritage and tourism. 9. Historic Resources The Historic Resources Advisory Board (HRAB) has scheduled a meeting to review their direction and priorities based on the February joint work session. The design contest for the historic plaque is underway and submissions are being steadily received. 10. Stephens-City/Frederick County Joint Plannina Grou The staff is continuing to develop base information for this group to consider for land use planning. The staff is also continuing to work on mutually -agreeable boundary adjustments with Stephens City. 11. Industrial Uses/Districts On March 22, Evan Wyatt, W. Wayne Miller, EDC's June Wilmot and George Romine met with Douglas Toan and Tom Gilpin to discuss performance standards for truck or fleet maintenance facilities in the M-1 (Light Industrial) District. 12. Rail Corridors Lanny Bise is continuing to refine data on rail corridors for the Comprehensive Plan Subcommittee. 13. Rural Community Center Sewer Study Lanny Bise has been working on base maps for the Rural Community Center Sewer Study on Autocad. 14. Professional Development On March 23, Kris Tierney led a Planning Seminar for the Planning Department staff on how to prepare for and run better public meetings. These one hour sessions are held monthly in the planning office conference room on a relevant topic. The sessions are led by alternate members of the planning staff who are responsible for picking the topic. This session included various tips taken from the book "Successful Public Meetings; A Practical Guide to Managers in Government" and an article From "Urban Land" which offered tips to applicants on preparing for approval hearings. The book "Successful Public Meetings" contains information on use of visual aids, structures of various meeting formats, preparing for meetings, conducting meetings, fielding hostile questions, and dealing with the press. 15. VAZO Conference Ron Lilley attended the Virginia Association of Zoning Officials Conference (VAZO) for two days and received training and professional development on zoning issues. 16. Other Lanny Bise began revisions to the rezoning application form used by the Planning Department. P/C Review Date: 04/21/93 SITE PLAN 011-93 FCSA - 642 ELEVATED WATER STORAGE TANK LOCATION: East and adjacent to State Route 642, approximately 1/2 mile south of Kernstown/I-81 Exit MAGISTERIAL DISTRICT: Shawnee PROPERTY ID NUMBER 75-1-A PROPERTY ZONING & PRESENT USE: Zoned B-2 (Business, General) and RA (Rural Area), land use - vacant ADJOINING PROPERTY ZONING & PRESENT USE• Zoned B-2 (Business, General) and RA (Rural Areas), land use - vacant PROPOSED USE: Elevated water storage tank REVIEW EVALUATIONS: Vingi_nia_ Department of Transportation• See attached letter from Robert Childress, dated April 6, 1993. Inspections Department: Tank shall comply with the Virginia Uniform Statewide Building Code and Section 311. Use Group U (Utility and Miscellaneous) of the BOCA National Building Code/1990. Fire Marshal: Driveway in area of tank must be 20' in width to facilitate ladder truck. Engineer/Director Wellington Jones informed me on 3/22/93 that area around tank base will be parking lot. I informed him that we'll need compaction to support 70,000 lb. apparatus. Access for emergency vehicles must be maintained at all times during construction. Sanitation Authority: Approved Regional Airport: See attached comments from Kenneth Wiegand, dated February 25, 1993. County Engineer: The E & S plan and stormwater management considerations are approved as submitted. We recommend that the emergency overflow pipe, 12" RCP, be relocated slightly to divert flow toward the natural drainage swale rather than toward the existing driveway. Planning Department: The 1/2 to one (1) million gallon elevated water storage tank is intended to maintain system pressure within the northern loop service area. This facility will utilize the Stephens City limestone quarries as its source. The Planning Commission previously determined that the location of this facility was preferable. The proposed elevated water storage tank is a permitted use on property zoned B-2 and RA. The height of this structure will be 181 feet. This type of structure is exempt from the maximum height requirements specified in the zoning ordinance. Staff has no specific concerns with the proposed site plan. It should be noted that the future development of office and support facilities may require buffers and screening along the Stossel property. Wyatt, Planner II \ RE: Corridor H Discussion DATE: April 8, 1993 The Frederick County Transportation Committee discussed the proposed Corridor H project during their meetings in March and April. These discussions were intended to provide the committee with all available information from the Corridor Selection Supplemental Draft Environmental Impact Statement, and to convey all concerns to the Virginia Department of Transportation (VDOT). The concerns of the Transportation