CALL TO ORDER & ADOPTION OF AGENDA Chairman Wilmot called the meeting to order at 7:00 p.m. Chairman Wilmot noted one change to this evening's agenda. Chairman Wilmot said the last item, Number 6, Tab C, Water Service in the Stephenson Area, needs to be postponed until a later date. A motion was made by Commissioner Kriz to adopt the agenda with Item Number 6, Tab C, removed. This motion was seconded by Commissioner Triplett and the Planning Commission unanimously adopted the May 5, 2010, agenda for this evening's meeting. MINUTES Upon motion made by Commissioner Kriz and seconded by Commissioner Triplett, the March 17, 2010, minutes of the Frederick County Planning Commission were unanimously approved as presented. Frederick County Planning Commission Page 2636 Minutes of May 5, 2010 -2 - COMMITTEE REPORTS Conservation Easement Authority — 4/22/10 Mtg. Commissioner Triplett reported that the Conservation Easement Authority (CEA) discussed fundraising efforts and a website for monetary contributions is being considered. Also discussed was the TDR (Transfer of Development Rights) Program, which had been presented to the Board of Supervisors on April 28, 2010. Commissioner Triplett said a Cedar Grove Road resident wanted to dedicate a 20 -acre easement. An application was provided and the request will be considered in the near future. CITIZEN COMMENTS Chairman Wilmot called for public comments on any subject not on the Commission's agenda for this evening. No one came forward to speak. PUBLIC HEARING Conditional Use Permit 903-10 for Animal Medical Center, submitted by Grey Wolfe, Inc. to allow for a building expansion and parking at 689 Aylor Road (Rt. 647) in association with the conditions set forth by Conditional Use Permit #06-95. This property, zoned RP (Residential Performance) District, is identified with P.I.N. 75-A-38 in the Opequon Magisterial District. Action — Recommended Approval with Conditions Commissioner Oates said he would abstain from all discussion and voting on this conditional use permit due to a possible conflict of interest. Commissioner Crosen said he would abstain from all discussion and voting on this conditional use permit due to a possible conflict of interest. Zoning and Subdivision Administrator, Mark R. Cheran, reported this is an application to expand an existing conditional use permit (CUP) #06-95, which was approved by the Board of Supervisors on August 9, 1995. Mr. Cheran stated that veterinary offices are a permitted use in the RP (Residential Performance) Zoning District. He said the existing building foot print is approximately 3,500 square -feet and the applicant is applying for a building addition of no more than 12,500 square -feet. Mr. Cheran noted a new site plan will be required with the building addition in order to update the site to meet current ordinance requirements, including parking. Mr. Cheran reported that the Planning Department has received a number of letters and emails, both in favor and opposition to the CUP; comments against the CUP range from odors and traffic to drainage. Mr. Cheran pointed out this business has been operating at this site since 1995 and there have been no reported zoning violations during that time. In addition, VDOT has had no issues with the Frederick County Planning Commission rage Minutes of May 5, 2010 -3 - road and entrances. He noted that drainage and stormwater management issues will be addressed at the site plan stage of development. Mr. Cheran next read a list of recommended conditions, should the Planning Commission find the expansion to be appropriate. Commissioner Mohn inquired what type of screening elements would be required to be installed by ordinance for the buffering. Mr. Cheran replied it would most likely be a full -screen buffer, such as the existing six-foot fence along the property line, which was installed pursuant to the site plan issued back in the 1990s. Commissioner Lemieux asked about the entrance and Mr. Cheran replied that VDOT reported no issues with the entrance. Mr. Cheran recalled the recent improvements made to Aylor Road and along the frontage of this property. He said VDOT owns most of the road frontage except for a small portion owned by the applicant_ Mr. Cheran said if it was necessary for the entrance to be opened up more, he thought it could be accommodated. Commissioner Thomas asked if the County was proposing the installation of a full, six- foot opaque fence along the full north side of the property and also the east side of the property. Mr. Cheran replied the additional opaque fence will need to be installed adjacent to the new building addition and parking area along the northern property line. Dr. Bruce E. Welch, DVM, co-owner of the Animal Medical Center, said his goal, along with his partner, Dr. Brian Cather, DVM, is to provide modem, progressive, and state-of-the-art veterinary medicine to the community. Mr_ Welch said the technology of veterinary medicine has greatly improved over the years, along with the scope of what is available. Dr. Welch said they currently have an in-house lab, ultrasound, and endoscopy, and will soon be expanding to do arthroscopy and laparoscopic procedures. He said they would like to expand their intensive care unit and would like to have a second operating room. Dr. Welch explained they conduct many advanced orthopedic and soft tissue operations, however, they need facilities for "ultra -clean" procedures, such as hip replacements, reconstructive knee surgeries, and arthroscopic procedures, in order to have successful outcomes. Therefore, they are hoping to be able to construct a second operating room which they can dedicate for those types of advanced and clean types of procedures. Dr. Welch said they are also hoping to develop a full rehabilitative therapy department. Dr. Welch said they do not have any intentions, at this time, to add more staff or more veterinarians. Dr. Welch next addressed the issues raised in some of the letters of opposition which were received. In particular, Dr. Welch addressed complaints in Ms. Judy K. Laub's letter about the visual attractiveness of the building, the mixing of residential and commercial traffic, the entrance, and the possible health threat due to animal waste. Dr. Welch presented a letter from Mr. Frank R. Lee, a licensed soil evaluator and a former Health Department official, who reported on the environmental condition of the property. Dr. Welch said it was Mr. Lee's professional opinion there was no evidence of a health hazard on the property or any violation under current regulations. He added that the veterinary facility has a person assigned on a daily basis to go out and pick up animal waste. Mr. Welch said they are willing to fence not only the north side of the property, but also, the east side of the property, and to replace the existing privacy fence, which was installed over 13 years ago. Mr. Welch next addressed other complaints, regarding noise, odors, and lighting. Chairman Wilmot opened the public hearing and called for citizen comments. The following persons came forward to speak: Frederick County Planning Commission Page 26325 Minutes of May 5, 2010 -4 - Mr. Lawrence J. Complier, Opequon District, was a property owner at the northeast corner of Westmoreland Drive and Accomack Circle. Mr. Complier said they received a letter from Dr. Welch on April 30, and one from the Planning Department, about a week ago, which did not give them much time to research the proposal. He said a big concern was the visual impact of increasing the existing 3,500 square -foot building to a 9,000 square -foot structure. Mr. Compher said the existing building is probably twice the size of any house in the area. He said although the structure is less than 35 feet high, the barn -style roof is not visually appealing. Mr. Complier had concerns about the area on the north side of the building, where the animals are walked; he said when it rains heavily, the ditch overflows. He said stormwater runoff is a problem, especially after the road improvements rechanneled the runoff. Mr. Complier said lighting in the parking area was a concern because of the possibility of lights shining into neighbors' homes; hours of operation and traffic were also concerns. Mr. David Jennelle, Opequon District, a property owner on Westmoreland Drive, said since the veterinary facility was built, there has been a significant amount of water runoff on his property to the extent they have to run three sump pumps in their crawl space almost full time. Mr. Jennelle said his back yard is practically useless with the exception of when there is a drought. He noted there is considerable roof area on the existing structure and when it rains, it falls into a small pitch pocket. Mr. Jennelle asked for the applicant to repair or replace the fence because it has deteriorated over the years. Mr. George Nethers, Opequon