Planning Commission and the Board of Supervisors to assist them in making a decision on
this request. It may also be useful to others interested in this zoning matter.

EXECUTIVE SUMMARY:
This is a request for a Retail Nursery. Extension of the existing Horton Nursery on Route 522
South.
Should the Planning Commission find this use appropriate, Staff would suggest the following
conditions be placed on the CUP:
1. All review agency comments and requirements shall be complied with at all times.
2. An engineered site plan shall be submitted to, and approved by, Frederick County and shall
identify uses on the subject parcels, 76-A-61, 76-A-62, 76-A-63, 76-A-64 and 76-A-65, prior
to any business activities occurring on the parcels.
3. One non -illuminated, freestanding business sign shall be allowed on the property; the sign
shall be limited to 25 square -feet in area. The sign shall not exceed ten (10) feet in height.
4. Any storage of heavy equipment shall take place within an enclosed structure.
Eighteen employees are permitted between the months of April, May, and June, while the
remainder of the time, the site shall have no more than six employees.
6. Approval of this CUP will void CUP #06-06.
7. Any expansion or change of use will require a new Conditional Use Permit.
Following the requisite public hearing, it would be appropriate for the Planning Commission
to offer a recommendation concerning this application to the Board of Supervisors.

PROPOSED USE: This application is for an expansion of a retail nursery.
REVIEW EVALUATIONS:
Virginia Department of Transportation: The following comment is from Greg Hoffman of
VDOT, dated June 7, 2011: I have discussed the issue with Mr. Ingram concerning leaving a
break in the fence on Lot 75-A-61 to separate the residential from the commercial uses. There
will have to be a fence and gate erected to separate the two uses. There must not be any
commercial use of the residential entrance on Route 522. This will need to be shown on the
engineered plans that will be submitted.
The following comment is from Greg Hoffman of VDOT, dated May 12, 2011: The
application for a Conditional Use Permit for this property appears to have a measurable impact
on Route 522 South and Route 760, the VDOT facilities which would provide access to the
property. We have the following comments: Route 522: Access to Lot 76-A-61 from Route
522 must be restricted to residential use only. Commercial traffic must utilize an interparcel
connection between Lot 76-A-61 and Lot 76-A-62. Owner must demonstrate segregation of use
between commercial and residential traffic on Lot 76-A-61 by a wall or fence with no access to
Route 522. If this is not possible, the entrance on Route 522 must be removed and all traffic for
Lot 76-A-61 must utilize an interparcel connection with Lot 76-A-62. Route 760: It is
recommended that access to Lots 76-A-64 and 76-A-65 be provided by an interparcel connection
from Lot 76-A-63. Existing entrance on Lot 76-A-63 must be upgraded to meet VDOT
standards for a low volume commercial entrance and a ditch line or a fence installed off VDOT
right-of-way to limit egress/ingress to properties along Fires Loop Road in front of these lots. If
interparcel connectivity cannot be achieved, a low volume commercial entrance(s) shall be

installed to Lots 76-A-64 and/or 76-A-65. Plans showing improvements on VDOT right-of-way
to Route 522 and Fries Loop Road must be submitted to VDOT for review and approval. A
VDOT Land Use Permit will be required for any work performed on the VDOT right-of-way.
Frederick County Fire Marshall: Emergency vehicles need to be able to get in and out.
Frederick County Inspections: No comment required; no structure proposed.
Frederick County Department of Public Works: No comments at this time
Frederick County Sanitation Authority: NIA
Frederick -Winchester Health Department: No material of any kind (trees, stone, soil,
evergreens, etc.) may be stored on or within ten feet at: existing drainfield, reserve area, any and
all septic system components, including but not limited to treatment unit, septic tank, pump tank,
conveyance line, force main, sewer line, etc. No equipment may be used on those areas, and no
road (temporary or permanent) may cross or bisect any portion of the septic system and above
mentioned components. (This includes the reserve area.)
Planning and Zoning: The current retail nursery is located on parcel 76-A-62, a 5.57+/- acre
tract of land, which was approved via CUP #06-06 on September 27, 2006. This use currently
has 18,400 square feet of showroom, and 18,900 square feet of greenhouse area. A nursery stock
area is placed behind the greenhouse structure, extending to the rear of the property. This
property was cited with a zoning violation for expanding this use beyond the limits set forth by
CUP #06-06. CUP application #06-11 is intended to resolve the zoning violation.
This Conditional Use Permit (CUP) will encompass parcels 76-A-61, 62, 63, 64 and 76-A-65
with a total acreage of 11.07 +/- acres in size. Prior to operation of the retail nursery on this
expanded area, an engineered site plan will be submitted to, and approved by, Frederick
County. This site plan will address all of the requirements of the Frederick County Zoning
Ordinance as well as the uses on the above referenced parcels. All heavy equipment will be
stored within an enclosed structure. Staff would recommend that that no new signage be
permitted; signage to be limited to one (1) non -illuminating, freestanding business sign no higher
than ten (10) feet and a maximum of twenty-five (25) square feet is area. This requirement is in
keeping with the rural nature of this area and preventing a typical commercial strip along the
eastern side of Front Royal Pike (Route 522).
The 2007 Comprehensive Policy Plan of Frederick County ("Comprehensive Plan") and future
comprehensive plans provide guidance when considering any land use actions. This proposed
use is located on property identified within the Comprehensive Plan to remain rural and is not
part of any land study. The properties immediately adjacent to this proposed CUP are currently
zoned RA (Rural Areas) Zoning District. It appears that this CUP meets the intent of the goals

