Mr. Artz,
My wife and I live at 239 Woodcrest Drive in Frederick County. Our property borders the southern
portion of the property that was recently purchased by Richie Oram and Debra Johnson_ It is my
understanding that, in their efforts to build their home, Richie and Debra have encountered an
ordinance that many of us in the neighborhood were not aware of — a 200' setback requirement for
property bordering an orchard.
I don't know the particular reasons for the 200' setback requirement but our neighborhood is densely
wooded and there is a significant forest buffer between their desired house location and the orchard. I
must wonder if the ordinance was created with open field subdivisions in mind. In this case there would
be 100' of densely wooded land buffer. That would seem to be an overall better buffer than, say, 200'
of open space.
I fully support Richie's and Debra's request for variance to reduce the setback requirement from 200' to
100'. The variance has no negative impact upon the neighborhood and would not appear to have any
negative impact upon the operation of the orchard.
I have a scheduling conflict and cannot attend the hearing. I would invite you to share my thoughts with
the county commissioners who will review this request. I encourage them to support the variance
request.
