Dear planning Commission Mernber:
In order to meet the intent of -dhe motion to table my CUP # 17-00 request, I have done
the following in order to crake the activities acceptable to the neighbors:
1. On November 18, 2000, a letter was sent to the three neig Dors who sent the
petition to the Planning Commission with copies to I` L. David Newlin and to fir.
Kris Tierney. In this letter I explained why the expanded CUP was requested and
in what portion of the house and on what part of the propertythe seminars,
weddings and receptions would be held along with a brief description of each. I
stated that I want the CUP to be time linuted and ;will make such a provision in
my will if necessary. Further, 1 stated that I would be willing to discuss the letter
v ritah: t.•lem.
2. Because no response was provided by hese neighbors or Wir. New ir., I
telephoned each of then on November 30, 2000, in order to ask them if they
understood the letter and if they had any questions.
3. I developed a set of Rules & Regulations for seminars and a set for weddings and
receptions and sent them by email to Mr. Jeremy Camp for his comments. He
stated in an email message that they were acceptable.
A. On December 7, 2000, Mr. H���ard and Mr. Newlin came to the house to discuss
the CUT request. I gave thein a copy of both sets of 4 he Rules & Regulation:, for
their review.
On December 8, I sent a slightly revised copy of both gets of the. Rcles &
Regulations to all of the neighbors that were listed in the CUP request with an
invitation to call me if they had any questions. I mentioned that I assumed the,
date at which they would be discussed would be on January 3, 2001.
6. The primary use of my home will be as a feed and breakfast. This wi!] limit the
number of other activities. My husband and I will not promote the use of our
house for weddkigs of ter than dhrough an agreement that may be developed with
the Vai ey Wedding Chapel or haveweddings of close acquaintances. V!e wili

Rules & Regulations
Weddings & Receptions
1. All weddings shall take place on the front lawn or within the house.
2. There shall be no more than 50 participants.
3. Music for an outdoor wedding ceremony shall be at an acceptable volume so as
not to disturb the neighborhood.
4. All food and refreshments shall be catered within the house.
5. Music for a reception shall be allowed only within the house.
6. All attendees shall be instructed as to the property boundaries and will be
encouraged to use only the front lawn, the area around the swimming pool, and
the woods and open space between the house and VA -739.
7. No loud noise or abusive language shall be tolerated.
8. The event shall last no longer than three hours.
9. All parking shall be in designated areas with no vehicles blocking the driveway.
Seminars
1. All seminars shall be held primarily in the lower level of the house. Breakout
sessions may be held on the front lawn or the area surrounding the swimming
pool.
2. There shall be no more than 50 participants.
3. All food and refreshments shall be catered within the house or on the back patio.
4. Music shall be allowed only within the lower level of the house.
5. All participants shall be instructed as to the property boundaries and will be
encouraged to use only the front lawn, the area surrounding the swimming pool,

STAFF CONCLUSIONS FOR 11-01-00 PLANNING COMMISSION MEETING:
Approval of this conditional use permit would be appropriate with the following twelve eleven
conditions (conditions 1-4 were placed on the bed and breakfast on December 8, 1999):
1. All review agency comments and requirements shall be complied with at all times.
2. In accordance with Cottage Occupation sign requirements, signage for the proposed use may
not exceed (4) four square feet in area. A sign permit will need to be issued by the County
Building Inspections Department prior to the placement of a sign.
No more that (3) three bedrooms shall be utilized for the bed and breakfast operation.
4. Any expansion of the bed and breakfast shall require a new CUP.
5. Parking will not be permitted anywhere along the access road of the property if that parking
prevents complete internal circulation.
6. The owner is responsible for keeping the trees and vegetation cut to at least 14 provide a
minimum vertical clearance of 14.5 feet in height along the entire access road.
7. No inore than 50 persons at one finie may attend the The maximum occupancy load during
any wedding, wedding reception, seminar, or other gathering shall be 50 persons.
Except for music used during wedding ceremonies, all forms of music and dance are to be
kept within the house. Music, whether performed or pre-recorded, should not be audible
beyond the property lines.
9. The existing natural screening between the house and the adjoining properties is to be
maintained in a healthy condition.
10. No wedding, reception or seminar will begin before 7:00 a.m. or last beyond 9:00 p.m.
Weddings and receptions are to be limited to three hours in duration.
11. All gatherings, other than wedding ceremonies are to be held within the house. Wedding
ceremonies shall be permitted within the lawn area directly in front of the house. Any change
in the location of the gatherings shall require a new CUP.

Mrs. Kriz,
I received your email this morning and I do not have any problems with
the set of rules and regulations you will be showing the neighbors. At
this point, staff does not plan to incorporate these into the actual
conditions of the permit. Nonetheless, it will be shown to the
Commission at your public hearing. I believe these rules and
regulations more specifically explain your intend than the previouse
letter did.
In regard to your suggestion that staff remove conditions 5 and 6, I do
not believe that this would be appropriate. The Fire Marshal and staff
agreed on adding these conditions to address the parking and access
concern. If there is a specific reason why these idems are a problem
for you, let me know your opinion, and staff will take it into
consideration. Also, staff does not have a problem rewording condition
10 as you suggested.

Good Evening, Jeremy:
Since your visit to inspect our premises on November 20, the following has taken place:
1. A letter dated November 18, 2000, was sent to the Hillyards, Fetters and Farleys with a
copy to Newlin and Kris Tierney. You received an email copy.
2. Because no response was received as of this date, I telephoned Paul Hillyard, Bob Fetter
and Phil Farley this evening and asked each of them whether they had received their
letter. Following a brief discussion, I suggested that each of them come over to the house so I
could show them the areas that I am proposing to use for the weddings, receptions and
seminars and to have further discussions to respond to any of their concerns. I also
telephoned David Newlin, but there was no answer so I left a message as to the purpose of
my call and to return a call.
The attachment to this email contains proposed sets of Rules & Regulations for Weddings &
Receptions and Seminars. These will be shown to each of the above mentioned people when
they come to visit. I am requesting that you review them and make any comments.
In reviewing the conditions that you have developed to date for the CUP, I would suggest that
Items 5 and 6 be deleted as they contain conditions that ordinarily be done in any safe
operation. In particular, Item 6 was not clearly defined by the Fire Marshall during the request
for the Bed & Breakfast, otherwise it would have been taken care of at that time.
Items 7, 8, and 9 are very appropriate.
I would suggest that Item 10 be rewritten as: No wedding, reception or seminar will begin
before 7:00 am and last beyond 9:00 pm. Weddings and receptions be limited to three hours.
I request that no limit to the number of events be included as the weather will define the
number of weddings and one would normally expect that they would be held only on
weekends. Receptions may be held any time and normally seminars would be held during the
week. My husband and I intend to handle all of the work associated with any of these events
and thus, this would limit them also.

Chairman DeHaven said that he would abstain from discussion and voting on this application
due to a possible conflict of interest. He then turned the chair over to Vice -Chairman Marker.
Mr. Mark R. Cheran, Planner 1, read the background information and review agency
comments. Mr. Cheran said that the proposed conditional use permit (CUP) is for an expansion of a previously
approved landscape contracting and garden center, referenced as CUP 4012-97. He explained that this
expansion is for an additional 9,600 square feet of open and enclosed display areas, and outdoor storage areas
located toward the front of the property, adjacent to Northwestern Pike.
Mr. Cheran continued, stating that a land use plan, tailored to the Round Hill Community, has
been developed as a part of the Frederick County Comprehensive Plan and recommends that visual disruption
to the Route 50 corridor be minimized by controlling the size, location, and number of signs. Mr. Cheran stated
that staff is recommending limiting the number of business signs to one and limiting a maximum of 50 square
feet in area to achieve this objective. Mr. Cheran also noted that an engineered site plan will be required for
the proposed expansion.
Mr. Michael M_ Milani, the applicant, was available to answer questions from the
Commission.
There were no public comments and no issues of concern were raised by the Commission.
Upon motion made by Mr. Miller and seconded by Mr. Thomas,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend
approval of Conditional use Permit # 18-99 of Michael M. Milam for a Landscape Contractor's Business and
Garden Center at 2186 Northwestern Pike with the following conditions:
All review agency comments must be complied with at all times.
An engineered site plan shall be approved by the County.
One (1) business sign shall be allowed along Northwestern Pike (Rt. 50); this sign shall be limited to
a maximum of fifty (5 0) square feet in area.
4. Any expansion of use or change of use would require a new Conditional Use Permit.
*Conditional Use Permit 924-99 of Rhoda Kriz to establish a Bed & Breakfast as a Cottage Occupation.
This property is located at 547 Apple Pie Ridge Road and is identified with P.I.N. 42-A-206 in the
Gainesboro Magisterial District.

In addition, Ms. Lohr stated that the proposed use will take place in the existing house and the applicant has
identified three rooms which would be rented in association with the bed and breakfast operation. She further
stated that in evaluating the site, it was evident that the dwelling in which the business will occur is adequately
screened from all adjoining properties by mature vegetation; and, in addition, the dwelling is located
approximately 800' from the Apple Pie Ridge Road right-of-way.
Ms. Rhoda W. Kriz, the applicant, was available to answer questions from the Commission.
There were no public comments.
No issues of concern were raised by the Planning Commission. They believed that the
proposed use would not impact the existing community in a negative manner.
Upon motion made by Mr. Miller and seconded by Mr. Thomas,

Ms. Lohr stated that this application is to allow a cottage occupation within an accessory structure and,
specifically, will allow one non-resident employee, the applicant, to operate an ice sculpting business from an
existing garage. She continued, stating that the adjoining properties appear to be adequately separated from
the location of the proposed use and the garage is located approximately 40' from the Route 11 right-of-way.
Ms. Lohr stated that there will be no excessive noise or odor resulting from the operation. She said that there
will be no retail element on the site, however, occasionally, a service truck will deliver ice to the site.
