DRRC 05-24-07 Meeting AgendaMEMORANDUM 03UNTY of FREDERICK Department of Planning and Developznept To: Development Review and Regulations Subcommittee From: Susan K. Eddy, AICP, Principal Planner S"CIE5 Subject: May Meeting and Agenda Date: May 17, 2007 540/665-5651 FAX: 540/665-6395 The Frederick County Development Review and Regulations Subcommittee (DRRS) will be meeting on Thursday, May 24, 2007 at 7:30 p.m. in the Board Room of the County Administration Building, 107 North Kent Street, Winchester, Virginia. The DRRS will discuss the following agenda items: AGENDA 1) SIC to NAICS Conversions. Discussion of ordinance changes to convert the existing Standard Industrial Classifications (SIC) in the Zoning Ordinance to the North American Industry Classification System (NAICS) beginning with the B 1 (Neighborhood Business) District. 2) Large Lot Parcels zoned RP (Residential Performance) District. Discussion of ordinance changes to allow farm animals on RP zoned parcels larger than 100,000 square feet outside of the Urban Development Area (UDA) and the Sewer and Water Service Are (SWSA). 3) Other. Access to this building is limited during the evening hours. Therefore, it will be necessary to enter the building through the rear door of the four-story wing. I would encourage committee members and interested citizens to park in the County parking lot located behind the new addition or in the Joint Judicial Center parking lot and follow the sidewalk to the back door of the four-story wing. SKE/bad Attachments FILE COPY 107 North bent Street, Suite 202 • Whichester, Virginia 22601-5000 Item #1: SIC to NAICS Conversions As the Members of the DRRS are aware, the Business and Industrial Zoning District Regulations (§ 165-82) in the Zoning Ordinance are based on the Standard Industrial Classification (SIC). The SIC codes are no longer updated and have been replaced by the North American Industry Classification System (NAICS). After a presentation from Mr. Patrick Barker, Executive Director of the Winchester -Frederick County Economic Development Commission (EDC), at the March DRRS meeting, the DRRS directed staff to begin the conversion of the Zoning Ordinance from the SIC codes to the NAICS codes. The task of converting from SIC to NAICS has proved more complex than originally anticipated. While there is an online program (www.naics.com/search.htm) to directly convert the codes, within the conversions are decisions with which the DRRS and ultimately Frederick County may not concur. Because the NAICS codes are so detailed and specific, the Zoning Administrator would have less flexibility in interpreting the uses allowed in each district. To accomplish the task of evaluating the County's commercial and industrial zoning district uses, staff began by evaluating the uses allowed in the B 1 (Neighborhood Business) District. The current BI ordinance is attached. It is important to bear in mind the intent of the BI District when evaluating uses that belong in that district. "The intent of this district is to provide small business areas to serve the daily household needs of surrounding residential neighborhoods. Uses allowed primarily consist of limited retailing and personal service uses. Business uses in this district should be small in size and should not produce substantial vehicle traffic in excess of what is usual in the residential neighborhoods." At the May DRRS meeting, only the B 1 conversions will be discussed. Staff inputted the existing SIC codes allowed in the B 1 District into the on-line conversion program to generate the appropriate NAICS code. When the Zoning Ordinance did not contain an SIC code, staff looked directly for an NAICS equivalent. Attached you will find a green cover sheet for each use allowed in the B 1 District. Behind each green sheet you will find a printout of all uses formerly included in that SIC code and the NAICS conversion. In some cases you will find other NAICS sheets that staff found to be a simple useable listing. In cases where staff believed a use should clearly not be allowed in the B 1 District, it is crossed through. In cases where the staff is seeking the view of the DRRS, a question mark has been placed to the left of the NAICS code. In some instances DRRS members may have been unaware that some uses were allowed by the existing SIC codes, and perhaps this is the time to eliminate some inappropriate uses from the B 1 District. Of course, these will be clearly highlighted to the Planning Commission and Board of Supervisors and not covered under the umbrella of the SIC to NAICS conversion. 2 § 165-81 FREDERICK COUNTY CODE § 165-82 disposal before the mobile home park will sewer service must be provided through community systems. All community systems public authority. be approved. Water and the use of public or shall be dedicated to a ARTICLE X Business and Industrial Zoning Districts § 165-82. District use regulations. The following tables describe the business and industrial zoning districts in Frederick County, the intent of those districts and the uses allowed in each district. Standard industrial classification numbers are provided for particular uses to assist the Zoning Administrator in classifying uses. Determining whether a particular use should be classified under a particular category remains subject to interpretation on the part of the Zoning Administrator. A. Three principal types of activities are identified: 1 1. Raising funds by taking deposits and/or issuing securities and, in the process, incurring liabili- `. ties. Establishments engaged in this activity use raised funds to acquire financial assets by making loans and/or purchasing securities. Putting themselves at risk, they channel funds from lenders to borrowers and transform or repackage the funds with respect to maturity, scale and I {1! risk. This activity is known as financial intermediation. 2. Pooling of risk by underwriting insurance and annuities. Establishments engaged in this activity collect fees, insurance premiums, or annuity considerations; build up reserves; invest those reserves; and make contractual payments. Fees are based on the expected incidence of the a l! insured risk and the expected return on investment. 