Although not required by FAA, structure should be marked and lighted in accordance with FAA Advisory Circular 70/7460-1 J, Obstruction Marking and lighting, Chapters 4, 8 (M -Dual) & 13. 2. Consideration should be given to the owner/operator of the Timber Ridge Airport which is a private airport located approximately four nautical miles from two of the towers as to possible impact on that facility. These comments are based on the review provided by our engineering firm, Delta Airport Consultants, Richmond, Virginia. They have determined that these proposed towers do not penetrate any FAR Part 77 surfaces however final comment by the Airport Authority is pending on the FAA's determination of Aeronautical Study No. 01 -AEA - 4787 -OE. If the above referenced conditions along with any outlined in the FAA study are met, the Winchester Regional Airport Authority would have no objections to this Conditional Use Permit. Based on the date of the included FAA Form 7460, we believe the October 15 date is an error. We find that the tower does not penetrate any FAR Part 77 Surface associated with the Winchester Regional Airport. The following summary details the location of the proposed tower: White Tale I 62,485' (11.8 miles) I 16,047' (3.0 miles) - right 11,019' MSL Lane This tower is far enough from the airport that it will not be a factor in any future airport development as currently depicted on the approved Airport Layout Plan. However, two private airports, Al and Timber Ridge, both located about 14 nautical miles from Winchester Regional Airport along the extended RW 32 centerline, may be affected as they are each about 4.5 nautical miles from the tower.
