Lawrence, Zoning Administrator v SUBJECT: Public Hearing: Consideration to Revoke CUP #012-97 for Michael M. Milam DATE: March 6, 1998 As you may be aware, the Board of Supervisors approved CUP 9012-97 on October 7, 1997, for Michael M. Milam to operate a landscaping service, retail, and wholesale business at 2186 Northwestern Pike. A number of conditions were associated with this CUP approval In the CUP approval letter issued by the Planning Department on October 8, 1997, five conditions were identified. Mr. Milam has failed to adequately address three of these conditions. These three conditions are'. ► A commercial entrance meeting VDOT requirements shall be constructed and approved within sixty (60) days of the Conditional Use Permit approval. ► Any signage for the business must be as permitted by the Zoning Ordinance. ► A minor site plan shall be approved by the County. VDOT Entrance Requirements Based on the 60 -day requirement stated in the approved CUP, the VDOT entrance should have been satisfied by the beginning of December 1997. In December, VDOT agreed to allow a street connection design rather than the standard commercial entrance requirement for this project. In a conversation with Mr. Steve Melnikoff of the Virginia Department of Transportation on March 3 1998, staff was informed that Mr. Milam has not contacted VDOT since December 1997. VDOT has yet to receive the necessary design requirements for review. Signage Initially informed of an illegal sign on this site in June 1997, Mr. Milam continues to display the illegal sign advertising his business. In a letter dated October 3, 1997, Mr. Milam was informed that the erected sign exceeded the maximum sign square footage allowed, and that a sign permit is required. 107 North Kent Street • Winchester, Virginia 22601-000 Milam Landscaping CUP #012-97 Page 2 March 6, 1998 As of March 6, 1998, the sign continues to exist, exceeding the square footage requirements of the Zoning Ordinance, and the County has not received a sign permit application for the sign. Minor Site Plan In a brief discussion with Mr. Painter of Painter -Lewis, P.L.C. on February 24, 1998, staff was informed that Mr. Milam has not requested the services of Painter -Lewis for a minor site plan. Painter -Lewis had discussions concerning the entrance design, but was never authorized to initiate work by Mr. Milam. In a brief discussion with Mr. Milam on March 2, 1998, Mr. Milam indicated that he intends to seek approval for an entrance design/plan. When staff stated that a minor site plan was in fact required, Mr. Milam stated he was not aware of such a requirement. Staff referred him to the CUP approval letter dated October 8, 1997, in addition to other correspondence. Staff has mailed a number of letters to Mr. Milam addressing the CUP requirements. A second deadline of February 20, 1998, was established for the completion of all requirements associated with the approved CUP. These letters were sent via certified mail to Mr. Milam in January 1998. As the certified mail was left unclaimed, the assistance of the Sheriff's department was utilized. The Sheriff s department delivered the letters to Mr. Milam on February 9, 1998. This office received a letter from Mr. Milam on February 9, 1998, stating his intention of satisfying the CUP requirements by April 1998. This letter also stated that he hoped to reopen the business by April 1, 1998. In conflict to Mr. Milam's letter, there was a Grand Opening banner sign placed at the business site, and observed by staff on February 27, 1998. Copies of these letters are enclosed for your information Based on the activities which have occurred relating to Conditional Use Permit #012-97, staff recommends the revocation of CUP 412-97. As of today, you have failed to comply with the stated requirements of the approved CUP. I am in receipt of your letter dated February 5, 1998, which states your intention of achieving full compliance with the approved CUP by April 1, 1998. You also contacted me on February 19, 1998, to confirm that I had received the letter, and to inform me of the specifics of your progress towards compliance. Below are some of the specifics that gu provided: 1. That Tim Painter, Painter -Lewis, P.L.C., has started the minor site plan. I spoke with Mr. Painter on February 24, 1998. He informed me that you have not authorized him to begin any work for this project. He further provided that you have only discussed an entrance plan; you stated that the entrance was all that was needed for the minor site plan. Planning Response: The approved CUP required that a minor site plan be approved by Frederick County. This minor site plan requires more than simply an entrance to the site; access, parking, and health systems location are some of the necessary items that should be included on this minor site plan. 2. That construction of a commercial entrance is awaiting approval from VDOT as to what type of entrance is required. I spoke with Mr. Steve Melnikof, , Virginia Department of Transportation, on 107 North tient Street - Winchester. Virginia 2260 Page 2 Milam, Michael CUP # 012-97 February 26, 1998 February 24, 1998. He informed me that in a conversation with you in December, he agreed that a `street connection' design would be an acceptable entrance for this project. Mr. Painter confirmed that he was aware of the agreement that a `street connection' design would be appropriate. Planning