The Frederick County Development Review and Regulations Committee (DRRC) will be meeting
on Thursday February 22, 2018 at 7:00 p.m. in the first floor conference room (purple room) of
the County Administration Building, 107 North Kent Street, Winchester, Virginia. The DRRC
will discuss the following agenda items:
AGENDA
1) Election of DRRC Chairman and Vice-Chairman. As stipulated in the DRRC
Operating Procedures, a Chairman and Vice-Chairman will be elected during the first
meeting of each year.
2) Dimensional Requirements. Discussion of reducing the side and rear setbacks for age-
restricted and multifamily units in the RP (Residential Performance) Zoning District.
3) Shipping Containers. Discussion of codifying restrictions on commercial shipping
containers.
4) Other.

Access to this building is limited during the evening hours. Therefore, it will be necessary to
enter the building through the rear door of the four-story wing. I would encourage committee
members and interested citizens to park in the County parking lot located behind the new
addition or in the joint Judicial Center parking lot and follow the sidewalk to the back door of
the four-story wing.

Item #2: Dimensional Requirements
Staff is proposing to amend Chapter 165 – Zoning Ordinance to reduce the required side and rear
setback for age-restricted multifamily housing units in the RP (Residential Performance) Zoning
District from 100 feet from the perimeter boundary (with an additional two (2) feet from the
perimeter boundary for every foot that the height of the building exceeds 40 feet. When the
adjacent use is single-family residences) to 50 feet with the same step back provision. Multifamily
residential buildings require only a 50-foot side and rear building setback.
Staff is looking for direction from the DRRC on the appropriateness of this request for a text
amendment to the Zoning Ordinance. Depending on the outcome of this discussion, Staff may
forward this item to the Planning Commission for further discussion.

Item #3: Shipping Containers
Staff is proposing to amend Chapter 165 – Zoning Ordinance to restrict the use of commercial
shipping containers as accessory use/structure in all districts. Presently, mobile homes and
temporary trailers are not allowed as an accessory use/structure; this amendment would further
specify shipping containers as part of this requirement.
§165-201.05. Secondary or accessory uses.
G. In no case shall a shipping container (i.e. a pre-fabricated, durable, steel shipping containers
also known as intermodal containers, cargo containers, freight containers, or ISO containers)
be allowed for permanent storage or as an accessory use except in the M1 (Light Industrial) or
M2 (Industrial General) Zoning Districts.
Tractor truck trailer parking is permitted in the B3 (Industrial Transition) Zoning District, the M1
(Light Industrial) Zoning District, and the M2 (Industrial General) Zoning District as a conditional
use. Temporary storage trailers are allowed in all districts as part of construction projects (and may
not be used for residential purposes), and must be removed prior to issuance of final occupancy.
Staff is looking for direction from the DRRC on the appropriateness of this request for a text
amendment to the Zoning Ordinance. Depending on the outcome of this discussion, Staff may
forward this item to the Planning Commission for further discussion.