District, a resident on Aylor Road, said he has lived in the residence next door to the hospital for the past 2'/2 years and has never had any issues with sound, smells, or sanitation. Mr. Nethers said the veterinary hospital has been a very good neighbor and he was glad they are conveniently located there because he owns pets. Mr. Nethers said he was happy to have Dr. Welch's and Dr. Cathers' facility next door to provide the services the area needs. Ms. Carol Mashovick, Opequon District, a resident on Wythe Avenue, spoke in favor of the veterinary facility at this location. Ms. McShovick said she was a Golden Retriever breeder and was happy she only had to travel five minutes to get to this facility. She said she has been a client of Doctors Welch and Cathers since they opened and had never noticed a problem with odors at the facility. She vouched for the doctors in that they will work through any problems they are approached with. Mr. Gerry Casey, Gainesboro District, said he has known Doctors Welch and Cathers since they were six years old and he knew their fathers. Mr. Casey spoke about the two veterinarians' integrity and he assured the Commission that these two gentlemen will do what they say. Mr. Casey said he understood the Planning Commission was concerned because of the uncertainties, but he suggested that the neighbors take a look at the plan. He said this has been a good facility and it is needed in this area. Mr. Casey said this facility was providing good, quality veterinary services. Mr. Glen Barbour, Opequon District, said he lived in Greenbrier Subdivision, around the corner. Mr. Barbour said he has also known Doctors Brian and Bruce all of his life and he has known their families. He said the doctors are expanding for a reason and they will do whatever is asked of them to make the facilities presentable. Mr. Barbour said he has been throughout this whole building and they take great pride in the appearance of their facility. He said this expansion will be an asset to the Stephens City community. Jeff Snyder, Opequon District, said he has known Doctors Welch and Cathers for quite some time and he has used Doctor Welch's services since Dr. Welch started his veterinary practice. He commented that Dr. Welch is always very helpful and is a very caring person. Mr. Snyder said the business would not have expanded in this way if he wasn't a good veterinarian. Mr. Snyder said he has Frederick County Planning Commission rage zbjy Minutes of May 5, 2010 -5 - never experienced any odors about the facility, nor has he experienced trouble getting in and out of the facility, traffic -wise. Ms. Denise Copper, Opequon District, said she lived on Westmoreland Drive and was Mr. Lawrence J. Complier's wife. Ms. Copper said her concern was not about how good a veterinarian Dr. Welch was, but was more concerning the neighborhood and how the expansion would impact the neighborhood. Ms. Copper said within the four years she has lived here, the numbers of stray animals in the neighborhood have been increasing. Ms. Dayna Taylor, Opequon District, said she lives close by in the neighborhood. Ms. Taylor thought many of the concerns raised could be addressed and she questioned why the concerns were not raised earlier. Ms. Taylor said there are a lot of strays in the Lakeside neighborhood and she didn't think it was necessarily due to the animal clinic being there. Concerning the complaint that the facility was an eyesore, she said a number of the facility's new clients have trouble finding the facility; she said the building is large, but the church across the street is large also. Ms. Taylor suggested that odors may be coming from other people's pets that are walking their animals in the neighborhood; she said there are a number of people who walk their animals off -leash and do not clean up when their animals defecate. She said feces are regularly cleaned up at the clinic. Ms. Taylor said there is a pig farm nearby and odors are emanating from that facility. No one else wished to speak and Chairman Wilmot closed the public comment portion of the public hearing. Dr. Welch returned to the podium to address some of the comments that were made by the citizens. Regarding drainage issues, Dr. Welch said the water flows towards the east side of the property. He commented that when the late Mr. Lovelace, an adjoining property owner, was alive, he asked about the drainage. Subsequently, Dr. Welch said he got Mr_ John Neff, the site excavator, and Mr. Ed Strawsnyder, Director of Frederick County Public Works, to come out to the property to take a look at the situation. Dr. Welch said during the late 90's, stormwater management methods consisted of containing water to a region with overflow capacity in order to allow it to seep into the soil and then evaporate. So, at that time this is what was intended and was appropriate. Dr. Welch said when Aylor Road was constructed, the drainage improved somewhat, but during heavy rains, water is retained on the property. Dr. Welch pointed out this was surface water, not potential black water. Chairman Wilmot commented that many of the issues being raised are the type of issues addressed during the site plan stage of development. She said the citizens will have an opportunity to view the site plan as well. Commissioner Thomas said he visited the site twice because he had received numerous communications from the neighbors. Commissioner Thomas thought this facility was one of the best - kept veterinarian clinics he has been around. He said the lot is extremely well kept and he did not find any animal wastes anywhere on the lot. He said he looked in the neighbors' back yards and did not find any evidence of drainage running from the clinic into neighbors' yards. Commissioner Thomas said the swale on the north side of the building probably could not be any deeper than it is now, because of the topography and where it ties into Aylor Road. He didn't see how it could perform any differently. He did not smell any offensive odors, nor did he hear any noise. Commissioner Thomas suggested that Condition Number 3 state, "A matching six-foot opaque fence shall be constructed along the full north and east sides of the property," unless the residents on Accomack would not prefer it be there. Commissioner Kriz suggested that recommended Condition #6 read, "Total building footprint (instead of building area) shall not exceed 12,500 square feet." He also asked the other Commissioners if there should be a condition regarding the hours of operation. Other Commissioners did not think it was necessary to include the hours of operation. Commissioner Madagan suggested the full fence on the east side be optional, between the applicant and the adjoining residents, because those adjoiners have been using this area for a garden. A motion was made by Commissioner Thomas, seconded by Commissioner Madagan, and unanimously passed to recommend approval of Conditional Use Permit #03-10 for Animal Medical Center, submitted by Grey Wolfe, Inc. to allow for a building expansion and parking at 689 Aylor Road with the following conditions: 1. All review agency comments shall be complied with at all times. 2. A monument -type business sign, not exceeding six feet in height and 20 feet in face area, shall be allowed. 3. A matching six-foot opaque fence shall be constructed on the north side, between the building additions and the parking areas along the north property line, and, at the option of the applicant and the adjoining residents, the fence shall also be erected on the east side of the property. 4. Only animals required to be hospitalized for medical reasons shall be boarded overnight. 5. Animals recovering at the facility will only be permitted in the outside area for brief exercise periods. 6. Total building footprint shall not exceed 12,500 square feet. 7. An engineered site plan shall be submitted and approved by Frederick County. 