Call to order at 6:35 PM. The minutes of April 15, 2008 were unanimously approved as presented. Item One: Request for comments regarding the Route 7 Warehousing Rezoning Application: Major Points: • Ben Montgomery from Montgomery Development was asked by Chairman Kriz if steep slopes would be an issue in developing the site. • Mr. Montgomery responded yes and also clarified the rezoning strictly limits development to self -storage only. • He was also asked if heavy amounts of clearing would be necessary for construction. He responded by saying not really, and that trees must remain intact on most of the site due to restriction regarding steep slopes and floodplains riparian buffer. • Ms. Krempa responded saying that while the environmental feature protections in the code may limit the amount of clearing permitted at the site that she would like to see an assurance of that fact in the proffer statement. All agreed. • The group also discussed the possibility of finding historic artifacts on the property since they are has never been developed and is essentially intact. Group strongly suggested a phase one archeological survey be conducted prior to site disruption and that any if any historic artifacts are found, a more intensive survey be conducted. • Chairman Kriz, summed -up the Boards comments by recommending that both a designation of tree -save areas particularly along Route 7 be included in the proffers, as well as a phase one survey of the property, (with a follow-up investigation of any findings) be conducted prior to site disturbance. Action: The recommendations summed -up by Chairman Kriz will be included in the HRAB's response to the applicant's request for comments. Item Two: Discussion regarding the location of the existing and proposed interpretive signs for the Rutherford Crossing Development: Major Points: Board members reviewed the map of the site's current sign location plan, and the new proposal. Content of the signs was not yet prepared for the HRAB's approval, so the Board focused the discussion on the location. • Board Members expressed the desire to have the existing VDOT information signs near the site placed facing the historic site and not the road. Mr. Bielich, who is in charge of this and other aspects of the Rutherford Crossing Development, will follow-up with VDOT to see of this is possible / permissible. • Mr. Bielich confirmed that Mr. Howard Kittell of The Virginia Conservation Network (VCN) will be drafting the text of the signs and once it is finished the text will be forwarded to Planning staff and the HRAB for approval. • Chairman Kriz requested that the bugle symbol (the Civil War Trails logo) be included on the new signs. Mr. Bielich will see if this can be included. • Group also suggested that photos of the artifacts found on the Rutherford Farm site be included somewhere on the signs. Action: Mr. Bielich will forward the final design of the signs including final text to the board for Approval via email as soon as they are finished. He will also seek VDOT's comments regarding the location of the existing signs and the proposed location of the new signs will be reviewed by Ms. Candice Perkins as a part of the necessary Site Plan revision. Major changes included the remittance of the history to the beginning of the section and to the implementation strategies section. It was suggested that members take the Comprehensive Plan home to read and send comments to Planning Staff by April 18. It was stated that this version may be the one to go before CPPS for comments. Members agreed to read through the plan and send comments before the before stated date. The next item presented was the website. Planning Staff had begun formatting the site and wanted to receive comments from HRAB before continuing. Members suggested that the website have more links to other sites, more pictures, and a section for cemeteries. Mr. Oates stated that he would like to have a form for reporting cemeteries that surveyors may happen upon during their surveying. Planning Staff said that they would work with IT to develop a reporting form as such. Planning Staff stated that work would continue on the website with hopes of finishing the initial form by April 30th. A copy of the website would be sent to HRAB members for comment and approval before being added to server. The next item was presented by Chairman Kriz who asked if HRAB members wanted to meet if there were no rezonings to review. Vice Chairman Fravel stated that there were still several projects that could be worked on such as the Plaque Program for the upcoming year. Chariman Kriz said that Ms. Kalbain's consultation would be needed to determine what properties to nominate. Chairman Kriz, then, spoke of the funding that HRAB was allowed to spend on historical markers. Currently the fund is around $9,000. Members discussed spending the money on