Committee regard traffic impacts, land use impacts, cost, and the funding source. The committee believes that these concerns need to be addressed prior to a final corridor selection by VDOT. The West Virginia Department of Transportation (WVDOT) has stated that the Route 55 corridor is the most desirable connection for West Virginia. This route is currently being studied by VDOT to determine potential impacts to commercial and residential land use, historical sites, and environmentally sensitive areas. VDOT is also studying a possible connection with the I-66 interchange. Staff will attend a meeting on April 14, 1993 in Richmond regarding Corridor H. The purpose of this meeting is to address concerns regarding impacts and cost. VDOT will make a final determination regarding Corridor H on May 20, 1993. Included in your agenda is a summary regarding Corridor H, and graphic information. Staff will report on additional information received during the meeting in Richmond. Staff will ask that the Planning Commission provide a recommendation to the Board of Supervisors. The Board of Supervisors will create a resolution regarding Frederick County's position on Corridor H. 9 North Loudoun Street P.O. Box 601 Winchester, VA 22601 Winchester, VA 2260 CORRIDOR H PROJECT SUMMARY Corridor H is one of the economic growth highways designated by Congress to serve the Appalachian Region. This corridor is one of many that has been proposed to serve an area from northern Mississippi to southern New York. Each corridor has been assigned an alphabetic distinction. For the purposes of this discussion, we will focus on Corridor H. Corridor H is defined as a limited access highway. This road segment is proposed to provide an east to west connection that will begin just west of Elkins, West Virginia, and will tie into Interstate 81. The two road segments in Frederick County that are being considered as part of Corridor H are Route 50 West and Route 55. Route 50 West is a four (4) lane primary arterial highway that decreases to a two (2) lane arterial approximately one (1) mile before the West Virginia line. Corridor H is proposed to be a four (4) lane limited access highway. If the Route 50 West corridor is selected, it would require VDOT to construct additional road right-of-way. Traffic utilizing this route would have to access Route 37 near the Winchester Medical Center, and then proceed north to the I -81/11N/37/661 interchange area, or south to the I -81/11S/37/642 interchange area to access Interstate 81. This would increase vehicular and commercial truck traffic around the City of Winchester, and around interchange areas that serve commercial, industrial and residential uses. Route 55 is a two (2) lane minor arterial highway. This road segment traverses Frederick County from the George Washington National Forest to Cedar Creek. If this road segment is selected, it would require VDOT construct an additional two (2) lane highway throughout this entire segment. The proposed connection with Interstate 81 would be approximately two (2) miles south of the I -66/I-81 interchange area. VDOT is studying a possible connection with the 1-66 interchange area. If this is determined to be desirable by VDOT, the 1-66 interchange area will probably be relocated. The City of Winchester's water main is located approximately 1/2 mile east of the 1-66/I-81 interchange area. Water and sewer could have a significant impact on development around this interchange area. Development in this area could have an impact on the Middletown area. Corridor H is desirable from a transit standpoint. This corridor would provide a direct east to west corridor that is achieved today by accessing I-70, approximately 40 miles north of Winchester, or I-64, approximately 100 miles south of Winchester. Virginia's Inland Port would benefit from this corridor. This corridor could have an impact on the Winchester/Frederick County area as a distribution area. Questions regarding impacts to the current State Highway Plan, impacts to the Staunton District Highway Fiscal Plan, and traffic, land use, and environmental impacts are being assessed by VDOT. It is important to understand these issues, as well as impacts to transit, labor supply, commerce, business attraction, and tourism for the Winchester/Frederick County area prior to providing a recommendation to the Board of Supervisors. "...make rules for the administration of its affairs..." "...prescribe rules pertaining to its investigations and hearings..." Therefore, it is the opinion of the staff that the Planning Commission has the authority to adopt bylaws. The staff has taken the liberty to draft some possible bylaws. These are not intended to make significant changes in procedures, but are instead intended to clarify and document existing procedures. Please find attached draft bylaws for discussion. Box 601 Winchcstcr, VA 22601 Winchcster, VA 226W BYLAWS County of Frederick, Virginia Planning Commission ARTICLE I - AUTHORIZATION 1-1 The Frederick County Planning Commission is established by and in conformance with Chapter 21 of the Code of Frederick County, and in accordance with the provisions of Section 15.1-427.1, Code of Virginia (1950), as amended. 