Response: Since VDOT agreed to the entrance type in December, you should have authorized an engineer to begin the entrance design for the minor site plan, as required by the approved CUP. 3. That you were to meet with John Trenary, Building Official, on Monday, February 23, 1998, to discuss the requirements of, and apply for, a sign permit. In a discussion with Mr. Trenary on February 24, 1998, he stated that he had not spoken with you in the past few months, nor had any arrangements been made to meet with you on February 23, 1998, to discuss the sign permit. Planning Response: In a letter dated October 3, 1997, and in the approval of the CUP, you were informed about the Zoning Ordinance sign requirements, and that your existing sign was in violation. This sign issue should have been resolved once the violation was brought to your attention in October 1997. When the Conditional Use Permit for this project was approved in October, a number of conditions were attached, one of which stated that a commercial entrance meeting VDOT requirements shall be constructed and approved within sixty (60) days of CUP approval. This would have created a deadline in November 1997. Obvious by my above mentioned research, this date was not satisfied. Based on my review of compliance to the approved CUP, you have neglected to satisfy the stated conditions associated with Conditional Use Permit #012-97. The initial deadline in November 1997 has come and passed without compliance. The extension deadline of February 20, 1998, has passed, and little additional progress has been achieved. Therefore, I have determined that you have not satisfied the conditions associated with the CUP, and I will recommend to the Frederick County Board of Supervisors that Conditional Use Permit 4012-97 be revoked. The Planning Commission will review the status of this CUP at their meeting on March 18, 1998; their discussion will result in a recommendation to the Board of Supervisors. (If there are any members who were unable to attend that would like a copy of the agenda materials, please let me know.) The retreat is an invaluable oportunity for the staff to discuss pressing issues with members of the Board and Commission in a less formal setting. The opportunity for a give-and-take dialog with, and among, the members gives us input and feedback that is difficult to obtain in any other setting. I hope memberes of the Board and Commission share a similar view of the value of the day's activities. Setting Priorities At the retreat, members of the Planning Commission and Board of Supervisors were asked to rank a list of proposed projects in order of their relative importance. This was an effort to gain a sense of what members viewed as priorities for the year and, thereby, assist the Planning Department with the preparation of our 1998 work program. The resulting ranking is indicated in the attached tabl,w, along with a second table showing the ranking assigned by those that responded to the survey. Unfortunately, only five responses were received; therefore, the significance of the resulting ranking is somewhat questionable. There were some issues which were discussed about which there seemed to be little disagreement with regard to the need to address them. We have interviewed consulti g firms in order to undertake the task of examining the County's Fiscal Impact Model and hope to have that process underway before the end of the month. 107 North Kent Street - Winchester Virginia 22601-5000 Planning Retreat Summary Page 2 We will proceed with a land use study of the area between Shady Elm Road and the land lying east of route 522, to include the corridor of the proposed extension of Route 37. WPD 107 North [gent Street • Winchester, Virginia 22601-5000 Department of Planning and Development 1998-99 Draft Work Program General Mission Statement The mission of the Department is to lead in the development of policies and procedures pertaining to all aspects of community growth and development, as well as administer existing policies and procedures fairly and accurately. Policy development is achieved through the monitoring of various local, state, and national growth trends in an effort to anticipate needed changes or additions to regulations and procedures. The focus of this effort is to create and maintain a process which will positively influence the type, quality, and location of development. The goal is to produce a livable, well-rounded community, balancing the desire for growth with the desire for a high quality of life. This is in part carried out by providing the governing body with well thought-out, thoroughly researched, recommendations and support information in order to facilitate informed decision making. Department Description The Planning Department is again operating at reduced staff. With the recent departure of Andrew Evans we have moved Eric Lawrence into the position of Zoning Administrator, and anticipate filling the resulting Planner vacancy within weeks of this writing. Once we have a full staff on board, we hope to quickly resume a more balanced work program. Current staff includes the Director, Deputy Director, two professional planners (with an additional planner position currently vacant) Zoning Administrator, two Mapping and Graphics professionals, an Office Manager, two supporting clerical staff and a receptionist. With reduced staffing our attentions are, by necessity, dominated