I had the distinct pleasure of attending my first Board of Supervisors meeting this past week. It was
truly an enlightening experience. I feel compelled to write you and share my impressions. I have been
a resident in Frederick County for 19 years, always in this district. I have been a homeowner for 22
years. The behaviors I witnessed at this meeting concerned me very much as I have always had a
negative impressions of politicians from the media and previous beef encounters. My opinions will be
hard to change, but as adults and parents, I think we should see as our mission to pass on the very
best of our values to our children. I think we have a prime opportunity any time we are asked to speak
in a public forum. I think the public forum I witnessed this past week did not use that opportunity to our
best advantage. There were high school students present, and I have heard from my own high school
student erroneous information has been passed on concerning the Long Hill Bed and Breakfast. My
own daughter was astounded when she found out I had spoken in favor of expanding the Long Hill
CUP to included small meetings and wedding ceremonies, "...where alcohol would be served in
abundance". Although I assured her, I would never speak out in favor of this type of plan, I was
saddened to note that she had received this message from her peers at James Wood High School. I
can only guess at its source.
Mr. Chairman, to have allowed numerous attacks on your colleague without addressing that issue the
first time it came up was disconcerting. I wonder had the personal attack been addressed to you, if the
first instance would not have been the last. I also found your not allowing the owners of the Bed and
Breakfast to make a closing statement, when they had requested that at the onset of their talk, was
poor etiquette. If you had forgotten that you had not turned down that request, a gesture of humility by
acknowledging that and allowing them to speak, would have set a wonderful example/precedent.

I applaud the public forum and the opportunity for your county residents to voice their opinions. The
general "rules of engagement" are very fair and I felt were well followed. As I personally and
professionally know many of the speakers, I can only wonder that their perceptions can distort fact and
fiction so glibly in this forum. Again, I am speaking for our impressionable youth, not me, a jaded older
constituent. While I understand the sensitive nature of the Bed and Breakfast request affects the
surrounding neighbors to a greater degree than someone "...who lives eight miles out...", I feel any
resident of Frederick County should have their opinion carry equal credence. After all, my assumption
is that the Frederick County Board of Supervisors' job is to make decisions for the good of the county,
not the simple good of the most vocal locals.
Lastly, I did not personally know the Kriz family. I stopped at their place one day this summer when
saw the Bed and Breakfast sign. I happen to be a great fan of Bed and Breakfast routines; I am not a
hotel hopper. I attend many meetings in my professional capacity and have found meetings at The
Arboretum and Long Branch some of my most relaxing and valuable. How better to improve our minds
and missions than in an area surrounded by nature! (Sony, but the Hampton and Wingate are missing
that. Ah yes, but they do have modems). I was thrilled to see something like the non -hotels I
mentioned located on my ridge. I had toured the facility and booked it for the weekend of the James
Wood High School graduation; the location of the Bed and Breakfast ideal for having a beautiful and
close place for my family to stay and watch my daughter graduate. Unfortunately, my home on the
ridge cannot accommodate very many people comfortably, especially if we all need to shower within
the same 6 hrs. Now, I am wondering if the neighbors of the Bed and Breakfast will treat them kindly.
They are after all strangers, who happen to think I live in one of the most beautiful parts of the country,
and who have looked at homes here, but need different types of work. So, I wasn't a hired gun from
way out there.
I hope any one who saw this on TV or were at the meeting for a learning experience did learn
something. I hoped they learned that the Golden Rule should be as prevalent as Roberts Rules of
Order and your neighbors should be neighborly.

Supervisors May approve
fed & Breakfast Expansion
IMPORTANT UPDATE: A movement is underway to have the Frederick
County Board of Supervisors overrule the Planning Commission and
approve Long Hill Bed & Breakfast's request to expand into a hospitality
business.
If you don't contact each of the supervisors before January 24th,
there is a strong chance that Conditional Use Permit 17-00 will be
approved, despite the 6-2 vote by the Planning Commission to deny the
request. _Please contact each supervisor immediately, and attend their
meeting on January 24th at 7 p.m. in the County Office Building.
Strategy
Long Hill Bed & Breakfast is attempting to neutralize each of the
arguments presented at the public hearing before the Planning Commission.
Written documents may be presented to the Supervisors, indicating that
alcohol will not be served and that the Conditional Use Permit(s) may not
transfer if the property is sold. These were two key points of concern
presented at the Planning Commission Hearing on January 3rd.
The main points that the owners of Long Hill B&B fail to recognize are:
a.) Many area residents did not oppose the original B&B request, even
though they didn't like the idea. Had they known the request to
expand into the hospitality business would be forthcoming, they would
have opposed the B&B initially.
b.) The vast majority of Apple Pie Ridge area residents are opposed to
business encroachment into residential areas..... period! It is a matter
of honoring our zoning and neighborhood covenants. They do not ,,..,.
want this business expansion, or any other business in the =op`
midst of our neighborhoods, two schools, and two churches. _,YT
c.) Apple Pie Ridge is a very busy and dangerous road. Any proposal-- v- ';B
which adds to the congestion in the school zone should be rejected,._. i i

