The Comprehensive Plans and Programs Subcommittee (CPPS) considered a request to allow for the
expansion of the Urban Development Area (UDA) to incorporate parcel 63-A-2 of Joseph A. Allen,
et als during their August 9, 1999 meeting. Mr. Stephen Gyurisin, representative of Mr. Joseph A.
Allen, et als, advised the CPPS that parcel 63-A-2 is a 16.9 -acre portion of a 41 -acre parcel which
is severed by the city/county boundary line. The 24.1 -acre portion within the City of Winchester
Corporate Limits is zoned LR (Low Density Residential) District which allows single family detached
residential units on 12,000 -square -foot lots, while the 16.9 -acre portion within Frederick County is
zoned RA, (Rural Areas) District. Mr. Gyurisin also advised the CPPS that the Frederick County
Sanitation Authority Board approved a request to allow this acreage to be served with public water
and sewer by the City of Winchester Public Utilities should this acreage be incorporated into the
UDA.
The CPPS felt that this request was analogous to the Board of Supervisors' approval of expanding
the UDA boundary to incorporate the nine -acre tract for the Westridge Subdivision which was also
severed by the city/county boundary line. Furthermore, the CPPS felt that this particular request
would allow for improved public services by creating a local street network between this parcel and
the Westridge Subdivision which would connect Cedar Creek Grade (Route 622) and Middle Road
(Route 628). The CPPS recommended unanimous approval of this request with a condition that the
development of this property provided access from Cedar Creek Grade to a connection with the
Westridge Subdivision to ensure improved public services through a complete road network. Mr.
Gyurisin advised the CPPS that the developers of the Allen tract would be amenable to constructing
a road network from Cedar Creek Grade to Westridge Lane, including the off-site improvement
within the Westridge Subdivision.

On behalf of the owner of parcel 16-A-2 consisting of 16.9 + acres zoned Rural Area (RA), we request
extension of the Urban Development Area (UDA) to include this property.
:r. Allen's property consists of approximately 41 acres in two parcels located in both the City of Winchester
and Frederick County. The portion of the property located in the City of Winchester is zoned "LR" a
residential zoning classification that allows single family, detached, 12,000 + square foot homes. The portion
located in Frederick County is zoned "RA" allowing 2-5 acre lots. We are requesting the extension of the
Urban Development Area (UDA) to allow for development of the remainder of W. Allen's property in a more
urban fashion. We envision development design that would be similar to the adjoining Westridge Subdivision
that consists of 12,000 + square foot single family homes, public sewer and water, sidewalks, streetlights,
storm water management and public streets. The adjoining Westridge Subdivision is located in both the City
of Winchester and Frederick County.
Access to the property is possible through future stub roads planned as part of the Westridge Subdivision, the
unbuilt Rudbar Avenue and Cedar Creek Grade.
Sewer and water service would be provided by the City of Winchester if approved by the Frederick County
Sanitation Authority.
Our plans include requesting for a Residential Performance (RP) zoning designation and developing the
infrastructure for a residential neighborhood consisting of 12,000 + square foot single family homes.

RE: Fellowship Bible Church Water and Sewer Extension Request

The Comprehensive Plans and Programs Subcommittee (CPPS) considered a request to allow for the
extension of public water and sewer service to the Fellowship Bible Church property during their
September 13, 1999 meeting. Representatives of Fellowship Bible Church advised the CPPS that
they are limited in their ability to expand the current facility to provide services for their growing
congregation due to the limited drainfield area and the inability of the well system to provide adequate
fire protection.
To adequately develop this site, the church desires to install a 2'/z -inch force main sewer line and a
water line of adequate size to provide fire protection. The Frederick County Sanitation Authority
(FCSA) requires developers to provide an eight -inch line for fire service which must be dedicated to
the authority, therefore, the force main sewer line would be private and the fire service line would be
public. Fellowship Bible Church would access the Apple Valley Water and Sewer System that is
being developed by the FCSA to serve their property. Correspondence from the FCSA, dated July
21, 1999 indicates that there is adequate capacity in the Apple Valley Water and Sewer System to
accommodate this request.
The CPPS felt that conditions had changed significantly since they recommended denial of a similar
request from Fellowship Bible Church in 1996. The recent adoption of the Southern Frederick Land
Use Plan extended the Sewer and Water Service Area (SWSA) boundary along the south side of
Apple Valley Road (Route 652) to the intersection with Middle Road (Route 628). This extension
places the SWSA boundary directly across Apple Valley Road from the Fellowship Bible Church
property, whereas, this boundary previously existed '/z mile south. Furthermore, the 1996 request