interstate markers and maintenance. Chairman Kriz also suggested that the Bicentennial Committee that allocated the funds be reconvened to determine if the money could be spent elsewhere. It was agreed that both ideas needed to be further investigated. Item Three: Website Status Ms. Powers acknowledged that the status of the website project remains unchanged since she began serving as staff support for the HRAB, and that she will make sure that the site, which was originally to be launched with the new County Website be published as soon as possible. Item Four: APVA June 30th organizational meeting. Board members received a flyer announcing the Association for the Preservat5ions of Virginia Antiquities' (APVA) organizational meeting scheduled for June 30 and 5:30 pm at the Museum of the Shenandoah Valley in Winchester. It was unanimously agreed that the need for a meeting next month would be discussed by email before an agenda was formed. Meeting was adjourned at 7:30. Item # 2 Route 50 Commercial Development Property Rezoning Painter — Lewis, P.L.C. has requested comments from the HRAB regarding their application for the rezoning of 9.2436 acres of land from RA to B2. Please see the attached map for location information. The site is not located within the bounds of a core battlefield, however it does border along a potentially significant historic property. The Rural Landmarks Survey Report for Frederick County Virginia identifies two structures within the immediate area of the subject site. These sites are the: Carper — Wynn House (#34-1129) — identified as potentially significant * Carper -Cunningham House (#34-1130) The applicant has not included their proffer statement in the HRAB application package, but staff is seeking to have a copy available at the meeting. The applicant's proposal is to construct a series of commercial spaces for multiple users, or for a single, large tenant. Attached, please find conceptual, non -proffered plans that Painter — Lewis has submitted. Representatives of the applicant may be available at the HRAB meeting to provide additional information on the proposed rezoning. Staff will be seeking comments from the HRAB on the historical marker. It is estimated that $7,650 in tipping fees will be paid to dispose of 170 tons of solid waste. `4 H. HISTORIC SITES AND STRUCTURES The J&G, L.L.C. property assemblage does not contain any historic/archeological sites identified in Frederick County and Virginia Department of Historic Resources records. None is on the National Register of Historic Places or the Virginia Landmarks register. None of this site is located within any Civil War battlefield identified in the National Park Services, Study of Civil War Sites in the Shenandoah Valley of Virginia, published in 1992. There are several historic sites within 1 mile of the site, of these three (3) are identified as potentially significant. These include 1131 -Wilt -Dunn -Arnold House, 1133 -Fuller - Chapman House, and 1136-Keyser-Edmonson House. The complete list of historical sites within a 1 mile radius of the site and map can be seen on Exhibit 4. I. COMMUNITY FACILITIES DEVELOPMENTAL IMPACT MODEL - The new Developmental Impact Model (D.I.M.) is utilized primarily for residential rezoning requests. It is anticipated that the capital facility impacts of commercial and industrial rezoning request are ultimately fiscally positive to the County by policy. Accordingly, the D.I.M. does not apply a fiscal impact to commercial rezoning. EMERGENCY SERVICES Police protection is provided by the Frederick County Sheriffs Department. The nearest fire and rescue facility is the Millwood Fire and Rescue Station located on Costello Drive in the Frederick County. No additional fire and rescue facilities will be required for the area proposed to be rezoned. The Frederick County Capital Facilities Impact Model calculates that there will not be any projected capital cost for emergency service facilities attributable to this development. The owner recognizes the importance of emergency services, and proposes to proffer a monetary contribution to the local emergency responder. See the attached Proffer Statement. The property is located north of the protected portion of the Opequon Battlefield, at 1207 Redbud Road. The property in question is a part of the Redbud Forestal district and is within close proximity to the Third Battle of Winchester (Opequon). Please see the attached maps for more information. The applicant has completed a phase 1 archeological survey of the property, and received a comment from DHR (see attached). Also attached are computer-aided illustrations simulating the location and visibility of the proposed tower during the summer months (full foliage). The Rural Landmarks Survey Report for Frederick County Virginia does not identify any potentially significant structures on or adjacent to the