8. Any expansion or change of use will require a new conditional use permit. Frederick County Planning Commission Page 2643 Minutes of May 19, 2010 -2 - COMMITTEE REPORTS Comprehensive Plans & Programs Subcommittee (CPPB) — 5/10/10 Mtg. Commissioner Kriz reported that the CPPS received an update of the 2010 Northeast Land Use Plan (NELUP). He said the CPPS also discussed the 2010-2030 Comprehensive Policy Plan Update. Sanitation Authors — 5/18/10 Mtg. Commissioner Unger reported that the Sanitation Authority held election of officers and reappointed the same officers as last term. He reported that rainfall for the month of April was 1.2 inches, which is down; however, rainfall for the year is still up. Water production for the two water plants was 1.6 and 1.9, which is very good; only one mgd of water was purchased from the City last month; 4.5 mgd was used; Parkins Mill Plant is producing approximately two mgd, which is normal. Commissioner Unger reported on the continuing problems with Stephens City sewer, which is generating about four times more volume than normal. He said the town is experiencing some infiltration problems when it rains and the Authority and Stephens City are working on the problem. Commissioner Unger also reported the Authority received six bids on the Red Bud pump station and Patterson Construction from Fredericksburg was the low bidder. Winchester Planninz Commission — 5/18/10 Mtg. Commissioner Mohn reported that the Winchester Planning Commission considered a small rezoning for commercial use for the Winchester Union Rescue Mission which was forwarded to City Council with a recommendation of approval_ Commissioner Mohn also reported that the City is undergoing a Comprehensive Plan Update and has received considerable public input over the last two years and they are now working through the draft text. He said they discussed the first couple chapters of the Comprehensive Plan including the introduction, objectives, and vision statement. In general, a key concern of the Commission is to keep the text concise so it is accessible to the general public, especially as they move into more substantive sections of the plan. Commissioner Mohn noted these discussions will continue on a monthly basis. Economic Development Commission (EDC) — 5/07/10 Mtg. Commissioner Madagan reported that the EDC appointed Mr. Josh Phelps to the EDC's slot on the County's Review Committee for the Development Impact Model's Annual Update. He said the EDC voted to allow the City of Winchester to retain its seat on the EDC with full voting rights, if it provides funding in the amount of at least $72,000 for the coming fiscal year. The EDC Director Frederick County Planning Commission Page 2644 Minutes of May 19, 2010 -3- provided an update on proactive marketing. Additionally, the EDC was provided with a 2010 First Quarter Cost of Living Update. CITIZEN COMMENTS Chairman Wilmot called for public comments on any subject not on the Commission's agenda for this evening. No one came forward to speak. PUBLIC MEETING An amendment to the 2007 Comprehensive Policy Plan — Eastern Frederick County Long -Range Land Use Plan and the Northeast Land Use Plan. Modifications are proposed for the Developmentally Sensitive Areas (DSA) designation in the vicinity of Route 11 North, to include the removal of areas of DSA and to reflect recently -approved development projects. Action — Recommended Approval Deputy Planning Director, Michael T. Ruddy, reported this item was previously tabled for 60 days by the Planning Commission at their February meeting to allow additional time for the request to be reviewed and evaluated in conjunction with the public meeting held for the Northeast Land Use Plan (NELUP) update. Mr. Ruddy said the meeting was held on April 20, 2010 and was well attended. In general, the overall modifications to the Developmentally Sensitive Areas (DSA) appeared to be well received; there were no comments specific to the modification of the DSA in this area. Mr. Ruddy stated that following the Graystone rezoning application, the Board of Supervisors gave the direction to re-evaluate the DSA in a couple locations. Mr. Ruddy pointed out the specific areas for modification using a PowerPoint map; he said the area modified is generally bounded by Route 37 to the north; Milburn Road to the east; Route 11 to the west; and Red Bud Road to the south. Commissioner Unger inquired about a hatched horseshoe -shaped area on the "DSA - Before" map which was omitted on the "DSA -After" map. Mr. Ruddy replied this was part of a developmentally -sensitive area that was picked up on the original NELUP; he said this area recognizes the Milburne corridor and some additional land previously pointed out with some historical context. Commissioner Oates added that Howard Kittell, Shenandoah Valley Battlefields Foundation's Executive Director, showed this area back in 2001-2002 as a Civil War encampment set up by soldiers preparing for the Third Battle. Commissioner Oates said this area was put in per the Shenandoah Valley Battlefields Foundation. Chairman Wilmot inquired if a stream was located within this area and Commissioner Oates replied no. Chairman Wilmot opened the public comment portion of the meeting and called for anyone wishing to speak. The following person came forward: Frederick County Planning Commission Page 2645 Minutes of May 19, 2010 -4— Mr. William (Bill) Myers, Stonewall District, asked the Commission for additional clarification between the two maps, the "DSA -Before" map and the "DSA -After" map. Mr. Ruddy clarified the modifications for Mr. Myers. the meeting. No one else wished to speak and Chairman Wilmot closed the public comment portion of No further issues or areas of concern were raised by the Commission members. Commissioner Thomas made a motion to recommend approval of the Comprehensive Policy Plan amendment to the Eastern Frederick County Long -Range Land Use Plan and the Northeast Land Use Plan as presented. This motion was seconded by Commissioner Mohn and unanimously passed. BE IT RESOLVED, that the Frederick County Planning Commission does hereby recommend approval of an amendment to the 2007 Comprehensive Policy Plan — Eastern Frederick County Long -Range Land Use Plan and the Northeast Land Use Plan. This amendment includes modifications for the Developmentally Sensitive Areas (DSA) designation in the vicinity of Route 11 North, to include the removal of areas of DSA and to reflect recently -approved development projects. COMMISSION DISCUSSION ROUTE 11 NORTHEAST LAND USE PLAN Deputy Planning Director, Michael T. Ruddy, reported that a public informational input meeting took place on April 20, 2010, which was well attended with 111 community members participating. Mr. Ruddy said the update was generally well supported and public input guided the final draft of the land use plan. Mr_ Ruddy said a particular effort of this study had been to reevaluate the transportation element to ensure it was supportive of proposed land uses. He said this update contains an enhanced transportation network which is functionally acceptable. Mr. Ruddy commented that Frederick County, for the first time, was able to utilize transportation modeling into a small area land use plan; this modeling verified that with minor modifications, the transportation network was balanced with the land use plan. Mr. Ruddy noted there were some modifications to the land uses originally part of the Northeast Land Use Plan (NELUP); those areas were refined and areas of OM (Office Manufacturing) are promoted, which is a relatively, new land use designation proposed by the County to accommodate targeted economic development opportunities. He said there were several locations of OM District designated within this particular area of the plan. Mr. Ruddy stated that Developmentally Sensitive Areas (DSAS) have been evaluated on several occasions. He said this plan emphasizes the DSAS and promotes it within the Red Bud Run corridor area, picking up on the historical properties, the efforts, and environmental land within that vicinity. Mr. Ruddy pointed out that the Comprehensive Plans & Programs Committee (CPPC) evaluated and endorsed this plan. He said discussion occurred specifically on the location of the recently - Frederick County Planning Commission Page 2646 Minutes of May 19, 2010 -5 - rezoned Graystone property. He noted the Land Use Plan proposes this as a primary property for OM District, yet the group recognized the property was recently rezoned to M1 District. He said the CPPC questioned whether the OM designation should be maintained as a future land use or to recognize the recently approved M 1 Zoning designation. Mr. Ruddy believed both were valid paths and the CPPC had discussions in both directions. He said generally, the CPPC favored maintaining the M! as opposed to the OM designation, but any input from the Commission on that topic would be appreciated_ Commissioner Mohn, who chaired the working group for the study and update, stated this was a long process, but it resulted in a good product. He said some of the points about the uses, particularly with the Graystone site, will have to be worked through as it goes through the public process. Commissioner Mohn commented there had been considerable opportunity for input. WATER SERVICE IN THE STEPHENSON AREA Planning Director, Eric R. Lawrence, reported that last Fall, the County received a request to enable an existing residence of the Stephenson area to gain access to a public water line located within their front yard. Mr_ Lawrence said this residence was located outside of the Sewer and Water Service Area (SWSA) and was, therefore, by policy, not permitted to access this public water. Many of the property's adjacent neighbors, while also outside of the SWSA, did have water service. He said the Board of Supervisors