Reference is hereby made to the aforesaid instruments and the references contained therein for a further and more particular description of the property. Tax Map No.: 43-21-9 This conveyance is made subject to all easements, rights of way and restrictions of record affecting the subject property, including, but not in any way limited to, those restrictive covenants and conditions set forth in the hereinabove referenced Declaration of Protective Covenants Of Carroll Industrial Park dated February 5, 2007, of record in the aforesaid Clerk's Office as Instrument No. 070002103; provided, however, that the foregoing shall not be deemed in any way to reinstitute or republish any restrictions of record that may have expired or lapsed. The conveyance of the hereinabove described property is made, in part, upon the condition that the Grantee, and its successors and assigns, shall on or before December 30, 2007, at the Grantee's sole cost and expense, construct a berm 6' in height, along the eastern, southern and western boundaries of the property. The berm shall have a surface area 10' in width at the top, with the sides constructed at a 3/1 slope. Grantee agrees to plant a row of White Pine Trees, 10' on center, staggered, and a row of Leland Cyprus Trees, 10' on center, staggered along the top of the berm. Such work shall be performed in a good and workmanlike manner by Grantee, at Grantee's sole cost and expense. All trees planted by Grantee shall be maintained in good condition. Any dead or damaged trees shall be promptly replaced by Grantee. The terms of this paragraph shall extend to and be binding upon the Grantee and its successors and assigns.
