The Frederick County Development Review and Regulations Subcommittee (DRRS) will be meeting
on Thursday, May 24, 2007 at 7:30 p.m. in the Board Room of the County Administration Building,
107 North Kent Street, Winchester, Virginia. The DRRS will discuss the following agenda items:
AGENDA
1) SIC to NAICS Conversions. Discussion of ordinance changes to convert the existing
Standard Industrial Classifications (SIC) in the Zoning Ordinance to the North American
Industry Classification System (NAICS) beginning with the B 1 (Neighborhood Business)
District.
2) Large Lot Parcels zoned RP (Residential Performance) District. Discussion of ordinance
changes to allow farm animals on RP zoned parcels larger than 100,000 square feet outside
of the Urban Development Area (UDA) and the Sewer and Water Service Are (SWSA).
3) Other.
Access to this building is limited during the evening hours. Therefore, it will be necessary to enter
the building through the rear door of the four-story wing. I would encourage committee members
and interested citizens to park in the County parking lot located behind the new addition or in the
Joint Judicial Center parking lot and follow the sidewalk to the back door of the four-story wing.

Item #1: SIC to NAICS Conversions
As the Members of the DRRS are aware, the Business and Industrial Zoning District Regulations
(§ 165-82) in the Zoning Ordinance are based on the Standard Industrial Classification (SIC). The
SIC codes are no longer updated and have been replaced by the North American Industry
Classification System (NAICS). After a presentation from Mr. Patrick Barker, Executive Director
of the Winchester -Frederick County Economic Development Commission (EDC), at the March
DRRS meeting, the DRRS directed staff to begin the conversion of the Zoning Ordinance from the
SIC codes to the NAICS codes.
The task of converting from SIC to NAICS has proved more complex than originally anticipated.
While there is an online program (www.naics.com/search.htm) to directly convert the codes, within
the conversions are decisions with which the DRRS and ultimately Frederick County may not
concur. Because the NAICS codes are so detailed and specific, the Zoning Administrator would
have less flexibility in interpreting the uses allowed in each district.
To accomplish the task of evaluating the County's commercial and industrial zoning district uses,
staff began by evaluating the uses allowed in the B 1 (Neighborhood Business) District. The current
BI ordinance is attached. It is important to bear in mind the intent of the BI District when
evaluating uses that belong in that district.
"The intent of this district is to provide small business areas to serve the daily
household needs of surrounding residential neighborhoods. Uses allowed primarily
consist of limited retailing and personal service uses. Business uses in this district
should be small in size and should not produce substantial vehicle traffic in excess of
what is usual in the residential neighborhoods."
At the May DRRS meeting, only the B 1 conversions will be discussed. Staff inputted the existing
SIC codes allowed in the B 1 District into the on-line conversion program to generate the appropriate
NAICS code. When the Zoning Ordinance did not contain an SIC code, staff looked directly for an
NAICS equivalent.
Attached you will find a green cover sheet for each use allowed in the B 1 District. Behind each
green sheet you will find a printout of all uses formerly included in that SIC code and the NAICS
conversion. In some cases you will find other NAICS sheets that staff found to be a simple useable
listing. In cases where staff believed a use should clearly not be allowed in the B 1 District, it is
crossed through. In cases where the staff is seeking the view of the DRRS, a question mark has been
placed to the left of the NAICS code. In some instances DRRS members may have been unaware
that some uses were allowed by the existing SIC codes, and perhaps this is the time to eliminate
some inappropriate uses from the B 1 District. Of course, these will be clearly highlighted to the
Planning Commission and Board of Supervisors and not covered under the umbrella of the SIC to
NAICS conversion.

The following tables describe the business and industrial zoning districts in
Frederick County, the intent of those districts and the uses allowed in each
district. Standard industrial classification numbers are provided for particular
uses to assist the Zoning Administrator in classifying uses. Determining whether
a particular use should be classified under a particular category remains subject
to interpretation on the part of the Zoning Administrator.

Item #2; Large Lot Parcels zoned RP (Residential Performance) District
Staff has recently had enquiries from members of the public on the permissibility of farm animals on
large RP (Residential Performance) District lots outside of the Urban Development Area (UDA) and
SWSA (Sewer and Water Service Area).
The Zoning Ordinance currently allows agriculture and farming only in the RA (Rural Areas) Zoning
District. Agriculture and farming includes within its definition "the raising, shearing, feeding, caring
for, training and management of animals
While the RP Zoning District is primarily intended for suburban and urban housing types, there are
some historically zoned RP lots outside of the UDA and SWSA. Some of these are the single-family
detached rural traditional housing type. These are single family residences on an individual lot with
a minimum lot size of 100,000 square feet (2.3 acres) without public sewer and water. The first map
shows the location of these single-family detached rural traditional housing types. Most are located
in Opequon Ridge, Opequon Estates, McGuire Hills, Brookneill and Stonebrook. Most are
surrounded by RA (Rural Areas) District properties. (Private covenants may of course restrict
animals in some of these developments.)
The R5 (Residential Recreational Community) District also includes all uses allowed in the RP
District. Should the County make changes to the RP District, these would apply in the R5 as well.
The second map shows all R5 zoned properties, outside of the UDA & SWSA, that are over 100,000
square feet. These lots are located in all of the County's R5 developments: Lake Holiday (including
Timber Ridge & Autumn Hills), Shawneeland, Mountain Falls Park, Wilde Acres and Shenandoah.
Many of these lots, especially in Shenandoah, are for future development and will not likely remain
over 100,000 square feet in area. Should animals be used as part of a community recreational
facility, this would need to be shown on a master development plan.
In considering this issue, the DRRS is asked to address multiple points. These include:
® Should any farm animal be allowed?
• Should only horses be allowed?
® Should the number of animals be limited (for example, 1 animal per acre)?
• Should boarding horses as a business be allowed?
e Should barns/stables be a specified distance from the property line (for example 100 feet)?
® Should this be a by -right use or require a conditional use permit, or require a special
exception (similar to a CUP, but perhaps without conditions)?
If the DRRS is supportive of such an ordinance, staff will draft a Zoning Ordinance amendment
based on the preferences of the DRRS and forward it to the Planning Commission and Board of
Supervisors for their consideration.