by short- term tasks at the expense of long range planning. The daily activities of the Planning Department involve a great deal of administrative work. Codes and ordinances pertaining to land use and development are administered and problem -solving assistance is provided to developers, landowners, and the general public. Daily activities include responding to numerous inquires, review of development proposals, land use applications and building permits, preparation of various agenda materials, and the investigation of ordinance violations. Long range planning projects are undertaken as time permits. The staff is heavily involved with land use and transportation planning, grant applications and administration, historic preservation, and environmental issues. These activities require substantial coordination with other County departments, regional jurisdictions, and various State agencies. The development of a substantial, state-of-the-art, Geographic Information System (GIS) is underway which will coordinate all map - related data in the County using state-of-the-art technology. 1998-99 Goals, Objectives and Strategies GOAL: To maintain and improve our planning process in order to manage growth and development in Frederick County. Objective: Maintain an up-to-date Comprehensive Plan that is responsive to changing situations and current needs. Strategies Modify the Comprehensive Policy Plan format and review process. The County has traditionally reviewed the Plan on an annual basis. In order to continue in this tradition, but reduce reproduction costs, in 1997 the Plan was reformatted and placed in a binder so that only those portions being updated would need to be reprinted. A major update should be performed on roughly five-year intervals and is over -due. An attempt should be made to at least do a chapter -by -chapter update as time permits. The annual review should concentrate on a particular section each year along with the update of statistical data. Establish small area land use plans for particular geographic areas. Efforts should focus on the area between Shady Elm Road running east to Route 522, including the area affected by the proposed extension of Route 37. If time permits, the area along Route 11 north to the West Virginia line should also be evaluated. Update Count. Transportation and land use plans. These plans will need to be updated with completion of the Winchester Area Transportation Plan and approval of the final Environmental Impact Statement for Route 37 extended. Objective: Develop and maintain a computerized information system in order to better monitor development and aid in the collection, dissemination and analysis of information to support planning decisions. Strategies Assist in the effort to promote use of the County's wide area network ()yAN} and the Intranet. The Department's Mapping and Graphics staff will continue Planning and Development Page 2 Goals and Accomplishments to focus efforts on training and accessability of information. With increased use of the WAN by other County personnel, mapping staff should be able to increase efforts on map conversion, update and acquisition of additional layers of information, and system maintenance. Continue coordination efforts with Shenandoah University and other outside agencies to expand on the concept of a County Web page. Continue to offer training to other County departments in use of the GIS and associated programs. Objective: Prepare coordinated plans for community facilities. Strategies Annual update of the five-year Capital Improvements Plan (CIP) for major capital facilities. Continue efforts to improve the quality and accuracy of information provided. Search for new ways to achieve increased coordination and cooperation between various County departments and agencies in planning for capital facilities. Expedite and coordinate the design review of major development projects Investigate methods for improved communication and coordination with the school system in planning and locating new school facilities. Establish a capital facilities review process which is in keeping with the requirements of Section 15.2- 2232 of the State Code. GOAL: To initiate actions to put planning policies into effect. Objective: Maintain up-to-date development regulations which are effective in achieving their intended result. Strategies Continue to review and evaluate the effectiveness of development regulations. Strive to get a plan adopted within calendar year 1998. Objective: Continue to develop and implement methods to preserve key historic sites that will assist with the promotion of tourism. Strategies Implement the Battlefield Action Plan concentrating on preservation methods that emphasize cooperation with landowners. Continue to support the efforts of the Kernstown Battlefield Association and explore other funding sources to assist with the purchase of the Grim property. Objective: Ensure that new development adequately provides for the cost of new infrastructure. Strategy Continue to develop and refine impact analysis techniques in order to more accurately project the financial impacts of new development on infrastructure. Use conditional zoning and explore other means of addressing these impacts. Complete evaluation and revision of the County's Fiscal Impact Model and insure an annual review and update. Objective: Keep the Board, the Commission, and the County Administrator well- informed of activities within the department which they may receive inquiries about. Strategy Hold regular work sessions between the Commission and Board in order to keep all parties well informed of ongoing activities and to receive direction. Objective: Improve the quality and presentation of information provided. Strategy Use the Geographic Information System and other available computer systems and models to provide more useful and complete information in a format that is easy to use. THE 1998-89 PROGRAM A. ADMINISTRATION - Administrative tasks will include the following: 1. Violations and Complaints - Complaints received concerning ordinance violations will be addressed in an appropriate fashion based on the specifics of the occurrence. 