Agenda Items: November 2012 Minutes, Election of Officers, Review of the Verizon Commercial
Telecommunications Facility Conditional Use Permit (proposed tower located at 2250 Back Mountain
Road).
Call to order at 6:30 PM.
Item One: The November 2012 minutes were adopted as presented.
Item Two: Lauren Murphy was elected Chairman and Elizabeth Fravel was elected Vice Chairman
Item Three: Planner Perkins introduced the third item which was a Conditional Use Permit application
for a proposed 195-foot commercial monopole telecommunications tower with an accessory equipment
building for Verizon. The property is located at 2250 Back Mountain Road. The Rural Landmarks Survey
Report for Frederick County Virginia identified three historic structures located within the vicinity of the
proposed tower, one of which is located on site. All of these properties are listed as potentially
significant. The sites that are listed in the survey are:
• Larrick Legge House (#34-339) – Potentially Significant
• House, Route 600 (#34-357) – On site - Potentially Significant
• Schultz House (#34-385) – Potentially Significant
It was discussed that this area could be a potential rural historic district and the applicant was asked if
they had examined the surrounding larger area because it may qualify as a possible district. The
applicant stated that they had not looked at the larger area. The HRAB then stated that the applicant
should update the survey for the property and not utilize the older one on file. The HRAB requested
that the applicant prepare a preliminary information sheet to determine if the property is eligible for a
historic district and if this property is eligible for the registry.
The applicant inquired if the PIF or historic district would sway future approvals of towers. The HRAB
stated bat the PIF would not necessarily make the committee recommend against future applications.
Staff inquired if the applicant had additional information on the property and the applicant stated they
did not find additional information.
The HRAB stated that they wanted to see updated surveys for all future applications. The PIF should be
required as a condition of submittal of the CUP to the Planning Commission.
Meeting was adjourned at 7:20p.m.
Item # 2
Historic Plaque Application
The Historic Resources Advisory Board has received an application for historic property
designation for the Carr-Brumback-Owens House. This program, more commonly referred to as
the historic plaque program, enables the County to formally acknowledge the architectural and
historic integrity of county structures. Since its inception, the Frederick County historic
property designation program has awarded 29 historic plaques to important structures in the
County, the first of which were presented to the property owners in 1995.
Please see attached application, pictures and site description.
Staff is seeking a decision from the HRAB on this plaque application.
Item # 3
Discussion – Comprehensive Plan Amendment
The Historic Resources Advisory Board (HRAB) has been asked to provide a comment pertaining
to a requested Comprehensive Plan Amendment for the McCann-Slaughter property. These
parcels are identified by Property Identification Numbers 44-A-40 and 44-A-25B, in the
Stonewall Magisterial District. The McCann-Slaughter parcels contain approximately 160 acres,
near the intersection of Martinsburg Pike and Old Charlestown Road, on both sides of McCann
Road, and adjacent to the CSX Railroad. The properties are collectively designated in the 2030
Comprehensive Plan for various types of land uses, including Developmentally Sensitive Areas
and Industrial.
The Study of Civil War Sites in the Shenandoah Valley published by the National Park Service
identifies these properties as core battlefield area for the Battle of Third Winchester (Opequon)
with retained integrity.
Staff will be seeking comments from the HRAB on the historical elements possibly impacted by
proposed Comprehensive Plan Change. The comments will be forwarded to the Board of
Supervisors.
