APPEAL: To appeal the decision of the Zoning Administrator in the administration of the Frederick
County Zoning Ordinance pertaining to disallowing a proposed assisted living facility in the B2
Zoning District.
REASON FOR APPEAL: Applicant is appealing the decision of the Zoning Administrator as to
types of uses allowed in the B2 Zoning District, under Zoning, Article X Business and Industrial
Zoning Districts, Section 165-82B(1) District Use Regulations.

STAFF COMMENTS:
STAFF CONCLUSIONS FOR THE APRIL 15 2008 MEETING: Staff is requesting to affirm
the decision of the Zoning Administrator in the administration of the Frederick County Zoning
Ordinance, Chapter 165, Article X Business and Industrial Zoning Districts, Section 165-82B(1), that
an assisted living facility with a residential component is not an allowed use in the B2 zoning
district.
