This letter is to confirm that, on behalf of your client, the above referenced appeal application has
been withdrawn. The appeal application was a result of a letter dated March 3, 2011 from the Zoning
Administrator concerning Building Permit #0736-2010 and in which Section 165-201.6G(7)(c),
signage height for this site not to exceed 12 feet, and Section 165-201.6H(7)(c), signage size for this
site not to exceed 50 square feet, of the Frederick County Code was cited. The subject property is
located at 241 Garber Lane in the Shawnee Magisterial District.

I write to confirm our conversation of July 14, 2011 wherein it was agreed that based upon
your Department's tentative approval of the improvements to the structure at 241 Garber Lane
proposed by Carter+Burton Architecture, the above referenced appeal of the denial of a permit for
construction of a free-standing sign is hereby withdrawn.
As we discussed, final approval of a permit to allow the proposed modifications to the
building to be constructed is contingent upon further review of the site by your department, and may
include the requirement that a formal site plan be submitted by my client and approved.
It is my hope that these improvements to the building, in compliance with Frederick County
and State Codes, can be approved and built in a timely manner, bringing a swift conclusion to this
case in a manner that is both satisfying to my client and your office. With kind regards, I am