EXECUTIVE SUMMARY:
Phis is a request to expand on existing Country Store (CUP #15-01) to enable a restaurant.
Should the Planning Commission find this use appropriate, Staff would suggest the following
conditions be placed on the CUP:
1. All review agency comments shall be complied with at all times.
2. An engineered minor site plan shall be required for the future accessory structure.
3. Maximum height of freestanding sign shall be six feet.
4. Maximum size of a freestanding sign shall be 25 square feet.
5. No internally illuminated signs shall be allowed outside of the building.
6. Maximum size of a building -mounted sign shall be ten square feet.
7. Dumpsters shall be completely enclosed by an opaque fence with a minimum setback of 15
feet from the property line.
8. No more than 26 seats allowed for this restaurant use.
9. Parking shall only be permitted behind the structure.
10. No petroleum sales shall be allowed.
11. Any expansion or change of use shall require a new Conditional Use Permit.

Other Code that applies is ICC/ANSI Al 17.1-03 Usable and Accessible Buildings and Facilities.
Accessible restroom shall be provided within employees work area. All required egress doors
shall be accessible and 50% of the entrances.
Frederick County Department of Public Works: No comments at this time.
Frederick County Sanitation Authority: We do not serve this area.
Frederick -Winchester Health Department: As mentioned in our previous meeting, if the
conditional use is issued, please apply for the health permit and plan review for the added food
service. The Health Department has no objections to the change of use and will continue to work
with the owner/operator to obtain a health permit with minor additional to the facility (mostly
sinks & lighting).

Winchester Regional Airport: Since the Conditional Use Permit does not appear to have any
impact on the operations of the Winchester Regional Airport, we have no objections or
comments regarding this request.
City of Winchester: No comments.
Planning and Zoning: This property was approved for a country general store in 2001 via CUP
#15-01. The country store is operating within a two-story, eight -room, 2,448 square foot stone
and log structure. One of the conditions assigned to CUP #15-01 was the prohibition of the sale
of petroleum products as well as restaurant or deli operations. The applicant is requesting to
expand this country store to allow a 26 -seat restaurant and a photo gallery. The photo gallery will
initially be located on the 2nd floor of the structure, and will ultimately be relocated to an
accessory structure in the future. The applicants stated their desire to maintain the historic
integrity of the structure and property.
The Frederick County Zoning Ordinance allows for country general stores in the RA (Rural
Areas) Zoning District. The 2007 Comprehensive Policy Plan of Frederick County and future
comprehensive plans provide guidance when considering any land use actions. This property is
located within the UDA that identifies this area of the County for high density planed growth. It
appears that this CUP meets the intent of the goals of the 2007 Comprehensive Policy Plan of
Frederick County.
STAFF CONCLUSIONS FOR THE 07/06/11 PLANNING COMMISSION MEETING:
Should the Planning Commission find this use appropriate, Staff would suggest the following

At the July 6, 2011 Planning Commission meeting, staff will present the site plan for the Frederick
County Public Schools Transportation Facility to the Planning Commission for review.
Customarily, projects involving public facilities are brought before the Planning Commission prior
to site plan approval. A representative of the Frederick County Schools and OWPR, Inc. will be
present during the Planning Commission meeting.
The new transportation facility will be located off of Front Royal Pike (522 South) behind the
existing Armel Elementary School in the Shawnee Magisterial District. Site improvements include
the following:
* Administration building, maintenance building and wash building
a School bus parking area and future bus parking expansion areas
® Summer school bus storage area
OD Vehicle parking area and future parking expansion areas.
Action on the site plan is not required, but comments from the Planning Commission are welcome.
A smaller version of the site plan is attached for your information. Please contact me if you would
like to see the full version, or if you need any additional information.

