decision. (This may be provided on separate sheet.)
The properties are not in violation of approved proffers. The use "Public
buildings" encompasses the use of property for the hosting of events at the
premises for weddings, receptions, public presentations, charily gatherings and
other special and corporate events. A salon is not operated by the owners on the
premises although people use the premises for salon type services in conjunction
with events held on the premises.
11. Additional comments, if any:
The Frederick County Code does not specifically define the use of a premises as a
"Public buildings". The owners have opened the premises to the public for use as
an event center for many years. There has never been a complaint by anyone that
the use of the premises is a problem in any regard. The suggestion that the uses
on the premises violate the zoning for the property is staff driven. The owners
attempted to cooperate with staff to clarify the term "Public building",
that endeavor resulted in county staff seeking _ to impose restrictions on the use of
the premises beyond those currently permitted. The building located on. the
property has been used since at least 1949 for public functions. It was used for
commercial activity since 1972. The owners contest the suggestion a"certificate
of occupancy" is required for the uses engaged by the owners on the property as
historical usage of the grope . exempts the property from having to obtain a
"CO." The property has always been used as a public building. No use has
changed from historical uses.

Appeals (BZA) to overrule the administrative interpretation of the County Zoning Ordinance as
described herein. I agree to comply with any conditions required by the BZA.
