IV and CHARLES E. HARPER, parties of the first part, hereinafter referred to as the Grantors,
and STEPHEN SURBER and MENE SULLIVAN, husband and wife, parties of the second
part, hereinafter referred to as the Grantees, whose address is: 407 S Stewart Street,
Winchester, VA 22601
; and LAKE ST. CLAIR, INCORPORATED, a nonstock Virginia corporation, Additional
Grantor, herein referred to as the "Association".
WITNESSETH:
That for and in consideration of the sum of TEN and 00/100 DOLLARS ($10.00) and other good
and valuable consideration, cash paid in hand, the Grantors do hereby GRANT, BARGAIN, SELL
AND CONVEY with GENERAL WARRANTY and ENGLISH COVENANTS OF TITLE unto
the said Grantees, as tenants by the entirety with full rights of survivorship as at common law and
not as tenants in common in fee simple, the following described property:
All of that certain lot of land located about one and one-half miles West of Cedar
Grove, in Gainesboro Magisterial District, Frederick County, Virginia, designated
as Lot No. 10 as shown on the plat of Lake St. Clair, Incorporated, which plat is
recorded with a Deed of Dedication dated January 30, 1959, in the Office of the

Clerk of the Circuit Court for the County of Frederick, Virginia, in Deed Book 256,
at Page 127; AND BEING the same land conveyed to Robert G. Harper by Deed W
dated October 31, 1960 of record in the aforesaid Clerk's Office in Deed Book 269
at Page 399. Robert G. Harper died testate on January 8, 2015 and by his Will
recorded in the aforesaid Clerk's Office as Will File Number 150000081, he
devised the aforementioned property to his two sons, Robert G. Harper, IV and
Charles E. Harper. Reference is made to the aforesaid plat, deed and the references
contained therein for a further and more particular description of the property
conveyed herein.
This conveyance is made subject to the easements, restrictions, conditions and reservations
contained in duly recorded deeds, plats and other instruments constituting constructive notice in the
chain of title to the property hereby conveyed which has not yet expired by limitation of time
contained therein or have not otherwise become ineffective, and to all matters visible upon a
physical inspection of the property,
Lake St. Clair, Incorporated, additional Grantor, joins in this instrument for the purpose and
does herby consent to the transfer of the above described property in accordance with this deed,
does further acknowledge that, to the best of its knowledge, the property is in compliance with the
restrictive covenants set forth and recorded in the aforesaid Clerk's Office in Deed Book 256, page
127, and that it does hereby waive, as to this conveyance, its right of first refusal as set forth in
Article X, Section 2 of the aforesaid restrictive covenants, but confirms that such right of first
refusal remains in force as to any future conveyance of the property as hereinabove set forth:
