(A) 5) Draft Update of the 2012-2013 Frederick County Primary and Interstate Road Improvement Plans - The Primary and Interstate Road Improvement Plans establish priorities for improvements to the Primary and Interstate road networks within Frederick County. Comments from the Transportation Committee will be forwarded to the Planning Commission and Board of Supervisors. Ultimately, the priorities adopted by the Board of Supervisors will be forwarded to the Commonwealth Transportation Board for consideration. The Virginia Department of Transportation and the Planning Commission of Frederick County, in accordance with Section 33.1-70.01 of the Code of Virginia, will conduct a joint public hearing in the Board Room of the Frederick County Government Center, 107 North Kent Street, Winchester, Virginia at 7:00 p.m. on Wednesday, May 16, 2012. The purpose of this public hearing is to receive public comment on the proposed Six Year Plan for Secondary Roads for Fiscal Year 2013. Copies of the proposed Plan and Budget may be reviewed at the Edinburg Office of the Virginia Department of Transportation, located at 14031 Old Valley Pike, Edinburg, Virginia or at the Frederick County offices located at 107 North Kent Street, Winchester, Virginia. All projects in the Secondary Road Improvement Plan that are eligible for federal funds will be included in the Statewide Transportation Improvement Program (STIP), which documents how Virginia will obligate federal transportation funds. (B) 6) Senseny/Eastern Frederick Urban Areas Land Use Plan – This is a public hearing for the Senseny/Eastern Frederick Urban Areas Plan. The Plan encompasses the area of the County that is generally east of the City of Winchester and Interstate 81 to the Clarke County line and from Redbud Run in the north to the Opequon Creek in the south. The Plan contains four maps and a narrative text that covers the following areas: Urban Areas and Residential Development, Business Development, Transportation, and Natural Resources, Historic Resources, and Public Facilities, and is an update to Appendix I of the 2030 Comprehensive Plan and the Eastern Frederick County Long Range Land Use Plan, a component of the 2030 Comprehensive Plan. This Plan represents the work of a large number of citizen volunteers who have been working over the past several months in collaboration with each other. Cheran, Zoning Administrator This report is prepared by the Frederick County Planning Staff to provide information to the Planning Commission and the Board of Supervisors to assist them in making a decision on this request. It may also be useful to others interested in this zoning matter. Reviewed Planning Commission: 05/16/12 Pending Action Board of Supervisors: 06/13/12 Pending EXECUTIVE SUMMARY: This is a request for Commercial Outdoor Recreation Use for the purpose of expanding Conditional Use Permit #05-98, which is attached with Appleland Golf Course. Should the Planning Commission find this use appropriate, Staff would suggest the following conditions be placed on the CUP: 1. All review agency comments shall be complied with at all times. 2. No additional entrances permitted onto Route 11 from this site. 3. Any expansion of current facilities approved via current site plan will require a new site plan. 4. Hours of operation shall not exceed 11:00 p.m. 5. No additional signage allowed. 6. Lighting must be directed away from Route 11 and adjoining properties. 7. Noise shall be controlled so as not to impact adjoining properties; sound levels from the property line shall not exceed 75dba (A scale). 8. Approval of CUP #02-12 will null and void CUP #05-98. 9. Any expansion of use will require a new CUP Following the requisite public hearing, it would be appropriate for the Planning Commission to offer a recommendation concerning this application to the Board of Supervisors. REVIEW EVALUATIONS : Virginia Department of Transportation: The application for a Conditional Use Permit for this property appears to have little measurable impact on Route 11, the VDOT facility which would provide access to the property. Existing entrance is adequate for proposed use. However, should use ever expand in the future, the entrance may have to be upgraded to VDOT commercial standards. Frederick County Fire and Rescue: Plans approved. Frederick County Fire Marshall: Plans approved. Page 3 CUP #02-12, Pippin Enterprises LLC April 23, 2012 Frederick County Inspections: No structures, no comment required. Frederick County Department of Public Works: Frederick County Sanitation Authority: FCSA has existing water & sewer facilities in the area. FCSA shall review site plan as applicable. Proposed construction should consider FCSA access and disturbance to the surface of the ground. Frederick-Winchester Health Department: No objection from Health Department as long as only 3 holes are going to be added to the existing golf course. No building structures added and no wells drilled. The minor addition of 3 holds should not impact the existing facilities (septic) in any negative way. Planning and Zoning: This proposed CUP is to expand the golf course and will include four (4) properties (74-A-27 and 27A, 74-A-74 and 75). The existing Appleland Sports Center has an approved site plan and this plan will provide for parking for the