ultimately granted the residence access to the water service on November 18, 2009. Mr. Lawrence said that through the Board's deliberations, it was noted that other properties exist that utilize the public water service, but are located outside the SWSA. He said a list of properties located outside the SWSA, but connected to public water, was established. Another list will be created consisting of properties located outside of the SWSA, not utilizing the water service, but with water lines existing on their properties. He said these lists could be considered at a future Board meeting for adoption as an exception to the SWSA, formalizing their policy rights to utilize the water service. Looking first at Frederick County as a whole, Mr. Lawrence said GIS (Geographic Information Services) identified 344 parcels that are traversed by FCSA (Frederick County Sanitation Authority) water lines, yet are located outside of the SWSA. He said preliminary research indicates the water lines predate the County's SWSA policy or had gained individual exceptions. Mr. Lawrence stated that the Stephenson community was evaluated as a prototype, since there are no sewer connections in this area, and staff identified 66 properties which appear to have access to water; 51 of those properties have water meters. Mr. Lawrence said these properties appear to be appropriate amendments to the SWSA policy in the Stephenson area. A policy amendment would deem: the 51 FCSA accounts to be in conformance with County policy; and, the 15 addresses would be appropriate for future water service, should the property owners wish to connect to the service. Mr. Lawrence stated that if the Planning Commission and the Board of Supervisors believe the concept of the SWSA policy amendment is appropriate, the staff will continue the research and cross -record checking with the FCSA to identify all properties outside of the SWSA to determine: 1) properties already utilizing FCSA services; and, 2) properties already adjacent to existing lines, but without FCSA service. Mr. Lawrence pointed out that this process is not to modify the SWSA, but to identify those properties which have current water service and possibly create an opportunity for the Frederick County Planning Commission Page 2647 Minutes of May 19, 2010 Im Board of Supervisors to accommodate them through a formal process and grant them permission to utilize the water service. Commissioner Kriz spoke in favor of establishing a policy, particularly if the water line runs through someone's yard who wants to tap in. He said if a property is adjacent or connects, he was also in favor of some type of policy amendment. Commissioner Triplett asked if the 15 addresses identified were older homes. Mr. Lawrence said only existing homes were identified, not necessarily older. Mr. Lawrence said, in theory, these are small lots that probably could not be built on a private health system because of today's standards. Mr. Lawrence said he would guess they are older, probably constructed between the 1940's and 1950s. Commissioner Triplett was also in favor of establishing a policy for these residences. Commissioner Unger asked for more clarification on the history of how this situation came into being. Mr. Lawrence said that although the history of events was not fully documented, the staff has had discussions with persons who had some knowledge of what took place. Mr. Lawrence said when the lines were installed, a low-interest financing option was available to help pay for the lines; everyone was provided an opportunity to tap in. However, if a home owner tapped in, they accepted an obligation to pay not only the individual tap fee, but to help pay for the installation of the main line. Mr. Lawrence said some owners were not interested in tapping in. Commissioner Unger also agreed the residences with water lines on or near their property should be allowed access. Chairman Wilmot assumed the water line was not put along Jordan Springs Road for the purpose of serving these homes, but was installed for another reason. Mr. Lawrence said it was his understanding that the water line was installed to provide potable water to the residents in that area. Commissioner Crockett asked for confirmation that the 51 residences were connected with the Sanitation Authority for water use only and not sewer. Mr. Lawrence replied this was correct; he said 15 residences were identified that were not connected to the water, but had water lines crossing their property. Commissioner Crockett asked if there was a downside to this situation and Mr. Lawrence replied that one possibility would be that it may set a precedent to other areas of the County. Commissioner Thomas believed that if the water line was running across a homeowner's property, the homeowner should be allowed to tap into it. Commissioner Thomas said the County would have to be cautious where a property contains one existing residence, but has 50 or more acres associated with it. He said the policy should be written in such a way whereby the homeowner is limited to only one connection; he said it should not provide the opportunity to subdivide 20 lots and connect all those lots to public water. Commissioner Thomas suggested the wording be based on recorded lots or housing as of 1990 or 2000 as the number of connections a homeowner would get on the lot. He didn't think it was desirable to have a 300 -house community on one of these properties outside the SWSA simply because a water line crossed it. Mr. Lawrence believed the approach desired by the Board of Supervisors was to document within the Board minutes which properties had permission to tap into the water line. He said as a part of limiting this to one structure, the staff could identify the property identification numbers, along with the actual structure address. Mr. Lawrence said the staff could provide a list of all the properties that have permission to have one residential connection. Mr. Lawrence said the Board is seeking a recommendation for the residences that do have water service and a recommendation for the properties Frederick County Planning Commission Page 2648 Minutes of May 19, 2010 that do not. He said ultimately, if a working concept is established for Stephenson, the staff could apply it to the entire county, with the Board's approval. Chairman Wilmot inquired if the discussion was focused on retail service lines and not major transmission lines. Chairman Wilmot commented about suggesting to the Sanitation Authority that a statement be included within the policy noting there should be no new distribution lines constructed outside of the SWSA. Commissioner Thomas commented that before considering a county -wide policy, the Commission should take a look at what is taking place in the southern part of the County. Mr. Lawrence said the goal is to determine what authorizes FCSA to serve the residences in the Stephenson area that are outside of the SWSA. Mr. Lawrence said this would be included as an adopted policy statement, with a list of all the property owners. Mr. Lawrence said he would forward the Commission's comments to the Board, which included: policy statements for Stephenson may not be appropriate for other locations in the County and it will need to be determined whether or not different policies were needed for different areas, or whether a global policy would suffice; it was logical to specifically identify the properties included; the policy should limit one tap per existing dwelling so that subdividing large properties with water was not pursued; and, future distribution service lines should not be extended for residential use. Commissioner Kriz reported on the following items from the Transportation Committee meeting: 1) Valley Mill Road Truck Restriction — recommended to postpone moving forward until other surrounding area land owners, who are pursuing development, have submitted plans to the Planning Department; 2) Springdale Road Speed Limit Reduction — committee believed a traffic study would most likely not justify a speed reduction; however, staff was directed to investigate signage and confer with appropriate law enforcement personnel; 3) Valley Mill Road Area Alternatives — TIA scoping conducted for the Carriage Park development; this will unofficially be shared with the planning Department to keep all parties abreast of this alternative; 4) Route 37 Update — VDOT representatives reported that the field survey for the centerline has been completed; base maps will be completed this summer; two test sections will be established in late summer, followed by a meeting with county officials; final design of centerline will be completed in 2011; a public input meeting should be held in 2011; 5) 2010 Revenue Sharing Application — forwarded to the Board of Supervisors and includes $400,000 for improvements on the northern end of Route 11; $600,000 for the