property. The Study of Civil War Sites in the Shenandoah Valley, published by the National Park Service, shows that a portion of the subject site is included in the battlefield study area of the Third Battle of Winchester (Opequon) with portions of the site being identified as core area. Note that further information will be provided at the time of the meeting. This will include information about the RF study done to determine if this tower location is warranted, in light of coverage levels and opportunities for co -location elsewhere. Representatives of the applicant will be available at the HRAB meeting to provide additional information on the proposed CUP. Staff will be seeking comments from the HRAB on the historical elements possibly impacted by the proposed development. (TRIAD) has been retained by Shenandoah Mobile Company in order to obtain compliance with the Federal Communications Commission (FCC) under the National Environmental Policy Act (NEPA), as part of the Section 106 review process, for the proposed installation of a 195 -foot tall monopole cellular communications tower at the above -referenced property. As part of this process, the Virginia Department of Historical Resources (VADHR) requires this letter officially informing the government of Frederick County of the proposed project. The site is located approximately 300 feet north of a residential dwelling (constructed circa 1996) and 150 feet north of a small farmstead consisting of a small barn and sheds. The proposed square shaped compound will be 4,900 square feet in size, will be constructed on a poured 160 square foot concrete slab, and will be protected by an eight foot high chain-link fence enclosure. ,The direct Area of Potential Effect (APE) will be confined to the 58,000 square foot project area that includes the 100 ft x 100 ft lease area and the 2,300 feet ingress/egress easement. Approximately 85% (1,930 ft) of the proposed access road utilizes an existing graded and,.graveled driveway. The remaining approximate 375 feet to the proposed tower site will be through a farm trail and woodlands. There is no direct affect anticipated to this propefty other than the improvement of the proposed access road. There were no historical structures identified on the parent parcel. The proposed project location is depicted on the attached portion of the USGS Stephenson, VA, WV 7.5 -Minute topographic quadrangle. The approximate coordinates of the site are: N Latitude — 39.200620 W Longitude -78.105070 As part of this assessment and as required by the Virginia Department of Historical Resources (DHR), a Phase I Archeological Survey was performed by Rivanna TRIAD ENGINEERING, INC. West Virginia 1,Pennsylvania Maryland Virginia Proposed Monopole Tower No. 046 Winchester, Frederick County, Virginia June 13, 2008 Page 2 Archaeological Services, LLC, which found only a single small cortical fragment of reddish - brown jasper that was recovered from a shovel test at the northern corner of the lease area. This probable prehistoric lithic artifact showed no elements of classic flake morphology but may be a piece of shatter or spall. Based on the extreme paucity of cultural materials and the absence of non -modern landscape features, the proposed project will not directly impact potentially significant archaeological or other historical/cultural resources. No further archaeological research was recommended. Based on this, Rivanna Archaeological issued a Statement of No Finding. There is no direct effect anticipated to the site other than the proposed improvements, and it is not anticipated that the tower will be visible from the majority of the architectural resources in the area. Based on our preliminary research and site visit, it is TRIAD'S professional opinion that the proposed construction of the cellular tower antenna will have "no effect" on potentially existing endangered species, critical habitats, historical sites, and cultural sites. Water St., Suite 1100 Charlottesville, VA 22902 Archaeological Tel: 434-293-3108 Fax: 434-293-3183 Services, LLC Email: info@rivarch.com Phase I Archaeological Survey Shentel Shenandoah Mobile Company Proposed Redbud (Site 046A) Cellular Communications Tower Site, Frederick County, Virginia Archaeological Resources Statement of No Finding On April 9, 2008 Rivanna Archaeological Services conducted a Phase I archaeological survey of Shentel Shenadoah Mobile Company's Redbud site (#046A), the location of a proposed 195 -ft self-supporting cellular communications tower in Frederick County, Virginia. The Redbud site is located in Frederick County Tax Map Parcel 55 -A -129A at 1203 Redbud Road approximately 2.1 miles northeast of the Winchester city limits and the intersection of Interstate 81 and U. S. Route 7/Berryville Pike (Figure 1). The proposed Redbud tower site is located just west of the crest of a low, broad, southwest -northeast trending ridge known as Devil's Backbone The nearest water source is an intermittent tributary stream of Lick Run which flows north some 180 ft northwest of the proposed tower lease area. Approximately 1,500 ft north of the lease area, this unnamed tributary joins Lick Run, which flows north and east for two miles before joining Opequan Creek. The project area for the Phase I archaeological survey consists of a total area of approximately 58,000 sq ft (1.33 acre) comprised of a 100 ft x 100 ft lease area located approximately 0.36 mile northeast of Redbud Road at an elevation of 640 ft amsl, a 20 -ft -wide and approximately 2300 - ft -long ingress/egress easement that connects the tower site to Redbud Road, and a 6 -ft -wide and 164 -ft -long utility easement that joins the ingress/egress easement approximately 365 ft southwest of the tower lease area. Approximately 85% (ca. 1930 ft) of the ingress/egress easement follows the existing graded and graveled drive that leads to the late 20th -century residence at 1203 Redbud Road. Because of extensive disturbances associated with construction of the drive this portion of the project area was not examined and the Phase I survey was limited to the tower lease area, the connecting utility easement and the roughly 375 linear feet of ingress/egress easement not located along the existing drive. Centerlines of the ingress/egress and utility easements as well as the corners of the tower lease area were clearly staked at the time of the Phase I survey. All portions of the project area subjected to Phase I archaeological survey support mature woodland. Approximately 0.3 mile northeast of Redbud Road the proposed ingress/egress easement leaves the existing gravel drive and proceeds northwest across roughly level terrain for a distance of 375 ft to the proposed cellular communications tower site. The 100 ft x 100 ft tower lease area occupies gently to moderately sloping (7% - 13%) terrain just north of the crest of Devil's Backbone. The 164 -ft -long connecting utility easement runs north from an existing electrical transformer box along the west side of the drive leading to the residence (Figure 2). Archaeological field crew walked all parts of the project area except that portion of the ingress/egress easement that follows the existing drive. Exposed surface soils were common within the sloping tower lease area and these were visually examined for cultural materials. The general vicinity was also inspected for potential, pre -modern cultural features. A total of 19 shovel tests were excavated within the project area during the Phase I archaeological survey, including 8 shovel tests along the ingress/egress easement, 3 tests along the connecting utility easement, and 8 tests within the tower lease area. No shovel tests were placed along the existing graded and graveled drive that constitutes the southernmost 1,930 ft of the ingress/egress easement. Shovel tests were placed at intervals of no greater than 50 ft along the centerlines of the utility and ingress/egress easements and within the lease area. Four shovel tests placed at 25 - ft intervals were also excavated with the tower lease area. Shovel tests measured 1.0 — 1.5 ft in diameter and were excavated to subsoil or bedrock with all removed soil screened through 1/4 - inch hardware cloth to ensure consistent artifact recognition and recovery. Soil stratigraphy was recorded on standardized forms for each excavated shovel test and the location of each test was plotted on a scaled map of the project area. Shovel testing within the project area consistently documented very rocky, shallow surface soils overlying clayey subsoil or, more frequently, yellowish -brown saprolitic shale or siltstone bedrock. A single, small, cortical fragment of reddish -brown jasper was recovered from shovel test 42 in the northern corner of the tower lease area. - This probable prehistoric lithic artifact shows no elements of classic flake morphology but may be a piece of shatter or spall. Surface exposure was relatively good (ca. 25%) within the lease area and immediate vicinity and these areas were examined for surface artifacts. Radial shovel testing at 25 -ft intervals was also conducted outwards from shovel test #2, however no additional cultural materials were recovered here or elsewhere within the project area. The single recovered object likely is the result of highly ephemeral activity at some point during prehistory, however alone it is not sufficient evidence upon which to define an archaeological site The extreme paucity of cultural materials and the absence of non -modern landscape features observed during the Phase I archaeological survey of the Shentel Redbud project area indicates that the proposed project will not directly impact potentially significant archaeological or other historical/cultural resources.
