In order to obtain a full access commercial entrance, a minimum of 750' is required between Commercial entrances. The existing Commercial Entrance serving the gas station just to the northwest of your proposed site is approximately 200' shy of meeting the minimum required for full access. As conceptually shown, this office does not support the full access entrance to the site. The spacing is however adequate for partial access in accordance with VDOT Access Management Regulations. If you would like to revise the concept plan to reflect partial access only to the site, we could support the permit application request, pending all the requirements of VDOT's Commercial Entrance Checklist be met at the time of site plan design/review. There is no fee and you can apply at any time. As previously stated in the August and September emails, this office does not issue the exception. At no time did I guarantee an exception would be supported. The approval or denial comes from our District Planning and Land Use Director. (I have highlighted that statement in the email chain below.) You stated your neighbor is unwilling to cooperate with you on shared access and provided such documentation. I would like to point out the language used in the letter is not necessarily in accordance with the regulation. You asked for permission to use the existing entrance on their property and the landowner denied. The regulation doesn't state you have to use an existing entrance on neighboring property. The new development could construct a Commercial Entrance on either property to share with the neighbor. Also, have you approached the neighbor on the opposing side of the proposed development site? I would like to reiterate that this office does not issue approvals for the AM -E, Access Management Exception. Additionally, applying for the exception does not guarantee it will be approved. I would like to add that the plan we reviewed for the CUP application is very vague. I know our District Planning and Land Use Director will need more information to make a determination. Some items to consider include: Verifying intersection sight distance is met. A complete left and right turn lane warrant analysis is needed. The vehicles per day in this area of Rte. 522 is 18,000, not 12,000 as your office listed in the August 21, 2017 email. Would traffic signal warrants be met if the fourth leg of this intersection was granted the exception? If so, would the developer enter into a signalization agreement? These are some things to look into. Please let me know if you have additional questions or concerns. Our tenant requires full access, so if a waiver is unlikely and we are not able to locate the entrance at the median cut with full access, this project will fail. This office does not issue the approvals on Access management exceptions. Our district planning and land use manager looks at each site on a case by case basis and decides on approval or denial. As part of VDOT's Access Management Regulations, you are required to pursue shared access with your neighbor prior to constructing a new access. If the neighbors are not willing to cooperate with you, we will need written documentation of such. 2) Right and left turn lane warrant analysis are needed. I suspect turn lane may be needed for both left and right turn movements. — We noticed that several other entrances along this corridor do not have turn lanes. Is there a possible variance or waiver that these locations utilized? The other entrances may not have met the warrants for turn lanes at the time of construction. With all new site plans, turn lane warrant analysis is required. 3) Where did the 16 vehicles in the peak hour come from? - This information has been provided to us by our Corporate Tenant and has been very accurate for other similar size retail stores. The ITE trip generation manual identifies the following rates to be used under code ITE 820, Shopping Center: Weekday= 42.94 per 1,000 square feet of gross floor area AM= 1.0 per 1,000 square feet of gross floor area PM= 3.73 per 1,000 square feet of gross floor area 4) What is the type of delivery vehicle utilized in the Auto -Turn Exhibit? A WB -67 is to be utilized. This is needed to determine if the Auto -Turns are adequate. A WB -67 was utilized. 5) How will the drainage for the existing ditch line on Rte. 522 be handled. How will the onsite drainage be handled? - The information and drawing provided are very preliminary and thus we are not to the stage of determining drainage. However, drainage will be handled onsite and will be directed away from the roadway. More specific and detailed information will be provided as we progress further.