Valley Mill area; matching proffers are available for both projects. CITIZEN COMMENTS Chairman Wilmot called for public comments on any subject not on the Commission's agenda for this evening. No one came forward to speak. PUBLIC HEARING Rock Harbor Amendment to the Round Hill Community Land Use Plan. An amendment to the 2007 Comprehensive Policy Plan, Chapter 6, Land use, to update the Round Hill Land Use Plan which includes an expansion of the Sewer and Water Service Area (SWSA) by approximately 265 acres. The amendment establishes a new area of land use that promotes the recreational and open space attributes of this area and supports a well-designed conference facility and commercial center, with a limited amount of accessory residential opportunities and an orientation to the golf course and future Route 37 Interchange. The area is generally located west of Route 37 and south of the Winchester and Western Railroad in the Back Creek Magisterial District. Action — Recommended Approval Deputy Planning Director, Michael T. Ruddy, reported this is a Comprehensive Plan amendment request which has been discussed by the Planning Commission and the Board of Supervisors on multiple occasions over the past year. This request entails the inclusion of the 260 -acre Rock Harbor Golf Course into the Sewer and Water Service Area (SWSA). Mr. Ruddy said the property owner had requested something that would accommodate a proposed conference facility, extended stay residential, and commercial land uses, with some accessory residential. He said the Board of Supervisors directed the Frederick County Planning Commission Minutes of June 2, 2010 -3 - Planning Commission and staff to move forward with an evaluation of this request. Mr. Ruddy said the guiding principles of the request revolve around establishing a new area of land use that does indeed promote the golf course, the recreational attributes of this area, and also creates a well-designed recreation and conference facility with some accessory residential and commercial land uses. He pointed out the land use plan identifies a new land use designation and it also addresses important community facilities, including transportation, water and sewer infrastructure, and overall design of any potential project appropriate for this land use area. Mr. Ruddy continued, stating that one of the key themes within the land use plan is a proposed balance of land uses which includes the recreational, open space, commercial, and membership components. Within the land use text, definitions are added to each area which are quite flexible. There is a balance of land uses and those uses are quite flexible at this time. He added that the proposed area of land use fits in nicely with the existing Round Hill Community Land Use Plan and provides an important connection between the Round Hill Land use Plan and the recently -approved West Jubal Early Land Use Plan, with the focus and orientation being on the future Route 37 Interchange in this location. He also noted that the area known as the Robinson tract was additionally brought in to the request. Mr. Evan A. Wyatt, with Greenway Engineering, was representing the Rock Harbor Golf Course and the Perrys, the owners of the property. Mr. Wyatt said the Perrys bad two goals in mind: the opportunity to place a conference facility that would be appropriate for the community as a whole, and secondly, to make sure there were land uses that could continue to sustain Rock Harbor as a golf course. He said the balance of land uses described by the staff is an interesting concept and a unique plan in that it provides for a variety of large and small-scale commercial uses, as well as extended stay lodging, and restaurant and retail expansion for the golf course, as well as accessory residential. The type of residential anticipated is gated age -restricted and membership based. Mr. Wyatt said these were the types of things that keep the golf course going. He said the Perrys do not want to see the golf course recycled over time. Mr. Wyatt next commented about the opportunity to do gray water application, since this will be a 60% minimum open space project, which could take some of the burden off the sewer system. He said the Commissioner of Revenue would have the ability by Code to assess the 60% open space at the current land value tax rate; however, the areas defined for the conference center, the extended stay lodging, the restaurant, the retails, etc. would clearly be assessed at the retail/restaurant/lodging rate. He said they were pleased the Board endorsed moving this forward to public hearing with the extension of the SWSA because in order to actively market this and have the right partners in place, it was important to show that the County is committed, by policy and by water and sewer potential, to make this a reality. Mr. Wyatt said that throughout this process, the Planning Staff has been particularly accommodating and as the language has been crafted, concerns were identified and sent through committee. He said one item in particular mentioned by staff was the flexibility of land uses. He said the applicants agree and want to make sure there is flexibility to implement this plan. Mr. Wyatt said the percentages established, 60% open, 30% commercial, and 10% accessory membership/residential, seem to be a good balance and has the golf course remaining as the primary use; there is a major commercial component and some minor residential. Mr. Wyatt believed a little better flexibility could be provided if the language could be revised to state there is an expectation that a commercial component could be developed in advance of accessory residential. This would give the Perrys flexibility to do some of the commercial ventures and possibly some accessory residential, with the conference facility later, if they are not quite ready. Mr. Wyatt said they have yet to go through the ordinance process, so the percentages, the timing, the sliding -scale percentages, etc. all need to be discussed, developed, and resolved. Frederick County Planning Commission Page 2652 Minutes of June 2, 2010 -4 - Mr. Wyatt said what they are hoping will come out of this Planning Commission meeting tonight is a favorable recommendation for the expansion of the SWSA and the endorsement of the language as written with the one minor adjustment that requires a commercial center upfront, but not necessarily the conference facility. Commissioner Unger asked Mr. Wyatt if he anticipated the commercial to be either a motel or restaurant. Mr. Wyatt said that according to the Commissioner of Revenue, the extended stay lodging package would be assessed at commercial value, similar to a hotel. Mr. Wyatt said there is also a desire to expand the restaurant and retail facility, which would be taxable to the County and revenue - generating to the County. He said this commercial expansion would be to try to sustain what Rock Harbor is looking for, which is income to keep the golf course moving. Mr. Wyatt said they are not suggesting a 2,000 square foot addition and entitlement to all of the residential, but want to work at these ideas at the ordinance level. Commissioner Unger believed the applicant should be allowed a certain percentage of residential prior to the conference facility, in order to get the project rolling. Mr. Wyatt said he was not in favor of placing percentages of uses in the Comprehensive Policy Plan, but he was hoping for a statement guiding in that direction. Commissioner Thomas asked Mr. Wyatt what language in particular he was concerned about. Referring to Page 2, under Balance of Land Uses, Mr. Wyatt said he was comfortable with the percentages created for the types of land uses, however, under commercial, there is a statement that the conference center shall be in place prior to the commencement of accessory residential land use. Mr. Wyatt believed it may be difficult to deliver that immediately and, possibly prolong the second part of what Rock Harbor is trying to do, which is land uses that can sustain the golf course community as a whole. Mr. Wyatt said language exists in the body of the text that clearly points to the conference facility, so he didn't think if it was removed from this particular section it would get lost in the plan. He suggested that if the Commission wasn't comfortable eliminating it, it could be stated it was expected that commercial components be in place prior to the commencement of accessory residential. Mr. Wyatt preferred the policy not mandate that the first thing out of the box had to be the conference facility. Chairman Wilmot affirmed that everyone is indeed excited about the idea of a conference facility. She said one of the things that could help the cause is some definition of what a conference center is. She said many hotels call themselves a conference center, but in actuality, they are not. Chairman Wilmot