2. Requests for Information - Requests will be responded to in a timely fashion given priorities of certain projects and the amount of staff -time required to generate the information requested. 3. Support Boards, Commission, and Committees - Issues will be thoroughly researched, recommendations on alternative approaches to addressing issues will be developed, and supporting information materials generated for eight to 12 agendas per month. 4. Improved Customer Service - The staff will strive to develop new procedures and methods which result in faster turnaround of information requests, land use applications, and overall improved customer service. 5. Coordination with Agencies - The staff will continue to coordinate policy formulation, project development, and decision-making with federal, state, regional, and local agencies. 6. Record Keeping and Administrative Improvements - The staff will continue to work on improvements to record keeping and administrative procedures in an effort to improve overall office efficiency. 7. Capital Facilities Impact Model - We will attempt to work with a consultant to examine the model and revise it accordingly. 8. Grant Administration - Staff will continue to provide administrative over sight and management of the Community Development Block Grant (CDBG) and three Intermodal Service Transportation Efficiency Act grants (ISTEA) which correspond to the Rose Foundation's Center for Community Living, Sherando bike path, and acquisition of the Grim property. DEVELOPMENT REVIEW -The overall number of development applications remained fairly constant in 1997 calendar year when compared to previous years. This trend is expected to continue in 1997. Staff will continue to review the following types of development proposals and will work to improve review procedures: Rezonings Conditional Use Permits Master Development Plans Site Plans Subdivisions Variances Building Permits C. COMPREHENSIVE PLANNING - The Comprehensive Plans and Programs committee will review and update the Comprehensive Plan and Capital Improvements Plan. Staff will explore ways to increase the efficiency of the annual review process to make it less costly, and to produce a more informative, easy to use Plan. Comprehensive planning work items will be as follows: 1. Shady Elm to Route 522 - A land use plan will be produced for the area affected by the anticipated extension of Route 37 from I-81 to Route 37. The plan will address economic development, land use, growth, appearance, traffic, and other issues. Property owners and other stake holders in the area will be involved in the process. 2. Route 11 Corridor, North of Clearbrook - If time should permit, work will begin on a land use plan for the corridor and the surrounding area. Special emphasis will be placed on the location and feasibility of business and industrial sites. 3. Stephens City - Planning efforts with Town representatives, focused on the area immediately surrounding the town limits, will continue through the Frederick County/Stephens City Planning Committee. 4. Capital Facilities; Forecasting Need and Methods for Approval - Discussions continue on the methods used to assess the need for new capital facilities. Procedures should be developed, in compliance with the State Code, for review and approval of new capital facilities. There is a need for uniform projections methods to be used by various agencies in the County. Both the projections and need assessments should be linked to the adopted Comprehensive Plan. 5. Comprehensive Plan Requests - Each year requests are received to make certain revisions to the Plan. Such requests will be reviewed by the Comprehensive Plans and Programs Committee. 6. Business and Industrial Land Use Issues - There is a need to refine the policies in the Comprehensive Plan concerning business location. Planning and Development Page 8 1998-99 Work Program 7. Eastern Road Plan - The Eastern Road Plan will be reviewed and revised based on the results of the Winchester Area Transportation Study. 8. Neighborhood Planning - There may be a need to work with specific neighborhoods, such as Shawneeland or the Summit, to address neighborhood planning issues. 