BOARD OF ZONING APPEALS HEARING DATE: April 15, 2008 - Pending LOCATION: The subject property is located on Echo Lane, which is approximately 0.25 miles west of the Route 37 Bypass on Route 50 West. MAGISTERIAL DISTRICT: Back Creek PROPERTY ID NUMBERN: 53 -A -81,53-A-82 and 5313-3-25 PROPERTY ZONING & USE: Zoning: RA (Rural Areas) District Land Use: Vacant ADJOINING PROPERTY ZONING & USE: North: Land Use: East: Land Use: South: Land Use: West: Land Use: APPEAL: To appeal the decision of the Zoning Administrator in the administration of the Frederick County Zoning Ordinance pertaining to disallowing a proposed assisted living facility in the B2 Zoning District. REASON FOR APPEAL: Applicant is appealing the decision of the Zoning Administrator as to types of uses allowed in the B2 Zoning District, under Zoning, Article X Business and Industrial Zoning Districts, Section 165-82B(1) District Use Regulations. Appeal Application #02-08, HH Hunt Corporation April, 2008 Page 2 STAFF COMMENTS: STAFF CONCLUSIONS FOR THE APRIL 15 2008 MEETING: Staff is requesting to affirm the decision of the Zoning Administrator in the administration of the Frederick County Zoning Ordinance, Chapter 165, Article X Business and Industrial Zoning Districts, Section 165-82B(1), that an assisted living facility with a residential component is not an allowed use in the B2 zoning district.