1-2 The official title of this body shall be the Frederick County Planning Commission, hereinafter referred to as the "Commission." ARTICLE II - PURPOSE 2-1 The primary purpose of the Commission is to advise the Frederick County Board of Supervisors and to carry out all duties and functions described by the Code of Virginia, as amended. ARTICLE III - MEMBERSHIP 3-1 The membership of the Commission shall be determined by the Frederick County Board of Supervisors as specified in Chapter 21 of the Code of Frederick County. Methods of appointment and terms of office shall be determined by Chapter 21 of the Code of Frederick County. ARTICLE IV - OFFICERS 4-1 Officers of the Commission shall consist of a chairman, vice-chairman and secretary. The chairman and vice-chairman must be members of the Commission. The secretary shall be a member of the commission or a county employee. 4-2 Selection 4-2-1 The Officers shall be elected by the members of the Commission at the first meeting of the calendar year. 4-2-2 Nomination of officers shall be made from the floor at the first meeting of the calendar year. Election of officers shall follow immediately. A candidate receiving a majority vote of the entire 1 membership shall be declared elected. 4-3 Duties 4-3-1 The Chairman shall: 4-3-1-1 Preside at meetings. 4-3-1-2 Appoint committee members. 4-3-1-3 Rule on procedural questions. A ruling on a procedural question by the Chairman shall be subject to reversal by a two- thirds majority vote of the members present. 4-3-1-4 Report official communications. 4-3-1-5 Certify official documents involving the authority of the Commission. 4-3-1-6 Certify minutes as true and correct copies. 4-3-1-7 Carry out other duties as assigned by the Commission. 4-3-2 The Vice -Chairman shall: 4-3-2-1 Assume the full powers of the chairman in the absence or inability of the chairman to act. 4-3-2-2 Carry out other duties as assigned by the Commission. 4-3-3 The Secretary shall: 4-3-3-1 Ensure that attendance of Commission members is recorded at all meetings. 4-3-3-2 Ensure that the minutes of all Commission meetings are recorded. 4-3-3-3 Notify members of all meetings. 4-3-3-4 Prepare agendas for all meetings. 4-3-3-5 Maintain files of all official Commission records and reports. 2 4-3-3-6 Give notice of all Commission meetings, public hearings and public meetings, as required by the _Code of Virginia, as amended. 4-3-3-7 Provide to the Board of Supervisors reports and recommendations of the Commission. 4-3-3-8 Attend to the correspondence necessary for the execution of the duties and functions of the Commission. 4-3-4 Term of Office - Officers shall be elected for a one year term or until a successor takes office. Vacancies shall be filled for an unexpired term by a majority vote of the Commission. In such cases, the newly elected officer shall serve only until the end of the calendar year or until a successor takes office. 4-3-5 Temporary Chairman - In the event of the absence of both the Chairman and the Vice -Chairman from any meeting, the Commission shall designate from among its members a temporary chairman who shall act for that meeting in the absence of the Chairman or Vice - Chairman. ARTICLE V - COMMITTEES 5-1 The Commission shall establish committees necessary to accomplish its purpose. 5-2 In establishing committees, the Commission shall describe the purpose, membership, and terms of office for each committee. 5-3 Members of the committees shall be appointed by the Chairman. The Chairman may request recommendations from Commission or committee members on committee appointments. 5-4 Members of the committees may be Commission members, employees of the County, or citizen volunteers. 5-5 The Chairman and Vice -Chairman shall be ex -officio members of every committee. 5-6 Each committee shall establish its own operating rules. ARTICLE VI - MEETINGS 6-1 Regular meetings shall be held at the time and place set by the Commission at the first meeting of each calendar year. 3 6-2 Special meetings may be called by the Chairman, any two members, or the Secretary, and held after due notice and publication by the Secretary. 6-3 Notice of all meetings, and a copy of the agenda, shall be sent by the Secretary to all members at least five days before the meeting. 6-4 All meetings of the Commission shall be open to the public except for executive sessions as allowed by the Code of Virginia, as amended. 6-5 The Planning Commission may hold an executive session only according to the requirements of and for the purposes described by the Code of Virginia, as amended. 