The last sentence of your first paragraph is very disturbing to us. Please
give us the date and time of the incidents of trespassing and noise that
have disturbed the neighbors.
None of the adjoining neighbors have complained to us about noise and the
only comment made about trespassing was determined to be members of our
immediate family who were in Winchester for my mother-in-law's funeral.
We would appreciate a response.

Dear Sir:
Because of a travel commitment we will be unable to attend the
rezoning hearing on the Apple Pie Ridge Long Hill Bed & Breakfast.
However, we are adamantly opposed to a change of the present usage.
It is located near schools, a church (soon a second church), and backs
up to many residences. Even a small number of bed and breakfast guests
has caused disruption and lessened the enjoyment of the
property of those neighbors with incidents of trespassing and noise.
As homeowners in the area we feel we have been taken advantage of in
this matter. A small commercial usage request has been followed
immediately with a request to establish a much busier commercial
facility in an established residential area. It is a totally
inappropriate and unacceptable place for a reception facility serving
alcoholic beverages and creating noise with large numbers of partying
people and their musical entertainment. It does not belong and should
not be further encouraged.
The essence of zoning is to put land to appropriate use. This
commercial unit does not belong on Apple Pie Ridge and may create

serious safety issues on t_ , road. Please disallow it.

Dear Rhoda,
As promised, I said I would get back to you on your Conditional Use Permit
(CUP) request. First of all, I ask myself this question? If I had my preference, would I
want a business in my neighborhood? The answer is obviously no. Your CUP request is
to have seminars and weddings, along with the bed and breakfast. Could I live with this?
Probably. Only if I know the owners and could trust whether good judgment would be
used. I know Rhoda and George Kriz and I believe they would use proper discretion.
However, I emphatically state that there must be notarized conditions attached to the
CUP which are the following:
a. The CUP becomes null and void if the Krizs sell the property, if they become
incapacitated and can not manage the property themselves, or if they are deceased.
b. The CUP has to be re -certified every seven years.
c. The CUP can not be operated by their heirs or passed on to their heirs.
d. The CUP can not be expanded to anything else other than seminars, weddings or bed
and breakfast.
e. The CUP must include the documented rules that the Krizs defined in their letter to
the neighbors.
If these 5 conditions are made part of the CUP, I would not strongly oppose
the CUP. I am only speaking for myself and I can not speak for the other neighbors.

I have read the Rules and Regulations that you have provided for our review.
While I appreciate your attempt to place some sort of control over your proposed
activities, that still does not override my belief that an expansion of your current CUP is further
advancing a commercial venture in a totally residential neighborhood. I find the introduction of a
facility that would offer seminars and wedding receptions to be inappropriate to the existing
complexion of this area.
I should also add that this situation has been the cause of considerable discussion and
anxiety among many of us who would be effected by the potential noise, activity and increased
traffic. It is my concern that you could not guarantee control over guests' behavior, noise level
and general activity level.

could create DTVI issues right near our homes where our children and families must drive
every day. We know and respect Ms. Kriz, but also realise that when someone "rents" a
facility for a reception, it's not always possible to control what gees on.
We also are very concerned about any precedent or perceived softening, of our
zoning requirements that may be projected to individuals seeking exceptions in the Apple
Pica Ridge area in the future. Aside from schools and churches, this land has always been
zonedd and used strictly as agricultural and controlled residential p. operty. it is our
opinion that a huge majority of those who live on the Ridge o gold oppose any changes to
that status, along with any variances that could hamper the quality of life that has been
established There.

