RE: Waveland Farm Conditional Use Permit, Frederick County
Mr. Smith,
I am providing the attached information to summarize various communications pertaining to
the referenced Conditional Use Permit request, and to obtain your approval. Salient
communications occurring after submitting the initial CUP request for comments to VDOT are:

1. Additional information was provided to VDOT concerning the number of participants attending
events at this location. This information is contained in the attached CUP application.
2. The property owner provided information, including a sketch, showing how the existing private
property entrance on Marlboro Road (Route 631) will be gated, and described how the gate will be
closed during events. Event participants will use a newly constructed access point on the Abigail
Way cul-de-sac to access events. A copy of the sketch showing the planned gate configuration is
attached to the CUP application.
3. An on-site meeting was held on February 8, 2018 with Mr. Lloyd Ingram of the VDOT Edinburg
Residency to review the connection between the Abigail Way cul-de-sac and the Waveland Farm
driveway. Mr. Ingram said he considered the connection to be a driveway connection and did not
see a problem with it.
4. 1 asked Mr. Ingram if Abigail Way and Nittany South Way could be brought into the VDOT system
since the connection between Abigail Way and the Waveland Farm driveway now connects three
existing homes to Abigail Way; 1209, 1211, and 1215 Marlboro Road. He is reviewing this request.
5. A meeting was held with the Frederick County Zoning Administrator concerning the status of Abigail
Way and Nittany South Way. The roads have been dedicated to Frederick County but have not yet
been taken into the VDOT system. A bond has been posted by the developer and is to remain in
force until the roads are taken into the VDOT system. The Waveland Farm owner has entered into
an agreement with the developer to provide some maintenance activities on these roads.
I trust this provides the information needed for your approval of the Waveland Farm
Conditional Use permit request.

2012 Virginia Construction Code (Part 1 of the Virginia Uniform Statewide Building Code)
states:
Section 102 Purpose and Scope
Section 102.3 Exemptions. The following are exempt from this code:
6. Farm buildings and structures, except for a building or portion of a building located
on a farm that is operated as a restaurant as defined in Section 35.1-1 of the Code of
Virginia and licensed as such by the Virginia Board of Health pursuant to Chapter 2
(Section 35.1-11 et. seq.) of Title 35.1 of the Code of Virginia. However, farm
buildings and structures lying within a flood plain or in a mudslide -prone area shall be
subject to flood -proofing regulations or mudslide regulations, as applicable.
Chapter 2 Definitions
FARM BUILDING OR STRUCTURE. A building or structure not used for residential purposes,
located on property where farming operations take place, and used primarily for any of the
following uses or combination thereof:
1. Storage, handling, production, display, sampling or sale of agricultural, horticultural,
floricultural or silvicultural products produced in the farm.
2. Sheltering, raising, handling, processing or sale of agricultural animals or agricultural
animal products.
3. Business or office uses relating to the farm operations.
4. Use of farm machinery or equipment or maintenance or storage of vehicles,
machinery or equipment on the farm.
5. Storage or use of supplies and materials used on the farm.
6. Implementation of best management practices associated with farm operations.

Dear Mr. Stowe:
The Frederick County Historic Resources Advisory Board (HRAB) considered the above referenced
Conditional Use Permit application during their meeting on January 16, 2018. The HRAB reviewed
information associated with the Rural Landmarks Survey, information from the Virginia Department
of Historic Resources (VDHR) and information provided by the Applicant. This application seeks to
operate an event center at 1211 Marlboro Road, Stephens City. This property is within the Back Creek
Magisterial District.
Historic Resources Advisory Board Comments:
The Study of Civil War Sites in the Shenandoah Valley, published by the National Park Service, does
not identify the proposed site or the surrounding areas as being part of a battlefield. The Rural
Landmarks Survey Report for Frederick County, Virginia, identifies three structures located within
the vicinity of the proposed Conditional Use Permit, one of those (Waveland) is located on the subject
property.
After reviewing this information and the Applicant's materials and proposals, the Historic Resources
Advisory Board (HRAB) recommended approval of the Conditional Use Permit as presented.