9. Rural Community Centers - Each of the identified Community Centers may require a special planning effort (as time permits) which focuses on the issues particular to each center. D. ORDINANCE REVIEW - In addition to routine requests, activities of the Development Review and Regulations Subcommittee will include the following: 1. Zoning and Subdivision Ordinance Review - The Comprehensive Plan describes a need to monitor the effectiveness of the development regulations on an annual basis. There is a growing need to do a complete overhaul of both the Subdivision and Zoning Ordinances. Continued piecemeal amendments combined with the changing character of the County have resulted in a number of inconsistencies within the ordinances. Short of a complete rewrite, specific issues that will be reviewed, as time permits, include the following: Permitted uses within the Industrial Zoning Districts Residential design standards Planned developments regulations The provision of recreational amenities Design standards for residential streets Open Space requirements Environmental feature protections Floodplain Regulations In addition to these efforts, the subcommittee will respond to specific requests to review particular ordinance provisions. 2. Development Review - The Subcommittee will review specific development issues in relation to particular developments as needed. E. TRANSPORTATION - Transportation planning work will include the following: 1. Area Transportation Planning - Special efforts will begin on incorporating, publicizing, and implementing the road improvement plans that result from the Winchester Area Transportation Study and the Route 37 Corridor Location Study. Special efforts will be Planning and Development Page 9 1998-99 Work Program made to insure that the Eastern Road Plan is effective and up to date. There will be a need to continually work with the Virginia Department of Transportation to ensure that improvement projects are funded and implemented in a timely fashion. 2. Transportation Committee - Routine nnniwal :v^rk .:ill cvntiiiue with this l+Vr1ui11t1.Ge of the Board of Supervisors including the primary and secondary road improvement plans. 3. Regional Transportation Planning- The staff will participate in the regional transportation planning efforts through the Lord Fairfax Planning District. It is hoped that these efforts will provide improved resources, coordination, and influence in transportation planning for the region. 4. ISTEA Grant Applications - The staff will continue to apply for funding and administer the projects implemented under the ISTEA programs for as long as those programs last. 5. Route 37 - The staff will continue to supervise and coordinate work on the completion of the Final Environmental Impact Statement and the design of Route 37 extended. 6. Warrior Drive Revenue Sharing and Construction. - Staff will continue to coordinate applications for revenue sharing funds and begin design and construction of the portion of Warriror Drive between Route 277 and Relocated Route 642 (Tasker Drive). F. MAPPING and GRAPHICS - A major effort continues on implementing the County's Geographic Information System (GIS) Plan. 1. Expand Mapping Database - The staff will continue to expand the mapping database. Map conversion, acquisition of additional layers of information and user applications, and efforts to improve overall mapping and communication capabilities will proceed. The GIS will allow county staff to provide highly accurate information quickly. 2. Assist in the implementation of Phase H of the County's GIS Plan - Phase II of the GIS Plan (implementation of which began in Fiscal Year 97-98) will involve other departments and will result in a county -wide user network. 3. Development of a County Web page - Coordination and communication will continue with outside agencies, such as Shenandoah University, in an effort to provide additional, user-friendly information over the Internet. Planning and Development Page 10 1998-99 Work Program G. HISTORIC PRESERVATION 1. Historic Resources Advisory Board - Staff will provide support to the Historic Resources Advisory Board. The Historic Resources Advisory Board will take the lead role in the following efforts: Ensure that historic survey and other information is available to decision makers; property owners and the public in a useful form. Increase public awareness of the historic resources in the County. Ensure that proper emphasis is given to historic values in the development review process. Review development proposals. Continue the site recognition and plaque program. Develop incentives to property owners for historic preservation. 2. Battlefield Issues - The staff will work to support the local and regional battlefield preservation efforts as described by the Battlefield Network Plan. H. ENVIRONMENTAL PLANNING - The staff will continue to monitor any activity associated with the Potomac Basin Tributary Strategies Act and keep County officials informed of any significant developments. The staff will also work with various agencies on environmental issues such as floodplain management. I. OTHER 1. Improved Customer Service - Staff will continue to look for ways to improve public satisfaction with the land use review process. This will include an examination of the possibilities for a staff position of "application coordinator." This individual would be responsible for circulation, processing, and tracking of all application materials, thereby significantly reducing the responsibilities currently placed on the applicant. 2. Citizen Involvement and Education - Staff will continue to work with government classes and other student groups to increase awareness of the planning process and local government activities. We will also strive to develop new formats for public meetings which result in increased participation and a better means of sharing information.