next opened the public hearing and called for citizen comments. No one came forward to speak and Chairman Wilmot closed the public comment portion of the hearing. Chairman Wilmot inquired of the staff if the Board's direction was whether this would become an overlay or a totally new district. Mr. Ruddy replied that the Board endorsed what was presented in the implementation, which was the creation of a new zoning district designation. He said it may be termed an overlay, but it would be something new to accommodate this balance of land uses. Commissioner Oates pointed out that when the Commission discussed this last fall, the Executive Director of the Sanitation Authority spoke out about concerns regarding the process of getting sewer up through here and getting the neighbors and developers to work together. He said there was no one present this evening from the Sanitation Authority or no correspondence received. Mr. Ruddy said the Sanitation Authority has certainly been involved with this process all the way through. Mr. Ruddy said at the Board of Supervisors' discussion, they talked about the need for regional cooperation in this area and for this particular project, just like other projects, to participate in the regional planning and Frederick County Planning Commission Page 2653 Minutes of June 2, 2010 -5 - assume some responsibility for implementation. Mr. Ruddy said in recognition of the big picture of things, there is the ability to provide water service in sufficient supply, but there was work to be done on the actual implementation. Mr. Ruddy said the way in which the language is set up, under community facilities in particular, it states that it is essential to ensure that the infrastructure and facilities are provided in a timely and coordinated manner, which would be done through the rezoning of projects in this particular area. He said the policy language will make sure projects do indeed participate and fit into the big picture of water and sewer in this area. Commissioner Thomas asked what the next step would be, if this amendment passes and becomes a part of the zoning ordinance; he inquired if the staff had considered a definition for a conference center facility. Commissioner Thomas suggested that if this goes forward and the DRRS begins to consider the ordinance amendment, it may be beneficial for those involved to make a trip to the fish/wildlife conference center just north of Shepherdstown, which is a conference center/museum. He said they have about 20 separate conference facilities that could hold about 100-200 people. He said it was on a large scale, but was more of a rustic, recreational conference center facility with a cafeteria, restaurant, and minimal residential. Mr. Ruddy explained the next step would be for the DRRC to develop standards and criteria before this is implemented. Mr. Ruddy said when this was first presented, everyone had a similar vision in mind and it would need to be ensured this was well written into the future zoning designation accommodating this land use. Mr. Ruddy said this was approached as a SWSA expansion, recreational/commercial opportunity, not predominantly residential. Mr. Ruddy said the conference facility was clearly thought of being something other than a hotel with a meeting room. He added that while the land use plan and text is quite flexible, it still guides into a direction of a more specific zoning designation. Commissioner Thomas said there were some deliberations when the committees and the Commission were considering the Medical Support Overlay District and whether it should be specific for one development or made more generic so it could be used in other areas of the County. He said this is something to consider with this district as well. Mr. Ruddy agreed. He said the zoning designation could be applied elsewhere; however, the approach with this particular land use plan within Round Hill does tie it into a particular area. Commissioner Mohn referenced the balance of land uses and he asked the staff if the wording for the commercial might be more generalized. He said there is still the expectation that some degree of commercial development may precede the accessory residential, but not necessarily the conference facility. Commissioner Mohn believed the conference facility is clearly identified as an expectation in the body. He said when we call out for the conference facility specifically as a precedent to other uses, it doesn't feel quite as flexible. Mr. Ruddy replied the two main goals of this land use plan are to establish a new area of land use and secondly, to create a well-designed conference facility integrated with commercial land uses; he thought it was important to maintain the emphasis on the conference facility. Commissioner Unger was in favor of some initial commercial and residential development. He suggested that percentages be placed on the residential and commercial development completed and when that percentage is reached, the conference center would have to be started. Frederick County Planning Commission Page 2654 Minutes of June 2, 2010 S. Commissioner Thomas commented that the construction of a conference center is not going to be an inexpensive undertaking. He said to make this workable, flexibility should be provided and the language refined possibly to state the conference facility needs to be commenced prior to 50% of the residential land uses. He said the developer will need some cash flow to be able to construct the conference center. The question is how to make this economically viable for the developer so the County will get something it can be proud of, as well as be a benefit to the community. He said if the goal is to have a magnet area to draw conferences from a broad area, the facility will have to be done well so it can attract the clientele needed to make it economically viable. Commissioner Thomas believed the language needed to be a little more flexible to achieve this goal. Commissioner Crosen concurred with the previous views and he also thought there needed to be flexibility, especially because of the financial side. He said everyone wants to see the conference center, but there must be the ability to attract the clientele. He thought some vibrancy surrounding the conference center and some growth orientation will make the project better off. Mr. Ruddy said one approach then, would be to forward the existing language to the Board along with alternative language containing greater flexibility. A consensus of the Commission indicated that everyone was in favor of more flexibility regarding the conference center. Commissioner Unger made a motion to recommend approval of the Rock Harbor amendment to the Round Hill Land Use Plan with some flexibility included regarding the construction of the conference center and with the expansion of the SWSA_ This motion was seconded by Commissioner Crosen and was passed by a majority vote. BE IT RESOLVED, that the Frederick County Planning Commission does hereby recommend approval of the Rock Harbor amendment to the Round Hill Community Land Use Plan with the inclusion of flexibility within the language regarding the construction of a conference center. Winchester Regional Airport: We determined that the proposed tower does not penetrate any FAR Part 77 surfaces; therefore a tower located at the proposed site should not impact current or future operations at the Winchester Regional Airport. Our comment is based on information submitted for a determination study completed by the Federal Aviation Administration, Aeronautical Study Number 2009 -AEA -3776 -OE dated December 23, 2009. If at any time the tower height exceeds 150 AGL, the Winchester Regional Authority requests the following condition be met: Towers over 200 feet AGL, are required by FAA to be lighted. For towers between 150 and 199 feet AGL, the Winchester Regional Airport is requiring all structures to be marked and lighted in accordance with FAA Advisory Circular 70/7460-1K, Change 2. Please note on the determination study, that any variation from the information submitted by your firm for review would require a separate notice to the FAA. In addition, the determination does include temporary construction equipment such as cranes, derrick, etc., which may be used during construction of the structure as long as the equipment does not exceed the 99' AGL height submitted. Should temporary construction equipment exceed that height, a separate notice to the FAA must be filed. This comment should be included on the building plans to ensure the contractor meets this Federal regulation. Planning and Zoning: The 2007 Comprehensive Policy Plan of Frederick County ("Comprehensive Plan") provides guidance when considering land use actions. This proposed 95 -foot commercial telecommunication facility is located on property on the eastern side of Front Royal Pike (Route 522) adjacent