We would like to express to you our feelings in regard to the Conditional
Use Permit requested by Rhoda Kriz. We feel, like some of the other concerned
parties, that it would not be in our best interest for such a request to be granted. In
addition to the issues already raised by our neighbors, we have a concern about the
precedent that would be set. If this permit is granted, what will happen when the
next individual decides to request a permit to start a business of some sort?
We understand that Mrs. Kriz intends to do all in her power to see that the
conditions she outlined will be adhered to. However, that may be more difficult
than she thinks.
We hate to have the privacy and peacefulness of this neighborhood

Strong opposition is expressed here by neighbors who feel they would be immediately
impacted by this revision to permit wedding receptions, seminars, etc. at the above location.
This is a residential neighborhood which should be kept as such, and not have any further

Although there was moderate concern regarding the implementation of a Bed and Breakfast at
the home, most neighbors trusted the current owners to control and monitor the business
satisfactorily, not allowing undue noise or disturbances to impact the neighborhood. Up to this
point in time, that has been acceptable.
However, the potential ramifications of an expanded operation as applied for, are of great
concern to many of us in the area. Some of these concerns are listed below.
1. Upon eventual sale of the property to new owners, the permits are conveyed along with
the property. Any future owner would be of even greater concern because of being an
"unknown entity", and could propose more objectionable plans which would not be
sensitive to the neighbors, some of whom have lived here as long as 28 years.
2. Wedding receptions usually involve numbers of people, music unsolicited by the
neighbors, and a higher level of activity and noise than a Bed and Breakfast. Because our
homes are situated directly and closely behind the Bed and Breakfast as well as potential
entertainment areas, we are certain that the noise from the gatherings would filter into our
locations.
3. As stated in the letter from the Dept. of Planning, the phrase "other gatherings such as
seminars, etc." leaves a vast opening for various types of activities that would be
unsuitable in a quiet residential community such as this. How large would the seminars
be, at what time of day or night would they be held? In particular, at the end of the
sentence, the abbreviation "etc." could allow for a multitude of events, over which the
neighbors would have no recourse once this permit is allowed.
It is with these major concerns in mind, we petition the Planning Commission to deny the
request of the applicant, Rhoda W. Kriz and George Kriz, to convert property located at 547
Apple Pie Ridge Road from Conditional Use Permit #24-99 to Conditional Use Permit #17-00.
Once again, we feel strongly that this is a residential area and must be protected from further
intrusive commercial ventures, both now and in the future.

R has been my, pleasure to. be.a guest at George and ,Rhoda Krizs' home, to celebrate the
completion of the xemodeling undertaken to accotntnodate th-:ir new venture They have a
lovely home, and are the most gracious hosts imagixiable. 'I'tic privacy, atmosphere and
hospitality they have to offer make Long Hill a wonderful place to visit.
I contacted Rhoda ICriz in hope of her being able to host a Pla.niung Retreat for the Town of
Stephens City. She explained the conditional use permit under which she is currently
operating. She also told me that she had applied for a CUP to be able to host special events,
but the permit was pending approval. I tell you this so you wiU know that she has been
abiding by the conditions imposed on her business, and I believe tbat she will continue to do
so. Would anyone have kno�r-ri had she hosted our planning :etreat? Ptobably not. She
chose to stay within the guidelines as set forth by the county for .ger busixiess to opcmte.
I, was present for the Public Hearing held on January 3, 2001. 1 listened to the long list of
conditions imposed on CUP 17-00, and I heard the plazuung staffs recommendation of
approval. I heard Rhoda Kris agree to abide by each and evcry one, even stating that she
had additional self imposed rules of use- I listened to the fust three public opinions.
Regretfully; I had to leave after I spoke due to a previously scheduled ,meeting. The
opposition I heard was a bad case of NIMBY (not in my barky4rd). Apple Pie Ridge is and
has always been a very nice area. Adjacent prop,-rty owners coocerus about propcay values
and future commercialization of the area are a bit extreme. The amount of land surrounding
Long Hill, the lay of the land and the mature trees on the property mare it very private. I
doubt most neighbors can even see their house. The xcsidents who arc so adamant that the
CUP be denied have a high school football stadium next door. The issues of traffic, noise,

trespassing, safety of the neighborhood children, and alcohol consumption are more than
likely problems being generated by the high school every dme a game, pep rally, or
graduation is held,
There is a reason why the permits are conditional. If actual verifiable problems occur, the
permits can be revoked. Please approve CUP 17-00 and address problems if they arise. As
the leaders of our community, I know the Board strives to be proactive_ I hope you see this
use of a bed and breakfast/ private home is so benevolent Glictc e7usts no need to assume