3. Providing specialized services facilitating or supporting financial intermediation, insurance, and employee benefit programs. In addition, monetary authorities charged with monetary control are included in this sector. The subsectors, industry groups, and industries within the NAICS Finance and Insurance sector are defined on the basis of their unique production processes. As with all industries, the production iE processes are distinguished by their use of specialized human resources and specialized physical capital. In addition, the way in which these establishments acquire and allocate financial capital, their source of funds, and the use of those funds provides a third basis for distinguishing characteristics of the production process. For instance, the production process in raising funds through deposit-taking is different from the process of raising funds in bond or money markets. The process of making loans to individuals also requires different production processes than does the creation of investment pools or the underwriting of securities. Most of the Finance and Insurance subsectors contain one or more industry groups of (1)' i intermediaries with similar patterns of raising and using funds and (2) establishments engaged in activities that facilitate, or are otherwise related to, that type of financial or insurance intermediation., Industries within this sector are defined in terms of activities for which a production process can be specified, and many of these activities are not exclusive to a particular type of financial institution. To deal with the varied activities taking place within existing financial institutions, the approach is to split these institutions into components performing specialized services. This requires defining the units engaged in providing those services and developing procedures that allow for their delineation. These units are the equivalents for finance and insurance of the establishments defined for other industries. The output of many financial services, as well as the inputs and the processes by which they: are combined, cannot be observed at a single location and can only be defined at a higher level of the organizational structure of the enterprise. Additionally, a number of independent activities that represent separate and distinct production processes may take place at a single location ;I US—United States industry only. CAN—United States and Canadian industries are comparable. When neither US nor CAN appears, Canadian, Mexican, and United States industries are comparable. http://www.ntis.gov/naics 518 NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM belonging to a multilocation financial firm. Activities are more likely to be homogeneous with respect to production characteristics than are locations, at least in financial services. The classification defines activities broadly enough that it can be used both by those classifying by location and by those employing a more top-down approach to the delineation of the establishment. Establishments engaged in activities that facilitate, or are otherwise related to, the various types of intermediation have been included in individual subsectors, rather than in a separate subsector dedicated to services alone because these services are performed by intermediaries as well as by specialist establishments and the extent to which the activity of the intermediaries can be separately identified is not clear. The Finance and Insurance sector has been defined to encompass establishments primarily engaged in financial transactions; that is, transactions involving the creation, liquidation, or change in ownership of financial assets or in facilitating financial transactions. Financial industries are extensive users of electronic means for facilitating the verification of financial balances, authorizing transactions, transferring funds to and from transactors' accounts, notifying banks (or credit card issuers) of the individual transactions, and providing daily summaries. Since these transaction processing activities are integral to the production of finance and insurance services, establishments that principally provide a financial transaction processing service are classified to this sector, rather than to the data processing industry in the Information sector. Legal entities that hold portfolios of assets on behalf of others are significant and data on them are required for a variety of purposes. Thus for NAICS, these funds, trusts, and other financial vehicles are the fifth subsector of the Finance and Insurance sector. These entities earn interest, dividends, and other property income, but have little or no employment and no revenue from the sale of services. Separate establishments and employees devoted to the management of funds are classified in Industry Group 5239, Other Financial Investment Activities. 1 Monetary Authorities —Central Bank ry Authorities —Central Bank subsector groups establishments that engage in per- forming central lung functions, such as issuing currency, managing the Nat16n's money supply and international res es, holding deposits that represent the reserves,: o;` other banks and other central banks, and acting fiscal agent for the central government. 5211 Monetary Authorities — ral Bank The 52111 Monetary Authorities — Central See industry description for 52111I11 521110 Monetary Bank CAN This industry Compri s establishments primarily engaged in performin entral banking func- tions, such as '7 comp currency, managing the Nation's money supply and intr6skational reserves, holding deposits at represent the reserves of other banks and other central banks, nd acting as fiscal agent f the central government. The Zoning Ordinance currently allows agriculture and farming only in the RA (Rural Areas) Zoning District. Agriculture and farming includes within its definition "the raising, shearing, feeding, caring for, training and management of animals While the RP Zoning District is primarily intended for suburban and urban housing types, there are some historically zoned RP lots outside of the UDA and SWSA. Some of these are the single-family detached rural traditional housing type. These are single family residences on an individual lot with a minimum lot size of 100,000 square feet (2.3 acres) without public sewer and water. The first map shows the location of these single-family detached rural traditional housing types. Most are located in Opequon Ridge, Opequon Estates, McGuire Hills, Brookneill and Stonebrook. Most are surrounded by RA (Rural Areas) District properties. (Private covenants may of course restrict animals in some of these developments.) The R5 (Residential Recreational Community) District also includes all uses allowed in the RP District. Should the County make changes to the RP District, these would apply in the R5 as well. The second map shows all R5 zoned properties, outside of the UDA & SWSA, that are over 100,000 square feet. These lots are located in all of the County's R5 developments: Lake Holiday (including Timber Ridge & Autumn Hills), Shawneeland, Mountain Falls Park, Wilde Acres and Shenandoah. Many of these lots, especially in Shenandoah, are for future development and will not likely remain over 100,000 square feet in area. Should animals be used as part of a community recreational facility, this would need to be shown on a master development plan. In considering this issue, the DRRS is asked to address multiple points. These include: ® Should any farm animal be allowed? • Should only horses be allowed? ® Should the number of animals be limited (for example, 1 animal per acre)? • Should boarding horses as a business be allowed? e Should barns/stables be a specified distance from the property line (for example 100 feet)? ® Should this be a by -right use or require a conditional use permit, or require a special exception (similar to a CUP, but perhaps without conditions)? If the DRRS is supportive of such an ordinance, staff will draft a Zoning Ordinance amendment based on the preferences of the DRRS and forward it to the Planning Commission and Board of Supervisors for their consideration. 3
