Uses in the B2 Zoning District with Performance Standards

A request has been submitted by Mr. Ralph Beeman of Greenway Engineering, on behalf of TJC
Enterprises (Signet Screen Services and Embroidery) to amend the Zoning Ordinance to permit
Advertising Specialties - Wholesale (SIC #5199) uses in the B2 (Business General) Zoning District. This
request was considered by the Development Review and Regulations Subcommittee (DRRS) at their
February 23, 2000, meeting. Following discussion, the-DRRS recommended that Section 165-82.B.(1),
B2 (Business General District) Allowed Uses, of the Frederick County Zoning Ordinance be amended
to include Advertising Specialties - Wholesale (SIC #5199) as a permitted use. The committee further
recommended that performance standards be adopted to ensure that the scale and operation of such uses
would remain consistent with the intent of the B2 District.
Issue Summary:
The proposed amendment would permit the establishment of Advertising Specialties - Wholesale uses
in the B2 District. Establishments that would be classified as Advertising Specialties - Wholesale may
involve an array of advertising -related activities to include custom embroidery, custom textile printing,
and the coordination of orders for advertising specialties for local clients through outside suppliers. As
endorsed by the DRRS, such uses would be subject to the following performance standards:
1) Establishments engaged in such businesses shall not exceed 10,000 square feet of total floor area.
2) Only 25% of the total floor area of a shopping center shall contain such businesses.
3) Such businesses shall not have outdoor storage.
These standards were deemed necessary to ensure that the scale of such businesses would remain
consistent with the character of the B2 District. In essence, only Advertising Specialties - Wholesale

uses of limited intensity would be permitted in the B2 District, while larger wholesale operations would
be allowed only in the B3 (Industrial Transition), M1 (Light Industrial), and M2 (Industrial General)
Zoning Districts. Limited in scale by the recommended performance standards, it is unlikely that the
establishment of such uses in the B2 District would increase heavy truck traffic in commercial areas
traveled primarily by passenger vehicles and pedestrians.
Review of Planning Commission Discussion
The proposed amendment was considered as a discussion item during the April 5, 2000, Planning
Commission meeting. No changes to the proposed language were recommended and the amendment
received the general support of the Planning Commission.
Attached for your reference is the proposed amendment. Following receipt of public comments, a
recommendation to forward to the Board of Supervisors would be appropriate. Staff will be available
to address your questions and concerns.

Advertising Specialties - Wholesale businesses located in the B2 Business General
Zoning District shall be subject to the following requirements:

RE: Eastgate Commerce Center Woodland Disturbance Waiver

Please find attached a letter from C. E. Maddox, Jr., P.E., Vice President of Gilbert W. Clifford and
Associates, dated March 13, 2000. On behalf of Eastgate Properties, Mr. Maddox is requesting a
woodland disturbance waiver as permitted under Section 165-31 B(7) of the Frederick County Zoning
Ordinance. Currently, the Zoning Ordinance allows for the disturbance of 25% of the total woodland
area on a specific parcel or within the total acreage of a master planned area.
Gilbert W. Clifford and Associates has prepared an exhibit which identifies the environmental features
within Eastgate Commerce Center. Sheet 1 of 2 of this exhibit identifies 38 acres of woodlands
throughout the commercial and industrial park. Eastgate Properties is requesting a waiver to allow
for the disturbance of up to 55%, or 21 acres, of the total woodland area within Eastgate Commerce
Center. Sheet 2 of 2 of this exhibit demonstrates the location of the 17 acres of woodland that would
remain undisturbed if this waiver is granted.
In 1996, the Board of Supervisors approved a woodland disturbance waiver request for the Airport
Business Center. This waiver allows the Airport Business Center to disturb 56%, or 84 acres, of the
149 acres of the total woodland area. In order to ensure that additional disturbance would not occur,
representatives of the Airport Business Center proposed to establish an environmental corridor
easement for the remaining 65 acres ofwoodlands. The environmental corridor easement is identified
with a legal survey description which is depicted on the master development plan and on all
subdivision plats that are established within the Airport Business Center. This easement preserves
the environmental features by restricting any disturbance within the surveyed area.
The Planning Commission will need to forward a recommendation to the Board of Supervisors
regarding this waiver request. It may be prudent to require the applicant to establish an
environmental corridor easement for the undisturbed woodland areas to ensure their future
preservation.

Attached is a typical layout of potential industrial sites on the above referenced project. As you will note 55%
of the woodlands on this project will require removal in order to properly develop the site as an economic
development project for Frederick County.
The removal of woodlands will exceed the allowable 25% removal requirement in the environmental section of
your ordinance and the Board of Supervisors has the ability to waive this requirement. Please consider this
' -tter a formal request for the Board of Supervisors to allow up to 55% disturbance on this project.
Prospective industrial clients are looking at these sites now. We would appreciate anything your office can do
to expedite this request. If you have any questions please do not hesitate to call.
