Box 2740 Winchester, VA 22604 RE: H H Hunt Appeal Dear Mr. Lawson: BNTYof FREDERICK Department of PIanning and Development 540/665-5651 FAX: 540/665-6395 This letter is to inform you that the County of Frederick has removed the above -referenced appeal, which was scheduled for hearing on April 15, 2008, to the County Board of Zoning Appeals. Research of County records indicates that the Board of Supervisors, at their February 26, 1997 meeting, approved an amendment to the Frederick County Zoning Ordinance to add assisted living care facilities within the B-2 zoning district. I am enclosing a copy of the Board minutes reflecting these changes to allow assisted living care facilities in the B-2 zoning district. Therefore, the zoning determination letter dated February 20, 2008, is void and HH Hunt can move forward with their proposed rezoning on Route 50 West. Please return the appeal sign to this office. We will, at that time, start the process for refunding the BZA fees.
