In response to your two inquires: 1. A condition was placed on each approved CUP application stating that "In the event a telecommunications tower is not erected within twelve (12) months of the approval of this Conditional Use Permit, then the CUP will be deemed invalid." Therefore, if you anticipate a failure to comply with this condition, it may be appropriate for you to re -apply for a CUP and have the condition modified, and the time frame extended. 2. The Hunting Ridge tower CUP approval enabled the construction of a 195 foot telecommunication tower. Therefore, you'll need to keep the tower under 195 -feet tall. I know this is different from the original plan but only by a small degree (1 foot) and I wanted to get your input on whether this would be acceptable. Prior to the windshield survey, initial research at the Virginia Department of Historic Resources concluded that there were no archaeological resources within the APE of each proposed cell arca and that no properties were listed on either the National or State Register of Historic Propertics within the three respective areas of potential effect. Although no prol -rties are listed on the National or State Registers, there are properties in the APE that are considered historic. Thus, the windshield survey was performed in order to determine if any properties within the APE might be eligible for the National or State Register of Ilistoric Properties. (Results: Three possible cell tower locations are being considered and ars: located in Frederick County Virginia adjacent to Route; 522. Site #1. Reynolds Store. This site is located approximately ',,z mile south of Reynolds Store and 300 Feet east of State Route 522. The proposed cell tower area is located approximately four miles south of the Reynolds Stare site and roughly 200 feet east of State Route 522. The initial research indicates that there are sixteen properties situated on the Clore 7.5 topographic quadrangle within the APE that are considered historic. As with the windshield survey executed for the Reynolds Store proposed tower site, this survey also indicated that many renovations and alterations had been performed on the properties. Including new siding, windows, doors, additions, and chimneys. Site 3: Hunting Ridge:. '1'llis proposed project area is located on the White Mail 7.5 topographic quadrangle approximately four miles northwest of Winchester Virginia and roughly ',% utile north of State Route 522. They initial research indicates that there are eleven properties located within the APL: that are considered historic. Tike the: above-mentioned properties, the properties considered to be historic: in this APS' had also been subjected to numerous alterations and additions. Conclusion: The initial research indicated that no archaeological resources were located within the one - mile area of potential effect. Thus, the possibility of archaeological resources being located in the small project area is remote. Within the three areas of potential effect, there are forty properties that are considered historic, A windshield survey of these properties suggested that any historic significance the structures may have had was removed by years of alterations and additions. There is no evidence that the properties are associated with historically significant events or people, 'Che cemeteries associated with churches in the AsPE have no distinctive features nor have historically important peoples interned within the borders_ Also, the churches have no original distinctive features. At this hearing, we presented three conditional use permit applications for three proposed communication towers. During the course of this hearing, it was brought to our attention that Triton and its contractor, SpA Communications, has also submitted conditional use permit applications for towers to be located in Frederick County. After further discussions today, Decemlmr 6, it has been clarified that these conditional use permit applications have not been submitted as of this date.
