Winchester, VA 22602 RE: VARIANCE REQUEST #03-11 Dear Sir or Madam: This letter is to confirm that the above -referenced variance application was approved by the Board of Zoning Appeals at their meeting on June 21, 2011. The request on parcel identified by Property Identification Number 75-5-10 was approved by the BZA to allow a four and one half foot variance, resulting in a setback of five and one half feet, for an interstate sign as required by Section §165-704.05 D (1). Included within the motion to approve is a stipulation that this incursion into the zoning buffer will be at the applicant's risk and liability should any problems arise from the future excavation on the interstate right-of-way. The property is located on the southwestern quadrant interchange for Route 37 and Route 11 in Kernstown, in the Back Creek Magisterial District.