proposed expansion. The proposed CUP shall only utilize the current approved commercial entrance from Route 11. No other entrances will be utilized from Route 11 or Route 649. Any future expansion of the existing faculties will require a new site plan. A copy of the conditions of CUP #05-98 are included for your review. This current commercial outdoor recreation use (Appleland Sports Center) is operating under Conditional Use Permit (CUP) #05-98, approved by the Board of Supervisors on October 14, 1998. This CUP allowed for a par 3 golf course, concession stand, waterslide and accessory retail associated with the recreation use. Staff would note that the above- referenced properties (74-A-27 & 27A) are covered by CUP #05-98. The 2030 Comprehensive Policy Plan of Frederick County, and future comprehensive plans, provides guidance when considering any land use actions. This property is located within the Route 11 South corridor, and as noted on the Eastern Frederick County Long Range Land Use Plan, this area of the County is identified for commercial uses. It appears that this CUP meets the intent of the goals of the 2030 Comprehensive Policy Plan of Frederick County . In addition, as the State continues to work toward an ultimate plan for the I-81 widening, the County of Frederick continues to support the study of Eastern Route 37 as a potential corridor on new location as an alternative for that effort. Moreover, the County of Frederick supports exploration of the potential for rail transportation as a component of the Interstate 81 Corridor improvements. Progress to Phase 1 of the FHWA approved interchange modification to Exit 310 (as illustrated on map as priority A) A) Relocate Exit 307 further south to alleviate existing and future congestion on Route 277. There is an urgent need to begin increased study of this project. (as illustrated on map as priority B) B) Widen I-81 from Fairfax Pike to Route 37 North. This should include the relocation of the 277 Interchange. Establish a construction schedule for the phased improvement of Fairfax Pike (Route 277). Program funding for the completion of right-of-way acquisition and construction of each phase as described above. 3) Route 11 (North and South of Winchester) A) Establish an Urban Divided Four Lane System From: Southern limits of the City of Winchester To: 0.4 miles south of intersection of Route 37 South, Exit 310 (As illustrated on map as priority 3A) B) Establish an Urban Divided Four Lane System From: Northern limits of the City of Winchester To: Intersection of Merchant Street (As illustrated on map as priority 3B) C) Establish an Urban Divided Four Lane System From: Intersection of Merchant Street To: West Virginia line (As illustrated on map as priority 3C) 4) South Frederick County Parkway From: Relocated Exit 307 To: Intersection with Route 277 approximately 1 Mile west of the intersection of Route 277 and Route 522 This is a planned new roadway with limited access points serving a mixture of predominantly commercial and industrial development. There is need to study this project in conjunction with the Exit 307 relocation and planning for Route 277 improvements noted in item 3. Phasing of this project is not yet clearly defined, however general phasing would be from West to East with the clear first phase being from relocated Exit 307 to Warrior Dr. (As illustrated on map as priority 4) 5) Commuter Park and Ride Lots Establish a new park and ride facility along the Berryville Pike (Route 7) corridor. Work with the Northern Shenandoah Valley Regional Commission to determine appropriate locations for park and ride facilities at other strategic locations within the County’s Urban Development Area. For Park and Ride locations in Frederick County the primary goal should be that they are situated in such a manner that they reduce traffic in Frederick County in addition to adjacent localities. This route is the VDOT roadway which has been considered as the access to the property referenced. VDOT is satisfied that the transportation proffers offered in the BPG Properties, LTD Rezoning Application dated March, 2012 address transportation concerns associated with the request. Before development, this office will require a complete set of construction plans detailing entrance designs, drainage features, and traffic flow data for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, and off-site roadway improvements and drainage. Any work performed on the State’s right-of-way must be covered under a land use permit. This permit is issued by this office and requires an inspection fee and surety bond coverage. Planning & Zoning: 1) Site History The original Frederick County zoning map (U.S.G.S. Inwood Quadrangle) identifies the subject parcels as being zoned A-2 (Agricultural General). The County’s agricultural zoning districts were subsequently combined to form the RA (Rural Areas) District upon adoption of an amendment to the Frederick County Zoning Ordinance on May 10, 1989. The corresponding revision of the zoning map resulted in the re-mapping of the subject property and all other A-1 and A-2 zoned land to the RA District. The Applicant previously attempted to rezone these properties in 2007. Rezoning Application RZ#07-07 was denied by the Board of Supervisors on September 12, 2007.