to the Tasker Woods Land Use Plan. The Comprehensive Plan identifies this area of the County for development of business/industrial and residential land uses. The properties immediately adjacent to this proposed CUP are currently zoned RA (Rural Areas) Zoning District, and are not part of any land study. This proposed commercial telecommunication facility will be positioned to provide the existing and future land uses in this area of the County with telecommunication needs. The Frederick County Zoning Ordinance allows for commercial telecommunication facilities in the RA (Rural Areas) Zoning District with an approved Conditional Use Permit (CUP). The zoning ordinance requires that all proposed telecommunication facilities may be subject to additional performance standards in order to promote orderly economic development and mitigate the negative impacts to adjoining properties, residential properties, land use patterns, scenic areas and properties of significant historic values. There are no properties of significant historical value or any historical sites adjacent to this proposed use. The applicant has provided an inventory of existing telecommunication facilities and possible co -location structures in this area, and produced adequate documentation that those existing facilities were unsuitable for the proposed use. Conditional Use Permit #04-09 (CUP#04-09) for a telecommunication facility located at 170 Marcel Drive (Eastgate Commence Center), approved by the Board of Supervisors on September 23, 2009, is the nearest telecommunication facility on which they may collocate. The owner (FAA) of the telecommunication tower declined to allow this applicant to collocate on their tower. One of the conditions placed on CUP# 04-09 is that the tower shall be available for collocating public use wireless services providers, but not necessarily private services providers. STAFF CONCLUSIONS FOR THE 07/21/10 PLANNING COMMISSION MEETING: This is a request to seek approval for the construction of a 95 foot monopole telecommunication tower. Should the Planning Commission find this use appropriate, Staff would suggest the following conditions be placed on the CUP: All review agency comments and requirements shall be complied with at all times. 2. The tower shall be available for collocating personal wireless services providers. 3. A minor site plan shall be approved by Frederick County. 4. Shentel would propose a 10 ft extension to your pole if possible or would ask for a co -location opportunity below your installation. North Armel Site Shentel is proposing to build a PCS cell site off of US Highway 522, Front Royal Pike. The proposed site will mainly provide coverage on the aforementioned highway and provide capacity to existing and upcoming residential areas / subdivisions in the northeast part of Stephens City. Furthermore, business establishments near Hwy 522 -Tasker Road (like Home Depot Distribution Center, Storage Solutions, Comcast Digital Cable), small commercial businesses along Warrior Drive -Tasker Road, Armel Elementary School, and the Federal Bureau of Investigation office in Marcel Drive are seen to benefit to the additional coverage and capacity that this site will bring. The proposed PCS site (Site Number: WA09SH532C) referred to as "North Armel" is located at coordinates: Latitude: 39° 05' 11.36" N and Longitude: 780 08' 52.99" W_ The site address is 2839 Front Royal Pike, Front Royal, VA 22602. The PCS antennas will be installed in the proposed 95 -ft monopole. The RF signal strength simulation study shows that the minimum height required for antenna deployment at this location to meet the coverage objective is 95 feet; a height lower than this would result in less than the desired signal strength because of the terrain and clutter limitations. The loss in signal strength occurs because of the fact that the radio frequency signals, in general, are very susceptible to objects in their path such as buildings, trees & foliage and vehicles etc. In addition, RF signals degrade in strength as distance increases between transmit and receive antennas even when there is no obstruction present in the path between the antennas. The result of RF signal strength simulation is shown in the plots enclosed. The RF simulation map labeled as "Coverage of Existing Sites without Site 532C" shows the current covered area. The RF simulation map labeled as "Coverage of Existing Sites with Site 532C" shows coverage from the proposed PCS site when the antennas are deployed at a height of 95 ft above ground level (AGL) along with the coverage from existing Shentel sites in the neighboring places. Shentel complies with all FCC guidelines and standards for Radio Frequency (RF) emissions. Shentel will operate, maintain and monitor this PCS cell site under the rules and guidelines of the FCC. In conclusion, it is evident from the RF simulation maps that this PCS cell site would provide additional coverage and capacity to residential and commercial structures surrounding it. Considering the purpose and extent of the site coverage, the RF engineers at Shentel recommend that a PCS site with antenna located at a minimum height of 95 ft AGL be built at the proposed site location. REVIEW EVALUATIONS: Virginia Department of Transportation: The application for a Conditional Use Permit for this property appears to have little measurable impact on Route 11, the VDOT facility which would provide access to the property. Prior to operation of the facility, a low volume commercial entrance must be constructed to our standards to allow for safe egress and ingress of the property and positive drainage. Any work performed on the State's right-of-way must be covered under a land use permit. The permit is issued by this office and requires inspection fee and surety bond coverage. Frederick County Fire Marshall: No comments. Inspections Department: Structure shall comply with The Virginia Uniform Statewide Building Code and Section 312, use group U (Utility and Miscellaneous) of The International Building Code 2006. The tower shall be located and equipped with step bolts and ladders so as to provide ready access for inspection purposes. The tower shall not cross or encroach upon any street or other public space, or encroach upon any privately owned property without written consent of the owner of the encroached -upon property. (See 3108.2, Location and Access.) Special instructions per Chap 17 IBC 2006 apply to this structure. Plans submitted for review shall be sealed by a Virginia Registered Design Professional. Winchester Regional Airport: We determined that the proposed tower does not penetrate any FAR Part 77 surfaces; therefore a tower located at the proposed site should not impact current or future operations at the Winchester Regional Airport. Our comment is based on the determination study completed by the Federal Aviation Administration, Aeronautical Study Number 2009 -AEA -383 -OE dated May 5, 2009. If at any time the tower height exceeds 150 AGL, the Winchester Regional Authority requests the following condition be met: Towers over 200 feet AGL, are required by FAA to be lighted. For towers between 150 and 199 feet AGL, the Winchester Regional Airport is requiring all structures to be marked and lighted in accordance with FAA Advisory Circular 70/7460-1K, Change 2. Please note on the determination study, that any variation from the information submitted by your firm for review would require a separate notice to the FAA. In addition, the determination does include temporary construction equipment such as cranes, derrick, etc., which may be used during construction of the structure as long as the equipment does not exceed the 120' height submitted. Should temporary construction equipment exceed that height, a separate notice to the FAA must be filed_ 'this comment should be included on the building plans to ensure the contractor meets this Federal regulation. Historic Resources Advisory Board: The Frederick County HRAB considered this Conditional use Permit proposal during their meeting on June 15, 2010. The HRAB reviewed information associated with the Frederick County Rural Landmarks Surveyport and the Virginia Department of Historic Resources, as well as information provided by Greenway Engineering. The Study of Civil War Sites in the Shenandoah Valley, published by the National Park Service, shows that this site is located in the core area of the Second Battle of Winchester and the study area of Third Winchester. While this property is located within an area identified as having lost integrity, the area directly behind this site is identified as core area for the Second Battle of Winchester that has retained its integrity. In addition to these concerns, the HRAB noted that the home located at 2042 Martinsburg Pike was built in 1947. As it is older than fifty years in age, the structure should be documented