proposed to connect to the City of Winchester Public Utilities system within the Westridge
Subdivision which was located 3/4 -miles from this property, whereas this request would connect to
the Apple Valley Water and Sewer System which will ultimately be developed across from the
Fellowship Bible Church property when the Blackburn Limited partnership tract is developed. The
CPPS recommended unanimous approval of allowing public water and private sewer service
extension to the Fellowship Bible Church property based on these conditions.

Dear Mr. Wyatt,
We a Fellowship Bible Church are hereby requesting permission to connect to Frederick
County water and sewer lines currently extended to the new Coke Cola plant on Apple
Valley Road_ if our request is granted, we expect to install a 2 '/2 inch forced sewer line
and a water line adequate to provide fire protection. These lines would run approximately
three quarters of a mile on the southwest side of Apple Valley Road ( same side as the
coke plant). Our church facility is located at the intersection of Middle Road and Apple
Valley Road and currently uses two septic fields for waste disposal and a 340' deep well
for water service.
Our church was established at its present location in 1984 and grew to 150 in number by
1990. Since that time we have grown to over 700 in attendance at our three Sunday
services. While our core mission of worship, teaching and fellowship is our primary
focus, we are actively involved in the Frederick County community by means of non-
denominational youth programs (k through college age), pregnancy counseling, and food
programs for those in need, just to name a few. Our growth has compelled us to plan a
facility expansion program in three phases. The first phase will include a multi-purpose
building with a seating capacity of approximately 800 which alternatively can be used as a
gymnasium facility. This option of using the building for basketball, volleyball, and other
sports should enhance our outreach and also provide the youth of our community a
location to gather that is attractive, safe, and where wholesome activities are encouraged.

Our current septic and water systems can be upgraded to service our first phase of
construction only by placing the new multi -purposes building at a less than ideal location

Public Meeting Requirement
The Subdivision Ordinance requires that land divisions in the RP (Residential Performance) Zoning
District, without an approved master development plan, be presented to the Board of Supervisors for
final approval (§ 144-12-B). The Master Development Plan (MDP) requirement may be waived, and
has been waived for this project, based on the scale of the subdivision proposal. This project contains
land zoned RP and does not contain an approved NIDP; therefore, Board review and action is
necessary.
Staff Review
This land parcel is located in between the Fredericktowne and Fredericktowne Estates Subdivisions.
It is a residual parcel around which the above-mentioned residential areas have developed. The
application proposes a two -lot subdivision. The proposed lots comply with the dimensional
requirements of the single family detached urban housing type, in particular, the minimum lot size of
12,000 square feet. Access to both lots is proposed to be directly onto Fairfax Drive. Access to the
parcel identified with PIN 75-A-73 is achieved via Rockbridge Road extended.
With one exception, the subdivision as submitted appears to satisfy the requirements of the
Subdivision Ordinance. Sidewalks are required to be installed in the right-of-way along local streets
in any subdivision containing one (1) or more lots of less than fifteen thousand (15,000) square feet
in size. Due to the fact that the developments surrounding this proposed subdivision do not contain
any sidewalks, and the size of the proposed lots, it may be appropriate to allow an exception to this
requirement in this case. The Board of Supervisors, upon recommendation of the Planning
Commission, may allow variations in or exceptions to the provisions of the Subdivision Ordinance
in cases of unusual situations.
STAFF RECOMMENDATION FOR 10/20/99 PLANNING COMMISSION MEETING:
Staff recommends approval of this subdivision application with an exception to Section 144-18, the
provision of sidewalks, contingent upon the applicant's satisfying all review agency comments.