We are writing concerning the Long Hill Bed and Breakf-,:,quest to expand their
services to a Hospitality businoss. Even though it was `rely a4 zrit at the Planning
Commission meeting ofJanwery 3, 2001 that the Apple Pie R ":-;y neighbors were
opposed to the zoning request, we understand there is a good e.' -Dice that the Board of
Supervisors will approve the request anyway at your January '�:, meeting. We oppose this
approval for the following reasons -
1) Apple Pie Ridge Road is a residential/agricultural arez _ id has been zoned as
such. We do not want this to change.
2) There are great traffic congestion problems in the nticask of the high school,
elementary school, the existing church, and future MF!,hodist church. Why would
you warn to increase this congestion?
3) We oppose the serving of alcohol at any of their everjO gar obvious reasons.
4) This busi.-iess venture of the Kris' would only benefit Why would you
ignore the concerns of many constituents for the benc�i i of only one constituent?
5) When the Kris' asked for a rezoning for the Bed and €ir-akfast, we as good
neighbors warily accepted it. At the time, however, we were unaware of their
next plan — the hospitality center. If this is approved, what would stop them from
asking for more? Is this going to be a miniature Altou Echols battle that
Berryville has had to contend with for years? Is thatr'�:.at you want for the Apple
Pie Ridge area7 What happens when John Doe down road decides he wants to
have a business? What if the White Hall Store decier.s do sell out to a Sheetz
equivalent? Where do you draw the line?

Dear Planning Commission Member:
In order to meet the intent of the motion to table my CUP # 17-00 request, I have done
the following in order to make the activities acceptable to the neighbors:
1: On November :18, 20{ 0, a letter was sent to the -three neighbors who sent the
petition to the Planning Commission with copies to Mr. David Newlin and to Mr.
Kris Tierney. In this letter I explained why the expanded CUP was requested and
in what portion of the house and on what part of the property the seminars,
weddings and receptions would be held along with a brief description of each. I
stated that I want the CUP to be time limited and will make such a provision in
my will if necessary. Further, I stated that I would be willing to discuss the letter
with them
2. Because no response was provided by these neighbors or Mr. Newlin, I
telephoned each of them on November 30, 2000, in order to ask them if they
understood the letter and if they had any questions.
3. I developed a set of Rules & Regulations for seminars and a set for weddings and
receptions and sent them by email to Mr. Jeremy Camp for his comments. He
stated in an email message that they were acceptable.
4. On December 7, 2000, Mr. Hillyard and Mr. Newlin came to the house to discuss
the CUP request. I gave them a copy of both sets of the Rules & Regulations for
their review.
5. On December 8, I sent a slightly revised copy of both sets of the Rules &
Regulations to all of the neighbors that were listed in the CUP request with an
invitation to call me if they had any questions. I mentioned that I assumed the
date at which they would be discussed would be on January 3, 2001.
6. The primary use, of my home will be as a bed and breakfast. This will limit the
number of other activities. My husband and I will not promote the use of our
house for weddings other than through an agreement that may be developed with
the Valley Wedding Chapel or have weddings of close acquaintances. We will
make known the availability of our home for seminars, as accommodations in the
lower level of the house are very conducive to them
I am enclosing a copy of revised sets of the Rules and Regulations for your information.
Further, because the majority of the activities requested in the CUP will be inside the
house or on the part of the property in front of or to the side of the house, I invite you to
inspect the house and property at your convenience. My telephone number is 667-1663.

