F'RE'DERICK Department of Planning and Development 540/665-5651 FAX: 540/665-6395 July 15, 2011 Ms. Connie Carter 130 Rhinehart Lane Gore, VA 22637 RE: VARIANCE REQUEST #02-11 PIN #28-A-22 Dear Ms. Carter: The Board of Zoning Appeals, at their meeting on May 17, 2011, tabled the above referenced variance request and directed staff to conduct further research and to bring the request back to the Board for their meeting on July 19, 2011. After physically measuring the distance from the deck to the road, staff determined that the current setback is 60 feet and the property is not in violation of the Frederick County Code. This issue could have been averted had the correct setback been listed on the building permit for the deck. In conclusion, no further action will be taken on Variance Request #02-11 by the Board of Zoning Appeals; this matter is concluded. You may pick up your building permit in the Inspections and Permits Department. Also, please return the Variance sign so that we can start the process of refunding the $50.00 deposit.