6-6 Worksessions shall be held, as necessary, at the adjournment of regular meetings or at the time and place set by the Commission at the first meeting of each calendar year, or at a special meeting. Notice for worksessions shall be the same as for regular meetings. 6-7 Scheduled meetings may be cancelled by the Chairman or Secretary if there is no business to consider. ARTICLE VII - VOTING '11ko' i 7-1 A majority of members shall constitute a quorum. No action shall be taken or motion made unless a quorum is present. 7-2 No action of the Commission shall be valid unless authorized by a majority vote of those present and voting. ARTICLE VIII - OPERATING RULES 8-1 Order of Business 8-1-1 Call to Order 8-1-2 Consideration of Minutes 8-1-3 Secretary's Report 8-1-4 Committee Reports 8-1-5 Citizen Comments on Items not on the Agenda 8-1-6 Unfinished Business 0 8-1-7 New Business 8-1-8 Adjournment 8-2 Minutes - The Commission shall keep minutes of each meeting, and on adoption by the Commission, these minutes shall become a public record. The Chairman and Secretary shall sign all minutes certifying that they are true and correct. 8-3 Procedures 8-3-1 Parliamentary procedure at Commission meetings shall be governed by Robert's Rules of Order, except where otherwise specified in these procedures. 8-3-2 Whenever an agenda item requires a recommendation to the Board of %J a! Supervisors, the Commission shall continue to consider the item until a definite recommendation is made. If a motion has been made and defeated, alternate motions shall be made concerning the item under consideration. 8-3-3 Business items on the agenda shall be considered using the following procedures: 8-3-3-1 Report by the Secretary, County Staff or Commission Members 8-3-3-2 Presentation by Applicant or Representative 8-3-3-3 Citizen Comment 8-3-3-4 Rebuttal by Applicant 8-3-3-5 Discussion by Commission 8-3-3-6 Motion, discussion and vote by Commission 8-3-4 Public comment shall be allowed in all cases required by the Code of Virginia or the Code of Frederick County. In other cases, the Chairman may allow public comment. 8-3-5 The Commission members may ask questions for clarification and information after the staff report, applicant presentation or citizen comment. 5 8-3-6 Petitions, displays, documents or correspondence presented at a meeting may be made part of the official record of the meeting by motion of the Commission, to be kept on file by the Secretary. Such items need not be made part of the published minutes. 8-3-7 Public Hearings 8-3-7-1 The Commission shall hold public hearings on all items for which hearings are required by the Code of Virginia or by the Code of Frederick County. Such public hearings shall be advertised and notifications provided as required by the Code of Virginia. 8-3-7-2 The Chairman may establish special rules for any public hearing at the beginning of said hearing. These rules may include limitations on the time of staff report, applicant presentation and citizen comment. 8-3-7-3 In addition to those required by law, the Commission may hold public hearings on any matter which it deems to be in the public interest. In such cases, the public hearings shall follow all procedures described for public hearing in these bylaws. 8-3-8 Master Development Plans - Master development plans shall be considered by the Commission according to the following procedures: 8-3-8-1 Presentation by Applicant 8-3-8-2 Report by the Secretary, County Staff or Commission Members 8-3-8-3 Citizen Comment 8-3-8-4 Rebuttal by Applicant 8-3-8-5 Discussion by Commission 8-3-8-6 Motion, discussion and vote by Commission 8-3-9 Tabling 8-3-9-1 Agenda items may be laid on the table by the Commission. In such cases, such items should be tabled C. for a specific period of time, to be put back on the agenda at a particular scheduled meeting. 8-3-9-2 The Commission shall table items for which insufficient information has been provided or for which the rules of the Code of Virginia or the Code of Frederick County have not been met. 8-3-10 Worksessions 8-3-10-1 The Commission may hold worksessions at which the procedural rules of these bylaws shall not apply. 8-3-10-2 Worksessions shall be held after the adjournment of regular meetings or at times scheduled by the Commission for worksessions. 8-3-10-3 Notice of worksessions shall be sent to Planning Commissioners at least five days before the session. 8-3-10-4 The Chairman shall lead the session and require orderly behavior and discussion. 8-3-10-5 No actions shall be taken or motions made at a worksession. 8-3-10-6 Worksessions shall be open to the public. Public comment is not required but may be allowed at a worksession. 8-3-10-7 The Secretary shall keep a general record of all worksessions and the items discussed. 8-3-11 Adjournment - In no case shall the Commission consider any new items after 10:30 P.M. and in all cases the Commission shall adjourn by 11:00 P.M. ARTICLE IX - AMENDMENTS 9-1 These bylaws may be amended by a majority vote of the entire membership after thirty days prior notice to all members. 7