Dear Dr. Martenson:
Thank you for sending your objections to my Conditional Use Permit #17-00 to
my husband who is on the Frederick County Planning Commission. For your
information, he was not present in the hearing room at the first public
hearing and will not be in the room for the public hearing scheduled for
January 3, 2001.
There is much misinformation surrounding my request, some of which comes
from information distributed in the neighborhood of which I never directly
received a copy. Perhaps the following will provide a clearer understanding
of the request. I do appreciate your comments about the compatibility of
Long Hill Bed & Breakfast in the neighborhood.
First, my residence is primarily our home, and we have no intentions of
letting anyone who would be on our property do anything to disturb the
neighborhood or be destructive to my property.
Second, Long Hill Bed & Breakfast has three rooms that are used for guests.
In addition to the use of these rooms, we have a 1500 sq. ft. recreation
room on the lower level and a dining room, library, atrium and
sitting/office area on the upper level that can be used by the guests.
Third, we always had in mind to request permission to hold seminars in the
recreation room, but did not include this in my initial request because my
elderly mother was still alive, and I cared for her in my house. She passed
away in late September of this year.
Fourth, after the owners of the Valley Wedding Chapel stayed in our Bed &
Breakfast one night, they determined that our property would be suitable for
weddings and asked whether we would be interested in working out an
arrangement with them. We agreed because our front yard has been used
family weddings. The ONLY weddings that would be held on our property would
those arranged by the Valley Wedding Chapel except for family weddings.
Generally, those weddings are very small. We have developed a definitive
set of Rules and Regulations which state that the only outdoor music would
be for the ceremony itself. We will not have any disc jockey on the
property even though music may be played in the recreation room. If there
is any wine, spirited wine or beer served at any reception connected with
the wedding, service will stop one half hour before the three-hour time
limitation for the wedding and reception. We anticipate having very few
weddings being held on the property and most being held during the months of
April through October. We would expect even less to have any extended
reception. Thus, there would be very little increase in traffic on Apple
Pie Ridge Road.
Fifth, several people have come to visit our property after seeing the sign
on Apple Pie Ridge Road. Some of them have reserved all of Bed & Breakfast
rooms and have requested the use of our recreation room for a reception.
Examples include a high school graduation, a Bar Mitzvah and a small family
reunion. We have developed a set of Rules and Regulations for these types
of functions similar to those for weddings and wedding receptions. The
Inspections Department has stated that no more than fifty (50) people can
occupy the recreation room.

Sixth, since we opened Long Hill Bed & Breakfast, we have has contact from
people, who have heard about the size of our recreation room, as to whether
they could hold seminars or sales meetings on our property. This is in
keeping with our original intent mentioned in the third item above.
It may have been possible to accommodate most of the above through my
existing Conditional Use Permit, but I wanted to make sure that I was
following all the requirements of Frederick County. Thus, I submitted the
CUP 17-00 for an expansion of the previously approved CUP. Further_, I
requested that Sheriff Bob Williamson inspect the property so that he could
provide me with any guidance concerning my proposed CUP.
In conclusion, the Rules and Regulations that have been developed should
prevent any noise over and above the current level of noise in neighborhood.
The number of events should not increase the amount of traffic on Apple Pie
Ridge Road during peak traffic times as most of the events will occur during
off peak hours. We will very closely monitor the consumption of wine,
spirited wine and beer so the possibility of intoxicated drivers will be
less than those leaving a private party along Apple Pie Ridge Road. We do
not anticipate that many functions at which wine, spirited wine and beer
will be served.

the property and discuss CUP 17-00 any further, please call me at 667-1663

Dear Sirs,
I live on Woodcrest Drive which is situated immediately behind Long
Hill Bed and Breakfast. I am writing to oppose the request by Long Hill
Bed and Breadfast for a conditional use permit to hold receptions,
meetings, weddings, and other group gatherings, including the serving of
alcoholic beverages.
The reasons that I oppose this conditional use permit are several:
1. Apple Pie Ridge Road is busy enough without adding an
"entertainment business" and it's attendant traffic.
2. I don't want the large numbers of drivers who will have been
drinking alcohol(some undoubtedly intoxicated) on Apple Pie Ridge Road.
This road serves our residential area and two schools in the immediate
area.
3. The noise that this "entertainment business" will bring is not
tolerable. I moved to the county in large part to be in a quiet
setting. This business does NOT have the land buffer to prevent their
music and parties from being a recurrent nuisance.
4. While the concept of a bed and breakfast established in a home is
consistent with our quiet, residential community, this conditional use
permit clearly goes beyond a bed and breakfast usage. It will be an
entertainment business. This does not belong in our residential
neighborhoods.
Please oppose Conditional Use Permit 17-00.

Happy New Year! Hope you had a good holiday!
In preparing for this evening's public hearing I noticed in the Petition
Against Expansion that was submitted by the Fetters, Hillyards and Mrs.
Farley they particularly noted the phrase "other gatherings such as
seminars, etc". They were concerned that the 'etc.' 'could allow for a
multitude of events...'.
I notice the 'etc.' is still in the write-up on the agenda for tonight.
Would it be appropriate for you during your presentation to mention that the
etc. includes 'activities such as retreats, training, sales meetings, board
meetings'.
It is difficult to anticipate what corporations and organizations call the
sessions they would wish to have at a location such as ours. We don't want
to make it too restrictive just because of terminology.