The Planning Department received one Comprehensive Policy Plan Amendment (CPPA) request by
this year's June 1, 2011 deadline.
CPPA #01-11, 'Tasker Road - Parcel 86 — 11.35 acre change in Land Use Classification
from Institutional to Residential. The property is located on the east side of Tasker Road and
north of Rutherford Lane, approximately 0.7 miles south of I-81 exit 310 interchange in the
Shawnee Magisterial District.
In previous years, the Board of Supervisors has held a joint work session with the Planning
Commission to discuss the Comprehensive Policy Plan Amendment applications received. As there
is only one request this year, we will address this request differently by holding a discussion on the
request at regularly scheduled Planning Commission and Board of Supervisor meetings. Following
the Commission's discussion, the Board will then determine if this request warrants additional study
and formal action through the public hearing process.
Therefore, CPPA#O l -11 is presented to the Planning Commission as a discussion item at your July 6,
2011 meeting.
The Comprehensive Plans and Programs Committee reviewed this request at their June 13, 2011
meeting and recommended that this CPPA request is incorporated into the Eastern Frederick County
— Senseny Road Land Use Study by way of an adjustment in the study boundary to pick up this
property. It is anticipated that the study of this property and the broader study would have occurred
in a similar time frame.
The Applicant has requested that this request is considered independent of the study effort.

Comprehensive Policy Plan Amendment
Tasker Road, Parcel 86
Tax Map Parcel 75-A-86 of 11.4 acres lies on the east side of Tasker Road and north of Rutherford Lane,
approximately 0.7 miles south of the 1-81 interchange 310. Water and sewer lines are within close proximity.
The site is bounded by commercial uses to the north and residential uses to the east. The lands to the south,
across Tasker Road, are vacant but zoned residential.
Currently, the comprehensive plan classifies the northern portion of this site as institutional, a designation
that extends to the north onto the Agape church site. Unfortunately, the owner can find no description of the
institutional use within the comprehensive plan.
We believe the best use of the property would be residential and ask that the Eastern Frederick County Long
Range Land Use Plan be revised to classify this parcel as such.
The owner has investigated the possibility of some type of commercial use on the property. However, the
considerable slope across the site, from west to east, make use of the site for a commercial or retail use
difficult especially when vacant commercial parcels, without grading challenges exist on both ends of Tasker
Road. The same site slope constraints would also restrict the feasibility of an institutional use, assumed to be
schools or churches.
We have attached the completed application and the required fee of $3,000.00. Additionally, please find two
exhibits. One represents the existing comprehensive plan classifications and the other depicts the revised
boundaries which are being requested.
We appreciate your acceptance of this application and look forward to a presentation before the
Comprehensive Plans and Programs Committee and then the Planning Commission and Board of

The institutional classification found to the north has no description within the comprehensive
plan. Due to the grades on the site which slope considerably from west to east, an extension
of commercial uses from the north, or an institutional use is not feasible. The best use of the
property would be an extension of the residential uses which lie to the east. -
b. How would the resultant changes impact or benefit Frederick County. Consider, for
example, transportation, economic development and public facilities.
It would benefit the County to utilize lands within the UDA to their fullest extent possible. This
site is located within close proximity of the 1-81310 interchange providing quick access to
medical and commercial uses located along VA Route 37 as well as libraries, schools and
parks located to the east and south. Sewer and water lines are located adjacent to the site.
Direct access to Tasker Road is not required as the site has frontage on Rutherford Lane,
VA Route 846.
Other information may be required by the Director of Planning, the Planning Commission, or Board
of County Supervisors during the review of the initiation request. The applicant will be notified, in
writing, if additional information is required.
All applications must also contain the following items:

2. Non -Refundable Application Review Fee of $3,000 (payable to the Frederick County

Industrial) Zoning District. Automobile repair is currently permitted in the B3 (Industrial
Transition) and the M2 (Industrial General) Zoning Districts. Staff has drafted an ordinance
amendment that would permit SIC 752 as a permitted use in the M1 Zoning District along with
additional supplemental use regulations for the use. If approved, this amendment would permit
the following:

§ 165-204.12 Motor vehicle service uses, automotive repair shops and public garages.
All motor vehicle service uses, automotive repair shops and public garages shall meet the following
requirements:
A. All repair shall take place entirely within an enclosed structure_
All exterior storage of parts and equipment shall be screened from view of surrounding properties by
an opaque fence or screen at least six five -feet in height. This fence or screen shall be adequately
maintained.
C inoperable motor vehicles must be stored within a totally enclosed building or screened or, all sides
by a six foot opaque element such a fence, wall or berm.
D In the RA 1W and M2 Zoning Districts, the sale of automobiles shall not be permitted as an