and a DHR survey should be completed. Ultimately, the HRAB was concerned about the visual impact of the tower on the core battlefield area and felt that the tower, which is proposed to serve the FEMA development across the street, should be located on the roof of the FEMA building or on the FEMA site. The HRAB expressed a preference for a monopole telecommunication facility over a lattice facility such as has been proposed. It was suggested that monopole facilities with limited microwave dish mountings (due to the size of the microwave fixtures) would minimize visual disruption to the historic battlefield viewshed. The HRAB does not support this request because of its visual impacts on the historical character and significant Civil War battlefields in the area. As in the 2009 review of a CUP for the same site, the Board continues to recommend that the applicant document the dwelling at 2042 Martinsburg Pike, complete the DHR survey, and assure that the home remains intact. Planning and Zoning: The 2007 Comprehensive Policy Plan of Frederick County ("Comprehensive Plan") provides guidance when considering land use actions. This proposed 120 foot lattice -type commercial telecommunication facility will be located on properties located within the Northeast Land Use Plan (NELUP). One of the primary objectives of NELUP calls for the development of industrial and commercial use along the Route 11 north corridor. The properties are located within the Sewer Water Service Area (SWSA) and outside the Urban Development Area (UDA) as indicated in the 2007CoMprehensive Policy Plan of Frederick Coun The applicant applied for a Conditional Use Permit (CUP # 01-09) for a 120 foot monopole commercial telecommunication facility to be located on these properties, and was denied by the Board of Supervisors at their meeting held on May 13, 2009. The denial was based on the location of the proposed facility within a Developmentally Sensitive Area (DSA) and the surrounding historical sites, as noted in the 2007 Frederick County Comprehensive Policy Plan. The Board of Supervisors at their June 9, 2010, meeting updated the NELUP component of the Comprehensive Plan and modified the DSA in this area of the NELUP. The properties that are subject to this proposed. CUP were removed from the DSA. The Frederick County Zoning Ordinance allows for commercial telecommunication facilities in the RP (Residential Performance) Zoning District with an approved Conditional Use Permit (CUP). Commercial telecommunication facilities may be subject to additional performance standards in order to promote orderly economic development and mitigate the negative impacts to adjoining properties. These performance standards are to ensure that scenic areas and properties of significant historic values are not negatively impacted. In addition to these performance standards, the zoning ordinance requires that all proposed telecommunication facilities shall be of a monopole -type construction. The applicant has applied for a Conditional Use Permit for a 120 -foot lattice -type commercial telecommunications facility on the above - referenced properties. The Planning Commission may allow a lattice -type telecommunication tower provided that tower is located outside the UDA and not adjacent to identified historic sites. The general surrounding area of this proposed site contains sites of significant historical importance, which include the Hackwood property, established residential areas, and the Milburn Page 5 Conditional Use Permit 905-10 AT&T, Melissa Hall & Wesley Helsley, and Bradley Pollack July 6, 2010 Road corridor. The Hackwood property and the Milburn Road corridor are less than 1 1/2 miles from this proposed commercial telecommunication facility. Furthermore, the subject properties of this proposed commercial telecommunication facility will be located within the core area of the Second Battle of Winchester Civil War Battlefield historic site, and the study area of the Third Battle of Winchester. Frederick County has traditionally set a higher expectation for land use actions with regard to properties that are located within the vicinity to historic sites. The Frederick County Historic Resources Advisory Board (HRAB), as referenced above, reviewed this application and had concerns. The HRAB had the most concern with the visual impact of this proposed facility on the core battlefield area of the Second Battle of Winchester and the study area of Third Winchester. The HRAB expressed a preference for a monopole telecommunication facility with limited microwave dish mountings over a lattice facility. The HRAB also recommended that the applicant locate this facility on property located on the 150 acre industrially and commercially zoned Rutherford Farm development, which includes a multistory office building, commercial center, and vacant properties. This development may provide satisfactory coverage for this applicant and future co -location opportunities in this area of Frederick County. STAFF CONCLUSIONS FOR THE 07/21/I0 PLANNING COMMISSION MEETING: This is a request to seek approval for the construction of a 120 foot lattice -type commercial telecommunication facility. Staff would note that the proposed site does meet the requirements as set forth by the zoning ordinance for a lattice -type facility. However, as with the previous application, this facility will have an impact on adjacent historical sites. Therefore, a monopole - type facility may be appropriate to mitigate any impacts to the historical sites, and service the applicants' needs and the future needs in this area of the County. Planning Commission approval is needed for a lattice -type facility. Should the Planning Commission find a lattice -type facility to be inappropriate, the CUP is required to be for monopole -type construction or denied as presented. Should the Planning Commission find this use appropriate, Staff would suggest the following conditions be placed on the CUP: 1. All review agency comments and requirements shall be complied with at all times. 2. The tower shall be available for collocating personal wireless services providers. ;. A minor site plan shall be approved by Frederick County. 4. Prior to site plan approval, properties must be consolidated. The purpose of this study is to provide the analysis required by the local Zoning Ordinances to obtain a Conditional Use Permit for the proposed telecommunication tower. Comsearch performed a database search from multiple sources including the Federal Communication Commission (FCC) Universal Licensing System (ULS) and Antenna Structure Registration (ASR), a database of the top ten tower owners in the United States, and the Comsearch databases of all microwave and land mobile radio (LMR) commercial telecommunications systems licensed for operation in the United States. The database search determined that there were 4 commercial communication facilities registered within a 1.0 mile radius of the proposed AT&T tower. Table 1 identifies the communication facilities and lists their pertinent parameters including service, frequency band, FCC Call Sign, latitude and longitude, antenna height and licensee. Figure 1 shows the location of these communication facilities with respect to the proposed AT&T tower. The on-site evaluation also focused on the area within a 1.0 mile search radius of the proposed AT&T facility. The results of the on-site physical visit are contained in Figures 2 — 5 for the database identified facilities. Figures 6 and 7 provide documentation for two additional facilities determined during the on-site visit and Figure 8 indicates the location of these additional communication facilities with respect to the proposed AT&T tower.. Notes are provided with each figure identifying the type of tower and a determination concerning the viability of the existing facility to support the proposed AT&T communication requirements. This determination is based on a number of criteria including 1) the ability of the tower to adequately support the proposed 6' microwave antenna, 2) the sufficient height of the existing tower to support the planned AT&T microwave link, and 3) proximity to the AT&T facility where the required communication must terminate. The results of this analysis determined that there are no existing commercial communications facilities present within a 1.0 mile radius of the proposed AT&T 120' height tower that will support the requirements of AT&T. The proposed AT&T tower is required to support a highly reliable point-to-point microwave path between the AT&T facility and a location on Mount Weather, which is in excess of 16 miles away in a direction of approximately 132 degrees from true north. The proposed tower will be required to support at minimum a 6' solid parabolic antenna. None of the identified existing communication facilities will meet the stringent requirements of AT&T.
